I am rejecting this response because: I am rejecting this response because: Not only is the entire response preposterous, but the length of time it took to even get a simple response is senseless(Over days) At the time of speaking with [redacted] (Salesmen) and [redacted] (Finance Manager/Owner) I was promised all repairs (parts and labor) would be free of charge, because [redacted] "Was not that kind of person, and doesn't conduct business leaving his customers angry/unhappyHe said, no matter what the issue was, he will take care of itSimilar statement was established in a response from "Ohana" on Revdex.com website (unrelated complaint), to coincide [redacted] advised April 8th monthly payment would be deferred, or we will make a new contract once the vehicle repairs were complete(Ohana financed my contract "In-House) Ohana Auto Sales states they have a day / mile warranty, and the customer signs the warrantyIronically, I NEVER signed a warranty or buyers guide, and there is no record of said warrantyThere definitely was not a buyers guide on the vehicleWhich according to Federal Trade Commission, is a violation of the "Used Car Rule"Nevertheless, the warranty covers 50/parts and labor of certain repairs In the response from Ohana, they stated, "in order to continue the work on her vehicle she will now have to pay 50/of parts and labor due to day warranty being up." Indicating my purchased vehicle is STILL NOT REPAIRED, and contradicting information that the warranty was not really 50/parts and labor within the day warrantyIt doesn't matter if we are now passed the day warranty period, Ohana has had my vehicle since April 7th, (I informed them of the nonconformity on April 3rd, clearly within my days) [redacted] , and [redacted] advised "if it is the motor/engine that is faulty on my vehicle, they will use the engine from another Ford Explorer on their lot that they got from an auction Upon reading their response, I believe Ohana Auto Sales to be considered a "Buy here, pay here" dealerIn which, 100% of all repairs (covered) the dealer paysCALIFORNIA VEHICLE CODE defines "Buy here, Pay here" dealers Photos will be uploaded as an attachment Aside from that, before making ANY repairs, I was lawfully supposed to receive a written estimate for parts and labor Business and Professions Code: - The automotive repair dealer shall give to the customer a written estimated price for labor and parts necessary for a specific jobNo work shall be done and no charges shall accrue before authorization to proceed is obtained from the customerNo charge shall be made for work done or parts supplied in excess of the estimated price without the oral or written consent of the customer that shall be obtained at some time after it is determined that the estimated price is insufficient and before the work not estimated is done or the parts not estimated are suppliedWritten consent or authorization for an increase in the original estimated price may be provided by electronic mail or facsimile transmission from the customerThey still have yet to contact ME to let me know what exactly is wrong with the vehicle(What repairs are needed) California Civil Code - Where an option is exercised in favor of service and repair under Section 1793.3, such service and repair must be commenced within a reasonable time, and, unless the buyer agrees in writing to the contrary, goods conforming to the applicable warranties shall be tendered within days (I was only in favor of service and repair, solely do to being intimidatedI had already requested for a replacement vehicle [redacted] refused, because "He" already paid for the registration and transfer on my vehicle(In which I still haven't received anything from the DMV.) He said, "I can get another vehicle, but my down payment cannot be transferred to the replacement vehicle, and I would still be liable for the price of the original contract." In other words, I would need another down payment, and forfeit the down payment I already put He also stated, "If I take him to court, I will not win" as there are laws to protect him, after I drove the vehicle off the lotIn a phone conversation with [redacted] on May 2nd 2017, I called and asked what was going on with my vehicleHe stated, "What about it?" I said, "Whats going on with the repairs? It's almost going to be a month, and I have yet to hear from you guys" He said, "I have to pay whatever is owed", but he didn't know exactly how much at that pointHe was supposed to call me back with the exact amount he was referring toHE STILL HAS NOT CONTACTED ME TILL THIS DAY! As of July 3rd, they attest the vehicle is still not repaired Ohana is prolonging repairs (for I don't know the exact reasons) but it's evident they want me to rack up more "missed monthly payments" which this is the first I'm being informed about of any default, since [redacted] said a new contract would be made In Addition, I have lawfully and rightfully rejected / justifiably revoked acceptance of the goods California Commercial Code (1) Where the seller fails to make delivery or repudiates or the buyer rightfully rejects or justifiably revokes acceptance then with respect to any goods involved, and with respect to the whole if the breach goes to the whole contract (Section 2612), the buyer may cancel and whether or not he has done so may in addition to recovering so much of the price as has been paid After repeat attempts to hand deliver all original contracts/documents, I sent it out certified mail, with a return receiptProof will be uploaded as an attachment How ridiculous they state they have gone above and beyond to help and address my issuesThey have done no such thing, EVER! Their delayed response to Revdex.com, is exactly the delay I have encountered with them from day one In conclusion, I would like my entitled FULL refund

Everything that I have read in this letter is *** *** is a co-signer not
the buyer it was her daughter *** *** From the time of purchase the mother *** *** did not want to be on contract which I clearly made sure her daughter knew I will not do any paperwork or waste my time if her mother disagreed because it is a process and a responsibility the co-signer is responsible if at any moment the buyer defaults on contract The daughter clearly said it wasn't her mothers business that it was her car and her payments and I told her again please go make sure because she needs to know that As the night went on yes we were busy but never have we ever not taken a customer on a test drive if I personally don't go myself I have employees that will gladlythe customer *** *** along side her, her father and mother all agreed to just want to leave which didn't at the time seem like a problem because all of our vehicles have warranties days milesas a matter of fact the customer signs the warranty copies are on file
when a customer signs the contract cancellation option it gives them power to decide for any reason that if do not like vehicle they may return it by an appropriate time in their case the sale date was 2/9/so contract cancellation was by 2/11/at am in the contract it states that there is a $fee to accept this which also includes a $restocking fee as well the customer declinedso no money was taken for the contract at time of purchase
as the night passed *** next day I receive personally a phone call from *** father stating he felt like the brakes were possible bad , I then, before even having him finish his sentence say to him when can she bring it in he said as soon as possible so I said yes of course I will see u then I have never conducted business here unfair or unjust I have a mechanic shop only for my customers on property I take no outside work its opened only for my vehicles *** came and she told me about a window and her brakes immediately the car was checked brakes were changed and in fact the brakes that were on the vehicle still had life to them but to keep our customers happy I never let them know I just make sure they are always pleased neither did I charge her for them as well as I have never charged any customer even though that is not covered by warranty I also told *** that her father was adamant on the phone but when I told him no worries he thanked me he thought I was going to say " not my problem " so when he knew it would be taken care of he was appreciative *** herself told me she loved the car but that's how her parents are and that she was very sorry the next day being the 15th of February I receive a phone call from *** father saying he put his money into the vehicle and doesn't want the car because of many small reasons and all I told him was to come inside and speak to the finance manager*** spoke to the father explained to him that he needed to speak to both signers on contract he understood and the brought in his wife and daughter prior to that day have we never seen *** *** in or office as she claims I have video surveillance covering the whole entire dealershipAlaeddin then reexplained to them about how the warranty and contracts work and how was it fair to usThey had the vehicle for days put miles on it and broke off the door handle and minor parts that we never even held them responsible for He then pulled out a military ID and *** said to him that has nothing to do with purchasing the vehicle our oldest son is in the military as we speak we honor our soldiers but don't use a military ID as a threat the only reason alaeddin gave them back the deposit excluding the $was because prolong of use he gave them $which the father agreed and understood so did *** but the mother was hesitant , and Alaeddin even told them if ever they had a friend relative themselves whoever he will gladly use it towards heir purchase but in all fairness it will be deducted and for legal reasons he contracted them in a contract cancellation option which they then accepted and *** didn't charge them the $retocking fee
As for the other claims they are all hearsay I have sold hundreds of vehicles and this is my only return besides there is a family member of theirs that also purchased a vehicle thru us that is completely satisfied and always will be because we conduct business here completely different customers always come first To conclude this email the car we are speaking about CHEVY MALIBU was immediately sold and they customers love the vehicleI do have proof to all my claims

I *** *** have never said that I have never been in this business before im the cosigner so how could I have nevet been there..we didn't test drive the car if he sends your the contract it was sing at 6: pm his business was closing and he had one more customer left so as his workers was locking up the business and he was helping the last customer he didnt have time to test drive the car with use yes use me *** *** and stanquiesha davis..and yes the day return the car there was a customer in there complaining of his transmission going out of his car and he just gave them hundred dollars down days earlier..im going to go to this company and stand close by there so that I can get other customers that have complaint about how there cars are braking down and there losing out of there money.and as far as the door go the car didnt ever have speakers in is and they put the door hand together were you would never no...if they give Revdex.com the information to the person they sold the car to they will tell you thatthat car has no speakers and how the transmission is sliping and how the back set on the passenger *** is off ..this company is savages cars and use the people dont no it into we drive then this company need to be investigated..they sold dollars from use...for there neglect.when I said that they should have test drive that car with use...and the car wasn't driven because the brakes was to low and they sent my daughter and her year old son off there lot like that..all I want it my money back..on the date we got the car was a Saturday on Sunday they are close on Monday he was not there to take the carbfir a test drive on that day the wife are girlfriend said they was busy..the car was returned to they way before miles please Revdex.com investigate this come

(Ohana financed my contract "In-House)   Ohana Auto Sales states they have a 30 day / 500 mile warranty, and the customer signs the warranty. Ironically, I NEVER signed a warranty or buyers guide, and there is no record of said warranty. There definitely was not a buyers guide on the vehicle. Hello,   In regards to [redacted] customer is currently out for repo due to defaulting on her first payment that was due on 04/08/2017 and she is currently behind on 3 payments total. In order to redeem her vehicle she will need to bring all payments current , also in order to continue...

the work on her vehicle she will now have to pay 50/50 of parts and labor due to 30 day warranty being up. We have gone above and beyond to try and help the customer as much as possible with all their concerns and issues but refuse to cooperate.     Thank you,   Ohana Auto Sales
