On 5/14/Ohio Restoration Solutions was contacted by *** *** to inspect her home for storm damage which occurred on 5/12/On 5/17/2014, *** *** signed both our contract (Damage Assessment) and Notice of Cancellation, For clarification, I will explain in brief the forms mentioned above and what they outline:
The *** *** **thorizes Ohio Restoration Solutions to complete the repairs to the property.,should the damage be approvedIt stated that we work hand in hand with the Insurance Company (in this case *** and pricing is in direct correlation with their inspection and claim allowance(Note...not all insurance companies pay the same and/or follow the same approval process)Because this is not a cookie cutter industry, and approval amounts vary upon insurance companies; the work which Ohio Restoration Solutions performs is based on their individual approval estimate alone, Any deviations or modifications from which, would be supplemented for and would need to be agreed to and put in writing before further repairs would be completed with those proceeds made payable to Ohio Restoration Solutions
The Notice of Cancellation states the homeowner has business days to rescind and cancel without penaltyShould that day period expire, the Damage Assessment outlines that Ohio Restoration Solutions will be entitled to 25% of the approval amount as settlement for time, expense and expertise which have been exhausted during and after the approval process(I have attached copies of both the Damage Assessment and Notice of Cancellation which *** *** *igned on 5/17/2014)
Typically, the only out of pocket expense to the Homeowner while completing repairs made by an insurance claim is their deductible alone, The only time this figure would change would be if the insurance company did not approve enough to cover a full replacement (in other words they were only covering a repair), if the homeowner wanted to make additional improvements, and/or if the wished to pay for up-grades above and beyond what the scope of repairs outlinesPlease note...unless Ohio Restoration Solutions is conducting retail (non insurance related) business, we do not approve based on market rates; rather, we write the contract for the insurance approval amount
With that being said, on 6/6/2014, after gaining approval by her insurance company; *** *** had signed the Color Select determining the color and product she wished to be used for her
roofing materials, At that point, M** *** had exhausted her day Notice of Cancellation periodShould you review the Color Select *** *** signed and initialed (see attachment) you will be able to verify that drip edge and other materials were not included in the initial scope of repairs as written by *** and would need to be supplemented forAfter speaking with the adjuster for *** he requested that our Project Manager, *** *** order an *** (aerial measurement) to verify shortages and submit for the supplement(s) after doing so
When the *** came back, it was evident that not only was the drip edge left out of the original scope...the counter flashing, box vents, and additional squares of shingles (approximately 4) were left out as wellIt was at that point when *** had contacted *** *** advising her of the materials which would need to be supplemented for in order to complete her roof correctly and in accordance with acceptable roofing practices*** *** basically stopped our communication at that point and halted the process further expressing she did not wish to have Ohio Restoration Solutions present at the time of re-inspect and did not feel as though additional materials were needed
Ohio Restoration Solutions prides ourselves on our ability to work with various insurance companies and the relationships that we have maintained withinHowever, from time to time, companies will refuse or question a supplement and will advise customers otherwiseBecause we were not invited to take part in the second meeting with the *** representative, we cannot speculate on what was or was not said with regard to their being enough money to complete her roofHowever, we can attest that all of the necessary components were not included in their estimate and would have to have been in order for her roof to be installed properly, Should Ms, *** have allowed us the opportunity to meet with the adjuster, we could have resolved those concernsIt has always been our intent to maintain a positive relationship with *** *** and to complete her roofing projectWe would like nothing more that to bring her home back to it's previous condition and make this a positive experienceHowever, we have to have adequate materials and all components to do the job correctly
Although it is not a common business practice of Ohio Restoration Solutions, we are willing to re- negotiate the 25% cancellation fee and settle the contract for a flat fee of $This fee is not a restocking fee, rather it is a fee for the expenses and expertise that Ohio Restoration Solutions has incurred during and after her approval processWe feel that the settlement offer is more than fair
