O.K. CARS Stands by it's position...The [redacted] dollars was a nonrefundable deposit to hold the vehicle....

Complaint: [redacted]
I am rejecting this response because:  These are all lies.  I was not told that my money was non refundable. I was not told that this was a partial payment. There was no way I would have given him $[redacted] to hold a car for me when I was undecided, especially if I knew I wouldn't have my money refunded back to me.  I didn't go home to get the rest of any money or documents, because I had no reason to go back home to pick up any other monies, because I was undecided about the car.
He told me to contact him on Monday to let him know for sure if I was still interested in the car, but before I could even call him back, he called me on Monday morning on my job from a cell phone @10:32a.m. asking if I was going to get the car, and I told him no, and I asked him when would I receive my money, this is when he told me I wouldn't be able to get my money back. I asked this man if I would receive my money back, and he said if I decided not to get the car, contact him on Monday, and I would be able to get my money back.
These are all lies. I never told him I was going home to get any documents to bring back, and the office was closed on Sunday, how else was I going to reach him if not on Monday when the office was open.
I mean they even insisted on taking me home to get my check book, but I wouldn't do it. Whoever the manager is over this company has been terribly miss informed.  This man mislead me into believing that he was going to hold this car for me, and even mislead me into thinking that I would receive my money back.  He insisted on me giving him money to hold  this car. I was aware that I would receive my money back, and I want my money back. Everyone that was in that office that day knew what took place, and if they are in agreement with this illegal conduct then they are all telling lies. Whether it was tax season or not, it doesn't and it didn't give him the right to take my money wrongfully. He should be ashamed.
I am tired of people getting away with illegal operations. This is why he asked my family members to leave out of the office, so that I wouldn't have any witnesses. So this way my family wouldn't  see what his real intentions were, but I will not rest until I get my money back.  He is not telling the truth, and anyone else who is in agreement with him is lying as well. I am tired of people taking advantage of people who work hard for their money.  It is unfair. I don't have money to give to him to put in his pocket for an unearned commission.  The money he has belongs to me. What he said is not the truth, and he knows it. It is totally unfair, and illegal.   Something needs to be done! All I want is my money back, because I have been robbed....................I took his word. I am very upset right now, because he has lied on me, and I don't like it at all....Thank you....... there is a difference between holding someone's money and putting a down  payment on something.  [redacted]
P.S. If he missed several sales on the vehicle, then why didn't he call me to let me know that someone was interested in the vehicle, instead of lying saying I never did show back up, and any way, It was late Saturday evening, right at closing time, and the office was closed on Sunday, now he had to have missed sales for the car on that Monday morning, unless he had interested buyers calling his cell phone about the vehicle.

Review: I went to O.K Cars in Vicksburg on Feb. 8, 2014 with my sister, daughters and my niece. I was very interested in the black corolla, but was very skeptical at the time, because I was just undecided on what I really wanted and needed in a vehicle, but I really was in need of an automobile. I test drove the car, and a young lady rode along with me. After making it back to the dealership, I sat at the young ladies desk, and I signed a form with all of my demographic information giving her permission to run a credit report. After my credit report was printed off, it was given to Mr. [redacted]. I did not get his last name, but he began asking me questions about how much can I put down, and how much I would be able to pay a month. I told him the amount I could afford. He then wanted to ask me more questions, but he wouldn't ask me questions in front of my family, so he told them that they would have to leave out of the office, and I asked him why, and he said it's due to privacy issues, I knew then that something was fishy about how he asked my family to leave out, my sister even said she had never heard of a dealer asking anyone to leave out of the office just to talk. I didn't think to waive my rights at the time, because I totally thought this was part of the procedure. So he gave me several options, but I wouldn't be able to handle the payments, only for what I had already told him. My sister kept calling my phone while I was inside the building and texting me to not give Mr. [redacted] any money. So I told him that I would have to think about it a little while longer, then he suggested to me that I can put money down on the car and he will hold the car for me, and I can let him know something for sure on Monday. I asked him if I put my money down on the car, and I decide not to get the car then will I get my money back, he said yes. He said to let him know something on Monday. So since I had his word, I let him swipe my debit card for $[redacted] to hold the car for me, because I told him that I didn't know I could make a payment for him to hold a vehicle for me, he said "oh yes we do it all the time. I didn't think I would have anything to lose, so I trusted him by giving him my money to hold the car for me. He suggested that I give him money to hold the car, . I've been trying to locate an attorney to pursue this case for me, but I haven't been successful, because I just don't have the money to afford one. On Monday morning, I received a call from Mr. [redacted] from a cell phone number at 10:32 a.m. on Feb 10, 2014, asking me what had I decided about the car. I told him that I wouldn't be able to afford the notes for the car, and he said he was sorry to hear that, then I asked him when can he refund my money back to me, he said, you don't get the money back, I asked him what did he mean, he said once you make a down payment on a car you don't get the money back. I told him I need my money back, and that I didn't make a downpayment, its a difference between a down payment, and giving someone money to hold an item for you. Now if I changed my mind about the vehicle, what would he think I was coming back to his company for, other than to get my money back. He had the nerve to tell me he was sorry, and he hope I have good luck finding a car. The nerve of him. I felt horrible. All I want is my money back. It was not right for him to keep my money, when he told me specifically that I could come back Monday. I feel that I was robbed, and it's not right for these companies to cheat people out of their hard earned money.Desired Settlement: I just want my money back in the amount of $[redacted], and hope that O.K. Cars (Mr. [redacted] explain to his customers what it means when he suggest that they can give him money to hold a car for them, and if they decide not to get the car, that the money belongs to him. He should put this information in writing, and explain it to his customer, even if they read the small print. He needs to change his policy. He should also explain to his customers the difference between holding money and a down payment
