I truly feel this lady is a little confused We have bent over backwards to make her happy and now she accuses us of theft All her accusations are and incorrect We did give her a discount and she has paid the discounted amount As far as we are concerned if she would like to call, I would be happy to talk to her We consider this account closed [redacted] ***

On May 21, Ms [redacted] came in to our office at paid $1,by Check #for the fumigation that was completed on May 12, I, [redacted] ***, spoke with her about scheduling the additional work that needed to be completed per her request and signed "Agreement" She requested a p [redacted] adjustment because work at the water heater enclosure had been completed by others and $was deducted from the original bid that was authorized by Ms [redacted] on 04/04/via signed "Agreement" She then asked if we could start the work on Monday, May 26, Due to the Memorial Day holiday I let her know we would begin on Tuesday, May 27, around 8:am On the morning of Tuesday, May 27, Josh Rood called the homeowner and let her know we would be coming so he could gain access to the property to complete the work I received a call from Ms [redacted] expressing that she did not know we were coming Since I had personally scheduled the appointment with her I knew this not to be correctShe spoke with the owner Ron Rood and we proceeded with work as per the signed "agreement" On Wednesday May 28, we returned to continue the work in the morning Upon my return from lunch there was a message on our answering machine from Mrs [redacted] asking where we were and if we were "hiding from her", she also said she would come "find us" and asked "why we are hiding from her" We returned her call and explained to here that our crew was at lunch and would return when their lunch hour was completed If she did not want us to do the work why did she allow us to keep returning and why did she call us asking where we were? We completed the work on Thursday May 29, At no time did she ask us to cease Since all of the work was completed and we have a signed "agreement" to complete the work we are entitle to full payment We did reduce the total bill by $as the water heater enclosure was repaired prior to our arrival She also asked us to cut the lock with bolt cutters as she did not have a key or combination to the lock Her complaint was filed after we completed all of the repairs and she had every opportunity to call the police and/or ask us to leave and she did neither In her complaint she states that she requested the repairs to be completed We have both a verbal and a written "agreement" as she herself states in her complaint Thank you, [redacted] ###-###-####

I am rejecting this response because:This is in response to Ojai termite response which I will mail said agreementSaid agreement was for fumigation or to locally treat termite infested areas, not constructionThis agreement was signed on 4/4/14, Ron insists this agreement is for construction however I did not order construction until 5/21/14, as per Ron's responseI would never have ordered construction to begin on a Tuesday since I work on Tuesday mornings, plus I would have locked my dogs in the house and lock the sliding glass doorAs per response Josh rood called the homeowner and let (me) know he would be coming so he could gain access to the property, if he called I didn't talk with him, my phone was left behind in the house that morningAs for calling pd, I did, I spoke with officer *** from Ojai pd on 5/29/There never was an agreement for construction, I never knew how much it would cost exept when proposal was written $would be taken offI never knew the date or time, *** said she would get back to meNo contract, break and entery by *** even admitted by ***, his father in letter I am sending per mail.Omega reversible necklace missing, one side silver other side gold, value $300.00, either return or pay for itEmotional damages - how can one place a money amount on peace of mind and safety of ones homeAgain please remember I do not have a computer in my home and I will correspond by mail, I will send the papers of so called agreement, and ***'s letter, please mail back to me since I do not have a computer

Please see attached contract, signed by Ms*** We were hired by Connie *** on 10/06/to set a live animal "have a heart"trap at her residence located at *** *** Avenue, Oak View, CA As the contract states the fee was $to set and remove a live animal
There is "no guarantee" as stated on the signed contractOn 10/06/Ms*** paid $via check #at the time the trap was set On 10/12/we returned to the property and were unable to locate the trap On 10/19/we reset & rebaited the trap On 10/23/we pulled the trap at Ms***'s written request, her note requesting removal is also attachedMs*** contacted our office on 11/02/to request the trap be reset free of charge It is our policy to charge $per week for live animal trap rental She then requested a refund of the original amount she paid a month earlier At this time her call was transferred to the owner *** *** *** offered to reset the trap free of charge but Ms*** only wanted a refundWe upheld our promise to set a live animal trap to catch a Raccoon with no guarantee that it would be caught as the contract states We maintained the trap, refreshed the bait for a period of days The trap was pulled at Ms***'s request
Ms***'s complaint is contradictory with regard to price and amount she paid She did not pay $ We do not feel she deserves a refund based on the terms of the contractMs*** terminated the contract with Ojai Termite & Pest Control, Incwhen she made the written request to have the trap removedThe contract specifically states the following:
1) no guarantee
2) service frequency (one time)
We went above and beyond the service contract and do not feel Ms*** is entitled to any refund of original monies paid

Review: Called pest companies-questions were: what is the cost for removing 1 or 2 raccoons, and what was done with the raccoons once they were trapped? Was told cost of trapping and removing 1st raccoon to 1 mile away was $225.00, 2nd raccoon was $50. I told the person who answered the phone at Ojai Pest that it was fine. They set a date (Tuesday) and told me to give a check for $225 when guy brings trap. Guy showe, I told him I had 2 raccoons. He said he was told there was 1 and If he had known there were 2 he would have brought 2 traps. I confirmed that he planned on taking the trapped raccoon to at least 1 mile away- he said to Lake Casitas or mountains. He set the trap and said to call him if I caught the raccoon. He told me to unset the trap Friday because he was not able to collect raccoons on weekend. He said he lived close and if I caught a raccoon I could call him. I unset the trap Friday and then set it again the following Monday. I unset the trap the subsequent weekend. I reset the trap the following Monday, early. That same morning a different guy came to tell me he was there to set the trap. Told him that I had been setting the trap over the last 2 weeks and had unset it for weekends as directed by the 1st guy. 2nd guy guy said that the 1st guy was no longer with the biz. 2nd guy said that they were required To check trap, whether I was setting it or not. Showed him the trap location and it was already missing the bait I left. The guy said would work better if bait were attached with ties. 1st guy had not told me. I caught neighbor's cat, let it go, closed and left the cage w note for the guy saying I was going to see if raccoons had left. He took the trap. I called following Mon. to ask they bring it back and was told that the pricing had just changed- now they charge $50 week to leave trap. I said this was not what they proposed, nor agreed and asked owner for refund, or they could keep $50. They said new policy, $50/week,not charging per raccoon removal, would use my $250 for weekly useDesired Settlement: I want the $250 refunded because Ojai Pest did not keep the pricing proposal I was quoted by the person who initially took my phone call and sold the service (I maintained trap for 2 weeks based on what 1st guy told me.) now salesperson says that the new policy now $50 week to pay for weekly service (I maintained the trap myself for 2 weeks, left trap closed for their pickup in week 3) and that they were no longer charging per removal. New policy. They want change to charge $50 week, I declined.

Review: house was tented for termite on may 12, 2014. I delivered the check in person to the secretary stating I would like to have the damage done by the termites done asap. secretary stated since the water heater framework was already completed by someone else the estimate would be different, "I will call you with the new estimate and the day the work will start". No word from the secretary, on May 27, 2014, while I was at work, I came home and 2 trucks from the termite company were at the house, the gate latch was broken away from the house and one of the workers were inside the house, he came through the unlocked sliding glass door of my bedroom where my 2 dogs are kept. This man came in the house because of pounding done outside had shaken loose 1 of my tea pots I kept on the ledge, he came in and removed the remaining unbroken china. While he was in the house he went to the spare bedroom to repair the door frame which was destroyed by termites. so l. I had no estimate of the work to be done, 2. I was not given a date of work to start 3. break and entry. I called the termite company and complained, the owner was irate "you are talking about my son". That was the end of the conversation, no follow up from the company except for the worker apologizing for entering the home. I also have his confession on my phone, (which was not with me at the time of entry to my home.Desired Settlement: I feel as though I have been violated by a complete stranger entering my home and doing work inside and outside my home without permission. Yes I did tell Ojai termite I wanted work done, but it was not confirmed, meaning, I did not have a time schedule or estimate of the work. As of yet I still do not have an estimate. P.S.. please reply by mail since I do not have a computer at my home. thank you for your consideration. I do not plan to pay the second half of this bill.
