ID # [redacted] Ms [redacted] purchased a "used" Odes UTV on 7114/2016.The unit was delivered the next day to Priest River, Idaho (round trip miles)at "no charge" to the customerApproximately two weeks later Ms [redacted] called becausethe UTV would not startAs a good faith act, I sent one of my mechanics to pick up theunit at "no charge"It was determined there were electrical switches left on in the unitthat caused the battery to go deadThe unit was returned in good working order andinstructed how the turn all power off when leaving the unit parked at "no charge" to thecustomer trip #After another few weeks the customer called and stated the battery wasagain deadI sent my mechanic back to Priest River to pick up the unitOnce again theswitches were in the on positionTime the battery was beyond repair and was replacewith a new battery at our expenseIn addition to the new battery, we also installed abattery tender to be plugged in when the unit is not in use at "no charge" to the customer.,We kept the unit for two weeks going out everyday to start the unit without anyproblemsWe then left the unit alone for six days to see if it would start./ When Ms [redacted] came into the store she was told the unit had not been started for daysThe unitstarted without and hesitationWe again delivered the UTV to Priest River at "nocharge" and instructed that we would no longer sent our personnel to pick up the unitwithout a charge of$round trip.Five days later I received a call that the cart was deadMs [redacted] was instructedto bring the UTV to the shop and we would double check any and all electrical system aswas done on three previous incidentsAt that point, Ms [redacted] demanded her moneybackShe was informed that Odyssey Sports Northwest would, in fact, repair anyelectrical problem found, however she would be responsible for transporting the UTV.The conversation continue involving her daughter who repeated everything the same asMs [redacted] .We believe that there are young grandchildren that may have access to the UTVand possibly turning switches on and offThis is speculation.I have enclosed a copy of the invoice with the added paragraph about extending aa warranty to cover the battery.I believe Odyssey Sports Northwest has gone above and beyond to make thiscustomer happy at significant expenseMs [redacted] purchased a "used" UTV and was soldin good faithI do not believe we have any other responsibility to this customerThomas Z [redacted] , Owner

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to me I appreciate the owner's statement and that the information obtained by him was passed to himSince I did not hear from anyone from your business within the window Revdex.com provided, I took my Bennche to [redacted] ***, a similar business, just North of you They will be inspecting the muffler and handling the necessary repairs I could ask them for a statement as to what they found upon inspection if you'd like

First, I apologize for the delayed response I simply overlooked the prior notice.Please know that I cannot comment on the muffler currently on Mr***'s machine as we have not had the opportunity to inspect it I do not know if it is a Bennche muffler or something completely different We will gladly inspect it to see what kind is on the machine and if it exhibits any issues.I have only been privy to information relayed to me from Shawn, my service manager, that had the original conversation with Mr*** My statements reflect what was passed on to me by Shawn after he reviewed the initial complaint I am in no way attempting to attack Mr***'s character, but simply stating discrepancies with the information we had received Mr***'s assertion that there were issues during the transition and that his repair order was lost is incorrect and completely misjudged Any warranty orders are entered electronically with our vendors and cannot simply be lost The fact is that at the time of the transition, no warranty order existed, or it would still be in the system This is why I contacted the previous owner in an attempt to gather information Mr*** told me that he had no recollection of any commitments to provide a new muffler to Mr*** I do not wish to assert that Mr***'s side of the story is false, rather that it cannot be verified by prior employees with direct knowledge of the issue We are more than willing to make an inspection of the muffler I do not believe that we could fit anything but a muffler for that machine back on it, but I am open to the possibility.Our belief that a new muffler was installed is based on my knowledge that other mufflers simply should not fit his machine Obviously, if proper records were kept by the previous owner, this whole issue would be more simple to resolve I sincerely wish this were the case I again do not wish to question Mr***'s character in any way I do feel that mine is being questioned, as what Mr*** calls "simple facts" are at this time completely unverified His machine has not been brought to our shop for any inspection at this time, so we have no way to make a proper judgment of any of this until that happens

The replacement stock muffler was not available at the timeA muffler that they had on hand was hastily installedI was told to see if it works for now, and in the meantime they would order the replacement muffler under warrantyThere was never any complaint about "not liking the way it sounds"The complaint was there was a change to the original sound of the muffler coupled with a decrease in engine performance which seemed to indicate a mechanical problem with the unitIf Odyssey Sports feels that the muffler that was installed is an approved muffler for that vehicle, I would like the muffler examined by a third partyIf the muffler is stock and is in good working order or simply broken, I will withdraw my complaintHowever, if the muffler that was installed was either not specifically made for that vehicle or was in some way modified and is currently not in compliance, I would ask why the business would think this would be a satisfactory repair. I believe certain legal and ethical questions would now come into playOdyssey stated: "When Mr*** spoke with us, he did not say that the muffler that was installed was a loaner while a new one was being orderedThis assertion is only in the complaint he filed with Revdex.com." During my phone call to Shawn on 9-12-17, I specifically mentioned to Shawn that the muffler was indeed installed as a temporary fix and that one was supposed to be orderedThis is contrary to what Shawn claimed occurredI called Odyssey on 9-12-to check on the status on the order of the factory muffler since this temporary was now starting to cause issues. I also explained to Shawn during this phone call, that I was made aware that if correct back-pressure was not maintained, it could cause the vehicle to run roughThis was the basis for initial my call for serviceShawn stated that none of the techs that were there when I came in were employed there anymore. He then said the business is under new ownership and made a comment about how he doesn't mention the previous owner or employees by nameThis certainly sounds like there were issues during the business transition and that I may order and repair was simply lost during this transitionOdyssey then claims "we believe Odyssey Sports NW, LLC did provide a new muffler at his request during his warranty period." If that is the belief that the business has, I would again encourage an inspection of the mufflerIf it is a failed or broken component I will accept that finding as an out of warranty issue and gladly pay for a new OEM mufflerIf Odyssey itself believes they provided a new muffler, then where are the records of this service? What parts were installed?Odyssey appears to feel obligated to misrepresent my claim and bring my character and my "allegations" into question rather than deal with the simple facts

Complaint: ***I am rejecting this response because: the utv has not been left with any thing in the on positionAll buttons are labeled No children have access to the utv And I am saddened to inform the company that when utv is brought into the woodsTrees don't come with outlets to restart itDue to the company inability to fix the utv a full refund and return of utv is in orderPlease advise if there is supposedly nothing wrong with the utv why are they not willing to take it back. I responded to this complaint 1 year ago that was filed with Idaho State Attorney Generals Office. The complaint was unfounded then and it is now. I can not make all customers happy- I did everything in our power to maker her happy and nothing was ever good enough. I waived 4 pick up and deliveries...

@ $45 per or $180 and always gave her extras at no cost.

Complaint: [redacted]I am rejecting this response because:  I paid for a repair that DID NOT FIX THE problem.  They were guessing at a solution and charging me for repairs that were not necessary and not correct.   I had to take it somewhere else to get it fixed correctly.  Therefore, I actually paid for the repair TWICE!  I do not understand why Tom thinks I should pay for the pick up and deliveries when the problem was never resolved.Sincerely,[redacted]

This business was sold and I purchased it in February.  The parts were ordered from Benche for the consumer.  They shipped the wrong part to us.  I have been working diligently to get this resolved.  Benche has shipped the part on 04.26.2017 from Texas to me.  Upon receipt,...

First, please know that I do not have any direct knowledge of any promises, nor do any documents exist providing record of the conversations that Mr. [redacted] had with the prior owner of Odyssey Sports NW.  I did have the opportunity to consult with the prior owner prior to providing this response,...

however.  Mr. [redacted] alleges that he had an exhaust issue in the first 6 months of vehicle operation.  His description of this issue to us over the phone was that he didn't like the sound of the machine with the factory muffler.  Please know that a muffler not sounding the way a person likes is not considered a failure or a warranty issue.  My understanding (what Mr. [redacted] told us during his phone conversation with my service manager) is that the prior owner offered to place a different muffler on his unit in order to appease him.  Mr. [redacted] alleges that the previous owner explained to Mr. [redacted] that if he did not like this substitute, feel free to bring it back and one would be ordered for him.  In my conversation with the previous owner, he did not recollect any such assurance.  I have now owned this business for 7 full months, and have not heard a single complaint from Mr. [redacted] about his muffler this entire time.  At this time, we are puzzled at Odyssey Sports NW as to why the disappointment with the approved substitute muffler is now coming to light.  Also, when Mr. [redacted] spoke with us, he did not say that the muffler that was installed was a loaner while a new one was being ordered.  This assertion is only in the complaint he filed with Revdex.com.During his conversation with us, he again indicated that he does not like the sound of the muffler that is currently on his unit, when it backfires.  This again is not an indication of a failure or break in the muffler, for starters.  Secondly, a muffler has a 12 month warranty.  Even if it had failed, whether it was the original muffler, or one that was exchanged onto the unit during that 12 months, the warranty has expired for the muffler.  Mr. [redacted] has convinced himself that a muffler is part of the "emission control system".  Out of courtesy, we contacted the vehicle manufacturer, and they confirmed that a muffler is not part of the emission control system that is warranted for 30 months.  Odyssey Sports NW does not provide the warranty for this vehicle.  It is provided by the manufacturer, and we are their service center.  If Bennche (the manufacturer) chooses to warranty the muffler and labor, we would gladly take care of Mr. [redacted]'s concerns.  The have denied the warranty claim.As for Mr. [redacted]'s desired settlement, we believe that Odyssey Sports NW, LLC did provide a new muffler at his request during his warranty period.  If that muffler was defective, it was his reponsibility to bring the unit in for service during his warranty period to be taken care of.  Odyssey Sports NW is not in any type of violation of warranty, as we do not provide the warranty for the vehicle.  Mr. [redacted] would need to take up his complaint with Bennche, the manufacturer if he believes that the warranty is not being honored.
