The purpose of this communication is to respond to the incorrect and allegations submitted by [redacted] On September 1, [redacted] entered into contract with our company to design, engineer, furnish, and install a commercial steel building structure The executed contract amount for our portion of the project was $103,454, at no time did our company agree to any contract amount other than $103, [redacted] has provided intentionally misleading and information in order sensationalize his complaint by claiming our contract was for $25, At no point in time did our company agree verbally or in writing to act as the general contractor for this project [redacted] *ndicated that [redacted] who was a personal friend of his would be the general contractor for the project and [redacted] would clear the lot At the time of contract our company provided to [redacted] at his request a reference and contact for a building in Lawrence Township in which we supplied and installed which was a similar type building [redacted] *t that time called the reference provided and vetted our company [redacted] claimed at this time he felt good about the transaction and wanted to proceed [redacted] has falsely presented in this complaint that the reference contact [redacted] had indicated we did not install the similar building [redacted] has recently admitted in our office that he may have not spoken to the reference contact at all but someone else who wasn’t familiar with the project Again, [redacted] is intentionally and knowingly presenting information in order to sensationalize his complaint On September 14, our office received written communication from [redacted] stating he would submit an application to the [redacted] department for approval prior to October 1, 2017, this did not happen so [redacted] by his own neglect delayed this project At this same time [redacted] asked to completely change the design of the building project which had already been started After some time it was apparent that [redacted] was struggling with the zoning submission but refused to pay a professional to handle this portion of the project Our office above and beyond our agreed upon and executed contract tried to assist [redacted] the best we could [redacted] *lso ask our office in writing to tell [redacted] he needed to start clearing the lot, [redacted] refused During my conversations with [redacted] about the project it appeared he was having issues with [redacted] as well [redacted] claimed he was checking into running new power service to the property and was in contact with *** Power [redacted] also claimed that nothing could be started until he got confirmation from [redacted] Power [redacted] also claimed that [redacted] had left most of the details of the project out during his communications At this point our office had received written communication from [redacted] asking if we could assist [redacted] in working with [redacted] Power, again this was not in our work scope per our contract By now it was apparent that [redacted] was trying to get contractors involved to perform work without having to pay for the services By written communication with our office [redacted] promised to drop off a site survey on October 16, 2017, that never happened We did receive a communication from [redacted] on October 21, explaining he had not had a chance to get us the requested site survey By his own neglect [redacted] has again delayed the project At this time [redacted] asked that our office follow up with [redacted] We left several messages with [redacted] with no return call Over the next three weeks our office did not receive the site survey or get a return call from [redacted] On November 19, we met with [redacted] and [redacted] in our office at which time [redacted] claimed he would not have enough funds to proceed with the project and he intended to breach or legal binding contract On December 5, [redacted] asked if he could get a partial refund for an invoice he had paid required by the contract in which work was already started and expenses incurred We explained to [redacted] that our office has been working on the project for four months now and has incurred expenses along with other contractors and vendors and that our office would forward an invoice for additional money owed by him [redacted] by written communication agreed to this arrangement It wasn’t until this time (after months of work) did [redacted] raise concerns about the reference given to him at the time of contract It was obvious that [redacted] realized that he would be in breach of our legal binding contract and was trying to remedy his neglect by fabricating excuses [redacted] intentionally and falsely accuses our office of no progress on zoning and permitting in which neither were ever in our scope of work In fact, it was through his own neglect that he delayed this project causing unnecessary expense for everyone involved [redacted] *lso falsely accuses our office of not communicating with the [redacted] for which we have phone records proving otherwise As a matter of fact, we have multiple written communications from [redacted] asking if we had received any updates from [redacted] [redacted] has no basis whatsoever when stating that he thinks only hours were spent on his project over the last five months Again, this is another attempt to sensationalize his complaint with and unfounded accusations At no time did our office give any or misleading information about our company or experience Again, [redacted] falsely claims that we were to act as the general contractor for his project Never did we agree, quote, give pricing to, or communicate our office acting as a general contractor on his project Our office has been in contact with [redacted] constantly over the past five months while working on his project We have taken every step to avoid charging him for additional costs that our office and vendors have incurred Recently [redacted] claimed he was being advised by his attorney in which we submitted in writing that we would be willing to communicate directly with his representation in order to resolve this issue but he refused It is our position that [redacted] realized that he has delayed his own project then terminated our legal and binding contract without cause It is also our position that our company has suffered damages due to [redacted] ’s neglect and accusations We respectfully ask that you allow our company to maintain the good standing with your firm and that this and unfounded compliant be removed

I have reviewed the response made by the business in reference to complaint ID 1[redacted] and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[Provide details of why you are not satisfied with this resolution.]This is a rebuttal to [redacted] answer to my complaint against him and his business, Ohio Steel Construction.  To summarize, I paid him a deposit on a commercial steel building contract, then requested cancellation of the contract due to deceptive advertising, negative comments from his referral source,  refusal or inability to pay a previous sub-contractor,  and refusal or inability to act as a General Contractor.  [redacted] knows I am not a builder or involved in any field related to construction, and I came to him after reviewing his website wherein [redacted] and Ohio Steel Construction hold out as a General Contractor.  I have made repeated attempts to settle our differences yet he refuses.   He claims I owe him the balance of a contract for a commercial building he agreed to design, engineer, furnish and install.  No design engineering drawings were ever produced, no steel was ordered and the building was not installed.  He claims he never agreed to act as the General Contractor; however as clearly described on his website, and assumed by me, he would perform the described services necessary to complete the project (I would not have a problem paying for these services).  I made it clear, and he agreed, that my chosen subcontractors would clear the lot and build the foundation, and would be paid directly by me.  [redacted] of Ohio Steel Construction falsely and misleadingly claims [redacted] (which is not even [redacted] company) would act as General Contractor. [redacted] is a foundation subcontractor, and [redacted] knows that [redacted] agreed to work only as a subcontractor, but [redacted], knowing that his website states that Ohio Steel Construction would take care of the preliminary work, was apparently fabricating this story to cover his deficiencies.   Some of the excerpts from the Ohio Steel Construction (OHS) website: “Ohio Steel Construction is much more than just a building contractor, OHS is the company that can handle all your construction related needs,” and later; “Our team handles everything from site evaluation to building cost analyses, and the actual construction work, with thorough professionalism and strict attention to detail.” Another webpage on Commercial Buildings: “With the OHS guarantee of dependable construction, everything from drafting the initial plans to securing the necessary building permits and licensing requirements will be handled for you…everything from the tiniest details to the final delivery will be handled for you by the team of professionals.   In addition, multiple photographs of commercial buildings of all types are listed that, I believe, falsely imply they are OHS projects.  Even a construction video appears to have been plagiarized with the credits blanked out. As far as I could tell, the company consists of [redacted] alone, with no team or even a secretary that I ever saw or ever answered the phone, even though he acts as if ‘our office’ consists of more than just himself.  Sometimes it would be many days before my texts or requests were answered.  Questions about other ongoing projects were answered vaguely.  While [redacted] claims I was responsible for delays, his false representations led me to believe he could do the project.  Why would he expect a layperson to handle duties performed by a general contractor? Also, I discovered that reputable builders perform the initial work prior to payment, to ensure that the project can be completed.  Finally, [redacted], a company that agreed to act as the excavating subcontractor for the project, said that he would look into site evaluation.  [redacted] falsely refers to ‘conversations’ he had with [redacted], when he spoke briefly with him one time.  [redacted], after site evaluation and trips to zoning office, concluded that the site was not practical for the project, something that [redacted] of Ohio Steel Construction could have discovered if he had been a reputable builder, before taking a client’s money.   J[redacted]s has repeatedly stated that he would give me an invoice for work that “our office” (meaning himself) had done so that he could refund the remainder of the deposit.  A witness even accompanied me to his office, because I felt he could not be trusted. In summary, I have never seen a business such as Ohio Steel Construction that appears to have no concern for client satisfaction, and worse, I believe unlawfully uses false and deceptive advertising to induce and deceive potential customers.
