Thanks to whoever tried to get the GPS coordinates to this captain's fishing spots years ago. You turned what was probably a nice guy into a paranoid ***.
6 of us planned this trip for weeks. 2 nights in a hotel and, for me, paying my employees overtime so I could get away.
We get to the boat this morning and as stated on all the emails and website, turned our cell phones off and locked them in our cars.
We take off and about a half hour out the captain sees my friend looking at his watch. He blows a fuse, accuses my friend of trying to get this GPS coordinates. My friend says he doesn't know anything about that and that it links to his phone which is turned off in a car miles away. He offers to turn off the watch and give it to the captain. Captain wouldn't have it and heads back to the dock.
By the time we get back to the dock, my friend is steaming after being wrongly accused. We decide we're not going, but don't want to stick our friends with the difference or ruin their trip. We give our friends our share of the cost of the trip and head out.
If you're paranoid about someone whose only watercraft is a 17' canoe then you need to think about what you're doing. Have people turn in their Apple Watches, digital cameras, etc. as they all have GPS capabilities. Don't just say cell phones. 99.99% of your customers, like us, would never, ever think about GPS locations. All we wanted was a good day fishing.
If you're an honest and fair man, and not the *** that I saw this morning you'll private message me and I'll tell you where to return our portion of the funds.

At Offshore Hustlers Fishing Charters we pride ourselves on professionalism and customer service. We are a family owned business that works hard to provide the quality charters our customers have come to expect in the more than twenty-five years we have been fishing the Gulf of Mexico.

On the date in question, the two guests involved in the complaint were not the charter who hired our boat, and we had no financial or contractual relationship with the complainant or their friend. In the complaint, the complainant acknowledges their friend's refusal to comply with our policy of no GPS devices. Our policies are outlined clearly on our website (which can be viewed at https://offshorehustler.com/charters/) and we make sure to review them with the guests before setting off on each and every one of our charters. In the complaint, the complainant acknowledges having read these policies "as stated on all the emails and website" before getting to the boat.

While the complaint states that we accused the complainant and his friend of wrongdoing, this is not the case; our policy on GPS devices is a blanket policy meant to protect our business and to prevent over-fishing of the areas where we take our guests. Our business depends on our customers' satisfaction, and Captain Pete takes great care to protect the spots he has worked hard to discover and track over the years he has been fishing the Gulf. These policies are in no way meant to harass or upset our guests, and in this case, the complainant and his friend were given an opportunity to return the device to their vehicle and to continue on with the rest of the charter as scheduled.

After waiting more than fifteen minutes for them to return to the boat, and, as noted in their complaint, the two decided not to return of their own volition and the charter proceeded as planned. Our actions in this case were not malicious or unprofessional, we simply asked the complainant to comply with our clearly communicated policies and procedures. They made the conscious and voluntary decision not to do so, and then made the decision not to come back on our boat. Accordingly, the primary charter guest who contracted our boat directed us to proceed without his two guests, and that is what we did.

The primary charter guest and the remainder of his guests had a great time, and have left nothing but positive reviews of their experience. We caught tons of fish on this trip as can be seen in the photographs they posted on our Facebook page. Again, we provide courteous and professional service and work very hard to give our customers one of the best fishing charter experiences in the St. Pete area.

If we accept the captain's statement that the only party he is contractually/fiscally bound to is the person who booked the trip, then logic tells us that the only person contractually bound to follow his rules is the person who booked the trip.

While that is probably legally true, a reasonable person would realize that is not the intent of either party.

We understand that the captain was trying to protect his fishing spots. We had no reason, intent, nor wish to mark them.

Prior to boarding the boat, the captain asked that we all turn in our cell phones. All six of us complied without question. However, there was absolutely no mention of watches, GPS, cameras, or any other devices. My friend didn't even know that Garmin had GPS capabilities. His wife gave it to him for Christmas so he could keep up with messages and emails. Even so, with phones turned off and miles away, all functions were turned off. Had we been asked, we would have more than willingly showed the captain any of those items and returned anything questioned to our vehicles. All we wanted was a good day of fishing.

When the captain stopped the boat to catch some bait, my friend looked at his watch to see the time. He was sitting in the stern, directly behind the captain. The captain saw the watch and went ballistic, accusing my friend twice of trying to mark his spots. My friend replied that he was just looking at the time. Despite my friend turning his watch off and offering to give it to the captain for the duration of the trip, the captain would have none of it and continued to accuse my friend of trying to steal his locations from him. The captain turned the boat around and went back to the dock.

Now, if someone is going to try to steal something from another, would he do it openly, when the captain is standing over him?

By the time we got back to the dock, my friend was very angry because the captain had twice falsely accused him of trying to steal his fishing spots. It was quite obvious that, no matter what we did, this wasn't going to be a good day of fishing, and with the captain's demeanor, it could quite easily escalate into an even worse situation.

What the captain did was wrong. My friend offered a way out and the captain wouldn't accept it. As the owner of a family owned business for 34 years, I know about theft and customer service. The person trying to steal from you, isn't going to do it in front of you. In this case, he'd be sitting in the bow or head and trying his best to conceal his actions. This was not the case here. My friend was falsely accused and the captain needs to recognize his errors, make this right, and get some help for his paranoia.

It is unfortunate that the complainant and his friend, guests of the principle charterer, did not abide by our clearly stated policies. Respectfully, it is impossible for us to learn to use all available GPS devices on the market to learn to turn them off for guests who violate those policies. That is why the policy is simple and straight forward, no GPS devices on board.

Nonetheless, we attempted to correct the situation by returning back to the dock so the watch could be left in the car and waited for our principle charterer's guests to return so we could continue on a great day of fishing. At no time was anyone asked to leave the boat nor was anyone treated with disrespect. The principle charterer and his remaining guests continued on with the trip and had a great time, (see their Facebook posts on our site). The complainant and his friend could have done the same.

It is a shame that captain Pete doesn't have the cognitive skills to determine what he doesn't want on his boat until they've been out to sea for 30 minutes, and then has to accuse guests of stealing from him.

It is a shame that captain Pete doesn't have the verbal skills to ask his guests if they even visited his website before leaving the dock.

It is a shame that captain Pete can't face his paranoia and find a solution.

It is a shame that captain Pete has to hide behind a contract rather than making sure that all of his guests were treated with respect.

It is a shame that your attorney is going to end this here. They can justify it legally, but not morally.

I do hope that captain Pete finds some help in developing his greatly needed people and customer service skills.

It is a shame that the captain Pete considers that 33.4% of the customers on this trip wrote a extremely poor review of the trip, yet he considers that a plus because 16.5% of his passengers gave him a good rating.

If this was a legal issue, we would have been in small claims court weeks ago. This is about business principles and captain Pete's lack of them. There are other venues that we can pursue, picketing, action reporters,........

I hope captain Pete gets the help that he needs.

I am rejecting this response because: Even though the store refused to say that it kept a passport with them, I did see they had an U.S passport with them along with other photo IDs. I do not know what is the reason they did not admit that, forgetting about the fact or just not wanting to admit, I did see an U.S passport. I do not have evidence, such as photo, to prove it because it was improper, infeasible and illegal for me to take picture of other's U.S passport just to prove that they did keep the U.S passport. Besides that, as one of its customers, it was to my huge concern that my private identity information might be improperly used by the store under its "policy". There are many better ways that they can ensure the safety of their customers and their facilities. For example, they can call the police anytime as needed. In general, I was still very unsatisied and disappointed with one of their female staffs' proud, arrogant, and rude service attitude. More importantly, I totally disagree with their policy of temporarily keeping customers' ID.

To whom it may concern, Our staff recounts the situation in question and wish to give our side of the story. The complaint is regarding our policy in temporarily keeping an ID card for the duration of renting one of our karaoke rooms. We remember when the customer arrived to our store with his...

family to sing karaoke. Before entering the room, we asked for a form of photo identification such as a driver license or even a student ID card to keep in the front desk. We, however, under no circumstances do we accept passports as they are unfeasible to be kept in our filing folder.The customer was puzzled and we informed him that we enforce this policy for the safety of all of our clients renting other rooms and to ensure accountability if any equipment was damaged during that time. We are dedicated to have an environment with great entertainment and utmost safety as we do not wish to have unknown personal wandering within the store. All of the ID cards are kept in a safe filing folder in the front desk beyond the public reach. Having explain our Karaoke policy, our staff member notice that the customer became visibly upset and asked to be exempt from the rule. As following protocol, the staff member reminded him that it is simply the policy of our business and cannot be broken. The customer stated that he felt unsafe leaving his ID with us and we respect his decision to withhold it. However, if our guidelines are not met, we are unable to allow him to rent the room. At this point, the customer raised his voice to our staff member stating that this was a violation to his privacy. Having disturbed the other customers present, our team member pointedly asked him to leave as he is causing a scene in our private establishment. As he is upsetting the other customers with his tirade, we reserve the right to refuse service to him and asked him to leave. The Bluemoon team also wish to note that other businesses that perform rental equipment or services also will require a form of photo ID to be kept such as bike rentals or bowling rentals.
