Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.The evening of August 5th when Mr [redacted] came to our home after pm unannounced and uninvited he attempted to gain access to our home with physical force Plain and simple He never acted professionally throughout the entire process of this project and was uncommunicative and unresponsive many times forcing multiple attempts to contact him to find out what was going on Most of what he is alleging in his response is simply untrue We have never visited tile stores with him We were lucky to get him to meet us once at HOBO after multiple cancellations on his part The Glendale Police Department has charged Mr [redacted] with battery and has referred the case to Detective Brinkle of the department due to the fact that he has committed Theft By ContractorBelow is the letter the we provided to the officer who came to our home to take our statement.For Officer [redacted] Our attorney [redacted] requested that we tell you the following, specifically that Todd [redacted] told us that the initial $2,we gave him on 4/17/was used for other people's projects and that according to him this was common practice by contractorsWe have learned from having other contractors look at our project in order to have it completed that this is an unlawful action on his partWe have learned that contractors are required by law to appropriate funds received from a customer to their project only and are not allowed to re-appropriate or use in anyway those funds for any other customers.His bid for services included $3,for plumbing work this included moving plumbing in the ceiling and rearranging underground drains, installing the shower system and the steam generatorThe bid also included $for labor to install plastic to protect the passageway leading to the construction areaAs of July 6th when the plumbers came to dig up the basement floor, the installation of the plastic protection is the only work he had done other than removing the wall between the existing bathroom and the unfinished area of the basement where the new shower stall is to be builtFollowing is a recap of the sequence of eventsWe paid a deposit of $2,on April 17th to begin the project which did not start in earnest until July 6thPrior to that on July 1st Todd [redacted] informed us that in order to get the plumber to begin he would need another $2,dollars to pay the plumber ( [redacted] ***) a down payment or he would not start When we inquired why he needed another payment since no work had started other than the hanging of some protective plastic with duct tape and removing the wall between the existing bathroom and the area where the new shower was being built, he told us that he used the money we gave him for different job (he quickly said "this a common practice of contractors") he was working on From July 6th through July 18th the only work done and completed was by the drain plumbing installation in the basement floorBetween July 18th and July 20th they began installing some of the framing and an electrician came and roughed in all of the necessary wiring for lights, fans and the steam generator On July 21st Todd [redacted] requested another $2,payment to order the tile we selected with him at the Tile Shop in Brown Deer.From the 21st of July and the 5th of August the framing of the shower and installation of a vapor barrier and sheet rock was approximately 20% completeIt was on August 5th that we informed Todd [redacted] via text message that we were not pleased with the progress of his workSince the incident at our home on August 5th when Todd [redacted] assaulted me, we have come to learn the following information:He did not pay [redacted] ***, the plumberHe did not pay the electrician and his bill was sent to us (a copy included) stating if not paid a lien will be placed on our propertyHe did not order the tile that he requested an additional $2,forThe lumber he used to frame the shower stall is not to codeThe framing work and vapor barrier are not up to code and will all have to be removedTherefore the work that he did perform is worthlessWe also learned that he was not properly licensed as a contractor to perform this type of remodeling construction to obtain the required building permitHe never brought in the drawing we paid for at his instruction for $to obtain the proper building permit from the city of GlendaleHe is in possession of that drawing as wellIn addition to attempting to force his way into our home and assaulting me which resulted in injury to my hip and cuts and bruises to my body, Todd [redacted] also misrepresented himself to us and engaged in prohibited transaction with our money.If there is any other information you need please let us knowWe are happy to provide it [redacted] *** [redacted] ***

Upon meeting [redacted] and his wife, I found them to be nice, enjoyable people and I genuinely felt this would be a fine working experience, until Mr [redacted] began to text and call me at all hours, many times per day I had explained to him that I did have simultaneous jobs to work on, which he understood As I have stated, Ms [redacted] would ask me whether or not her partner was becoming overwhelming I told her that it was fine, I would joke about it with her but then the situation became unbearable I believe this is the fourth letter I have sent in regards to [redacted] ***’s complaints I understand this is publically posted, but Mr [redacted] has had not one iota of respect for your request of anonymity As I have repeatedly reported, this man has complained to every possible outlet that he can in an effort to thwart my ability to make a living at a business to which, until this unfortunate meeting, has had not one single complaint Again, his last words to me on the evening of Friday, August 5th were “ I will do everything I can to run you out of business (to which my girlfriend was a witness).” Truth be told, [redacted] and his girlfriend have filed complaints with every possible agency Again, he is not interested in mediation, he is interested in retribution His accusations are ridiculous and inaccurate His sole goal is to make good on his word, thus I will be as brief as possible.First, I did text Ms***, in her response to essentially firing me, on August 5th saying I would be picking up my tools and I have the text to prove it To this date Mr [redacted] has been asked by the Glendale police to return my tools several times, he refusesI have filed a theft report with with Officer [redacted] with the Glendale Police Department At this point the tools are considered stolen This has caused a serious financial blow to myself and my company I have had to replace some of the tools and I have had to turn down jobs because my tools have been stolen by Mr [redacted] and Ms ***.Second, the assertion that I physically harmed Mr [redacted] is ridiculous I was not charged with battery because I did not assault him, plain and simple I ask you, if you were assaulted, would you not call the police immediately? Mr [redacted] came up with this claim days after our last visit As I have stated, he was inebriated and hysterical in his driveway I rang the bell, asked for my tools, was refused As I approached my car to leave, he came out screaming and bleeding My girlfriend was with me and helped me in diffusing the situation, as there is nothing good that can come with arguing with an inebriated man who is already incised We left the scene He reported the falsified abuse claim days later I was not charged with battery because OF COURSE there is no such record Again, I can provide dozens of Affidavits from clients who will tell you who I am, and how this in no way fits into my profile At this point, I am being victimized by slander and defamation of character.Third, I paid the electrician because someone had to and [redacted] was not about to do so I cannot afford to lose my sub-contractors The ADA certainly wanted to see everyone taken care of, but declined to pursue any charges, because there is far from enough evidence to do so Mr [redacted] will continue to slander me, I did the work he asked I applied the money he’d given to me TO HIS JOBS, of which there were several He was delighted with the work prior to his evening on the 5th of August Again, he was inebriated, abusive, unkind and certainly displayed behavior that made it clear that he is unstable He frightened my girlfriend and we thought it best to pull the plug on this working relationship Again, you have never received complaints about me because I go the extra mile to please my customers The fact is, in the service industry, you meet all kinds of people, as I have and I enjoy it I have never met anyone with the literal instability and capacity for untruth as I have with this client.Fourth, I have not been in the home since the 5th of August .I have no idea who has, what work was altered, what anyone is looking at I know that I did the work required and I used any funds given to me by Mr [redacted] TOWARDS his projects It bears repeating that he changed the work orders many times, which is specifically addressed in our contract He ignored the contract and continuously stating that asked for or demanded changes with sub contractors without my knowledge I have the receipts, I have the work orders, I have provided them to the Milwaukee County District Attorney (yet another harassment tactic) and the DA found my information to be in line and certainly unworthy of any charge No claim of “battery” made it to the District Attorney’s office, because the claim was without merit.I am sincerely disappointed in the fact that Mr [redacted] is continuing this charade As he said, I completed satisfactory work for his friend, as I have to people to whom he recommended me This is a simple case of a client you cannot satisfy I let it go when he shared FAR too much personal information with me; I let it go when he took the initiative to offer me marijuana As much as Mr [redacted] is attempting to prevent anyone from suffering from anyone working with me; I am equally as interested in preventing anyone from sustaining the abuse I sustained during this sick relationship Again, I can provide you with dozens of references on my behalf, and I would be delighted to Whether Mr [redacted] and his friend can do the same, I am unsure I am simply exhausted from the harassment and looking at my legal options at this point.I very much appreciate the continued opportunity to respond I have responded repeatedly and I genuinely believe there is nothing that will satisfy this man I question his intentions and I do not understand where this animosity came from, but it was fast, furious and has been unrelenting.Thank you, [redacted]

Thank you for your correspondence and affording me the opportunity to respond to the allegations made by Mr. ***. First of all, I would like to thank you for taking the time to call me this morning regarding this unfortunate circumstance. As I am sure you realize, it’s difficult
to respond to complaints of a customer who had been extremely difficult to work with. We appreciate the business that we have, and we work hard to ensure customer satisfaction. I, personally have never dealt with this type of situation, it is foreign to me. It has unfortunately become an issue that is unparalleled and I do feel the need to respond.I had done several little jobs for this customer in the past. Simple home improvements repairs, in addition to a building a greenhouse and installing a fence. All jobs went off without a problem or complaint. In fact the customer was very pleased and had recommended my services to several of his clients and friends. He was a pleasure to work with aside from the large amount of texts, emails and phone calls he had placed in order to set up these seemingly simple jobs. At the time, I assumed he was simply an overly concerned homeowner Early spring of this customer had contacted me regarding a bathroom remodel. I took this customer and his wife to several different suppliers. We spent hours discussing materials, options and choices. Once they had decided upon their choice of materials, I drafted a proposal to do the work, which outlined a budget for the chosen materials l was slightly put off by Mr*** while we were negotiating the proposal, and I began to receive at least one call and several text messages per day, but I assumed that when we worked through that process, the need for immediate correspondence would settle down. I entered into a business agreement with *** *** when he accepted my proposal to do work requested. I began the work as quickly as my schedule would allow. As the work began, the correspondence began to pick up to constant phone calls beginning at 7:am and sometimes over one dozen texts a day, while I was often present at his home during this time. In addition, I met with he and his wife at different tile stores because they were second guessing their first choice . Over the course of the next few weeks, he made over changes to the design of the project (asking my subcontractors to make changes in my absence, which is expressly not permitted and spelled out in the proposal). He had asked to change the size and the layout of the showerstall, light placement, vent placement, the placement of the showerhead, the type of door just to name a few. The correspondence reached a point at which merely meeting his need for unusually constant contact began to impede my ability not only to complete work at his home interfere withe rest of my clients ongoing services. I had informed Mrand Mrs*** I had to oversee I more than one job going on simultaneously. Additionally, I informed them that I had time constraints due to my family time, being a single father with aging parents whom I need to take to appointments now and againWe reached a point in our construction at which I required the assistance of a plumber, who has his own schedule, and though he was informed of the time frame of this job, he was more difficult to have on schedule than I anticipated. It did stall the job to some extent, however, so did the perpetual change orders on the project we’d planned around.The night to which Mr*** eludes, Friday August 5th, I had just come home from work and received a text from the ***’s saying he thought the job we were doing was “BS” and he wanted to end our working relationship. I don’t take this lightly, I assume it to be true and given I wouldn’t have been there until Monday morning, I needed to collect all tools and other property left at the *** home. I was met by a seemingly intoxicated, hysterical man whom, when I said I needed to retrieve my tools, began screaming obscenities at me at the top of his lungs….then he wanted to work things out….then he would scream again. He vacillated from screaming to begging me to finish the work. I explained that I only wanted my tools as we walked together to the back door. He refused to allow me access into his home in order to obtain my property At one point Mr*** reached into lock the passage knob of his door, at which point he scraped his arm on the strike plate of the screen door. He than slammed the door, proceeding into his garage, screaming obscenities and closed the overhead door I assumed we were done. As I walked back to my car he came charging out of his front door showing me a bloody arm, launching back into his tirade. He demanded that I not only finish the job, but that I do so in a courteous manner that he would approve of. During his tirade I took out my first aid kit, asked Mr*** if I could help him with his arm. He agreed and I cleaned, dressed and bandaged his self inflicted wound. After which he said “thank you and I am sorry” As we said goodbye and I was about to leave, I told him I would be back on Monday to retrieve my tools. Then he broke into yet another tirade in which he hurled insults at me about my business, he listed every single complaint he was going to make about me and to whom (and he is following up on this), he said, “I will spend the rest of my life making sure you go out of business (apparently people really do that) and then he asked me what time I’d come back to work Monday On the following Sunday he sent me a contract to sign demanding that I agree to his terms and finish the project. At this point I felt that the working relationship was past the point of possible. I go above and beyond for my clients. This volatility was a concern to me and my family. At which point I requested no further contact in my response to their text, at approximately 8:pm I asked to have no contact with him, he then went, at 10pm on Sunday evening, to the police department to report the alleged assault. To which I am contesting This is plain and simple blackmail.In my opinion, this man is not balanced, he is unsafe, he has his own set ideas on treating people with common courtesy and respect and I feel he is not only not safe for me to be around, I would not subject any employee or subcontractor to his erratic behavior. All I want at this point is my tools back, which are worth more than $1,000. I have done and can account for $6,services and materials for this project. Additionally, I have been forced to take time out of my schedule to deal with his attempt to slander my company and family. At this point, we are at a stand-still and I am in no position to spend any more time or money attempting to please someone who strikes me as not altogether rational.Thank you for the opportunity to respond. We reached a point in our construction at which I required the assistance of a plumber, who has his own schedule, and though he was informed of the time frame of this job, he was more difficult to have on schedule than I anticipated.  It did stall the job to some extent, however, so did the perpetual change orders on the project we’d planned around.The night to which Mr. [redacted] eludes, Friday August 5th, I had just come home from work and received a text from the [redacted]’s saying he thought the job we were doing was “BS” and he wanted to end our working relationship.  I don’t take this lightly, I assume it to be true and given I wouldn’t have been there until Monday morning, I needed to collect all tools and other property left at the [redacted] home.  I was met by a seemingly intoxicated, hysterical man whom, when I said I needed to retrieve my tools, began screaming obscenities at me at the top of his lungs….then he wanted to work things out….then he would scream again.  He vacillated from screaming to begging me to finish the work.  I explained that I only wanted my tools as we walked together to the back door.  He refused to allow me access into his home in order to obtain my property.   At one point Mr. [redacted] reached into lock the passage knob of his door, at which point he scraped his arm on the strike plate of the screen door.  He than slammed the door, proceeding into his garage, screaming obscenities and closed the overhead door.   I assumed we were done.  As I walked back to my car he came charging out of his front door showing me a bloody arm, launching back into his tirade.  He demanded that I not only finish the job, but that I do so in a courteous manner that he would approve of.  During his tirade I took out my first aid kit, asked Mr. [redacted] if I could help him with his arm.  He agreed and I cleaned, dressed and bandaged his self inflicted wound.  After which he said “thank you and I am sorry”.  As we said goodbye and I was about to leave, I told him I would be back on Monday to retrieve my tools.  Then he broke into yet another tirade in which he hurled insults at me about my business, he listed every single complaint he was going to make about me and to whom (and he is following up on this), he said, “I will spend the rest of my life making sure you go out of business (apparently people really do that) and then he asked me what time I’d come back to work Monday.   On the following Sunday he sent me a contract to sign demanding that I agree to his terms and finish the project.  At this point I felt that the working relationship was past the point of possible.  I go above and beyond for my clients.  This volatility was a concern to me and my family.  At which point I requested no further contact in my response to their text, at approximately 8:30 pm  I asked to have no contact with him, he then went, at 10pm on Sunday evening, to the police department to report the alleged assault.  To which I am contesting.   This is plain and simple blackmail.In my opinion, this man is not balanced, he is unsafe, he has his own set ideas on treating people with common courtesy and respect and I feel he is not only not safe for me to be around, I would not subject any employee or subcontractor to his erratic behavior.  All I want at this point is my tools back, which are worth more than $1,000.  I have done and can account for $6,500 services and materials for this project.  Additionally, I have been forced to take time out of my schedule to deal with his attempt to slander my company and family.  At this point, we are at a stand-still and I am in no position to spend any more time or money attempting to please someone who strikes me as not altogether rational.Thank you for the opportunity to respond.  I would be delighted to supply you with a long list of satisfied clients.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.[redacted] has fabricated everything he has stated. He has provided no valid legal documentation that would be acceptable in a court of law. Attached you will find the check we sent to Sande Services Electric on September 12th in payment of the invoice they sent to us because [redacted] went to him on August 8th to inform Sande Services Electric that his contract with us was terminated. This was after he assaulted me at our home on August 5th in an effort to retrieve his tools. We told him then that we would return his tools after he delivered the tile that we had given him a check for in the amount of $2,500 on July 20th, 2016.   He could not deliver the tile to us because he never ordered nor paid for the tile. We spoke to [redacted] on August 10th, the date we received his invoice, explaining the situation and stating that we would definitely pay the bill if we were not successful in recovering our funds from [redacted] in a timely manner.  This is why we ended up sending a check to Sande Services on September 12th because this process is dragging on far longer than we anticipated.  Sande Services has agreed to continue working with us on our project as well.  [redacted] went in and paid this bill because he was being pressured to do so by the Milwaukee County ADA.  His claim that we would not pay that invoice is absolutely false and the proof is attached.His claim that he did not cause any harm to me in the attempt to gain entry to our home with force to retrieve his tools on August 5th is also false and once again, we have the attached photos as proof (if you view the photo properties you will see that they have a date of August 5th, 2016) not to mention that he was charged by the Glendale Police Department for this incident.With respect to his claim that he was charged with battery which was reduced to disorderly conduct because he went to Glendale Municipal Court to contest the charge is disproved by the following email form the Glendale City Attorney Rebecca Boyle; From: [redacted] Date: September 3, 2016 at 5:00:22 PM CDT To: "'[redacted], [redacted] Subject: RE: [redacted] pled no contest to disorderly conduct with a $550 fine.  The Judge will review forrestitution.  Restitution in municipal court is limited to actual damages, i.e., no pain and sufferingor inconvenience.  The restitution also must be related to the charge, so the contractual damagesare not at issue.[redacted]

[redacted] With regard to his claim that his workmanship was in good order please see attached report from [redacted], Director of Inspection Services, with the City of Glendale. It lists 8 items which prove that Stapelman was not qualified to do this type of work, not licensed to do this type of work and was in violation of a number of Glendale City Ordinances.Finally the texts which he has attached to his last rebuttal are forged. We, [redacted] nor I ever received them. [redacted] does have a voicemail message from him during his assault on myself at our home at the exact same time apologizing for his actions. Have him provide the phone records from his cellular provider proving those texts were sent. Cell providers have these records and they are time and date stamped.  Yet another false claim by [redacted].[redacted] is not giving any actual proof to back up any of his lies. And you the Revdex.com provide him a platform to defend his criminal actions and dishonest business practices. As we stated already our only reason for filing this complaint was to protect others from hiring him to do work he is not qualified to do. We do not feel that you, the Revdex.com, are protecting the consumer. We want no further contact from you the Revdex.com and are not interested in anything further Stapelman has to say in his defense because it is not factual. His tools have not been stolen, they are in the possession of our attorney and will be returned to him when he responds favorably to the Right to Cure Notice sent to him. If his response to this notice is not in our best interest his tools will be returned to him at the conclusion of the civil action we will take against him. So as to his statement that he has to turn down jobs due to the fact that his tools have been stolen by us is preposterous.  The suffering we are enduring with the mess he left us with, no second bathroom and the cost associated with fixing his work and getting our project completed far outweighs the 3 drills, one saw and some screws, nails and other supplies we have not returned to him as of this date.
