Revdex.com spoke with the owner of the business who stated that for the entire project, he has been in communication with the father, not the son. The father was informed of all charges up front, and it was explained to them that fees were charged to the by the County. He stated that he made it clear he...

would pay the fees, and expect reimbursement for fees. He said that at this point, his portion of the project is ready to be completed, but that he is waiting on completion of documents from the customer, and had been waiting for those documents to be finalized since early August before he can move forward with completion. He stated that the bill for services was sent a month ago, and he has not received payment.

Review: [redacted] was contacted to do a family subdivision of my grandmothers plat of land in March 2015. He was given a non-refundable $500 check for the deposit on April 7th. My wife and I are the clients paying for the survey. We were told he would be out there within a couple of weeks to begin work, and also that everything would be completed within a month. After not showing up for the first 3 appointments he finally showed up after 6 weeks. Each time he was called to follow-up, he said he would be there the following week. Once the survey was finally done, the property boundaries were not marked. We had to recontact him to come back out to mark them and over 5 months later, it still is not marked completely. He stated it's an additional charge to mark the boundaries fully. We had the understanding this was included in the quoted price of $2500. Since the initial few contacts with him by my father, and one call by me, he has yet to return any of my calls. He has only contacted my father a few times.I have left numerous messages on his phone since April, at one point asking for a itemized bill and if we needed to get another surveyor due to him taking so long. We have still not rec'd an itemized bill.As of September 20th, the paperwork and boundaries are still not complete. He has yet to complete the paperwork properly-it has been submitted to Albemarle Co multiple times with necessary items missing. The only updates on the process we have been able to get is from the County Planner in charge of our plat. Recently, he told my father there is an additional $1000 fee that the Co imposed on him on top of the initial $2500, of which we were never informed about. Just this week, I took my grandmother to have the plat paperwork notarized, and upon submission to the county, Andy did not put his seal on it thus rendering it invalid. It now has to be re-drawn up, re-notarized and resubmitted. We can't get the land titled to us until all is done, thus cannot move forward.Desired Settlement: I believe there should be a bill adjustment due to services not being rendered in a timely fashion, being done incorrectly and lack of communication by the surveyor. As the paying client, it is ridiculous that I cannot get in touch with him. I do not feel that he has completed $3500 worth of work and would like the job to be completed as soon as possible, or would like a full refund so we can hire another surveyor to come properly finish what Andy has not been able to do. We were supposed to be in our home long before September. Andy knew that we had a baby on the way and needed to have this done asap so we could get our home built. We are having to live with my inlaws now until we can build our home.

Response:

I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. When we originally contacted Mr [redacted] we were told it was going to be a total of $2500 for all services. We found out about the extra thousand dollar fee last month. When Mr [redacted] was first contracted for this job in April and given his non refundable $500 starting fee, we were told it would be about a month for him to complete the job. According to my phone records I called him on May 30th, at 6:24 Pm asking why he had missed all the appointments that he set up to come out and survey my property. At this point it was already past the time frame that he gave us saying he would have the job done. I called him again the next day, May 31st, at 4:01pm. Both times I was unable to get in contact with him and left messages on his cell phone to call me back. He never returned my calls but did call my father and stated that he had not come out due to rain. It drizzled for all of an hour that day. The next week his assistant was sick and the other times he had other excuses. I've seen surveyors work in the rain before and highly doubt an hour of rain would affect job performance. As he never returned my calls, I did allow most contact to continue through my father which I now see was a mistake. My father was made the initial contact person as I work nights and have trouble returning calls due to not being awake during most businesses hours. Our work schedules also didn't allow for us to be able to be on site when he was at the property. Since my father was also having the adjacent property surveyed, it was easiest to have him be the contact. Mr [redacted] was told by my father that he was only paying the initial deposit and all other payment would come through us. My name was on all the forms, not my father's. That alone should have been enough to prove that I was the client for that section of property, not my father. I called Mr. [redacted] again on July 28th, at 6:59 and left a message asking why my job was still uncompleted. I then asked him if I needed to hire a new surveyor and asked him to send me a bill as I was unsatisfied with his services. The number he gave us was his cellphone and he said he could answer out of office, but we never got any calls answered or returned. Mr [redacted] did give me paperwork to complete last month in August, but when I took it to the county to submit it they rejected it as it was filled out incorrectly. We gave the paperwork back to Mr [redacted] to fix the errors. When we returned the paperwork to the county again, it was refused again as it did not have his business seal. The road maintenance agreement form that we needed completed by him was one of the forms refused by the county multiple times. Come to find out, the form he gave us was a copy of a template that we now have to take to a lawyer to have typed up and completed. Mr [redacted] was hired in April, but by his own admission he just gave us paperwork in August. Why would it take four months for him to submit paperwork to the paying customer when he originally stated it would take about 30 days til completion of the project? I have yet to receive an itemized bill from Mr [redacted]. We were given a copy of the receipt of what he paid to the county a week ago by my father, but at this point I'm hesitant to pay him in full for services he has yet to complete. He wants payment now that we have the last bit of the paperwork, but we feel that we shouldn't have to pay until everything is fully approved through Albemarle County, which could be another few weeks as it has to go to Albemarle Co's lawyer for approval. We also just found out yesterday while reviewing our land use permit through [redacted] that it expires after 180 days, which we are fast approaching. The cost for that was $600, with $500 being returned if everything was done properly to their specifications. There is no way we will even be able to start the driveway in the next couple of weeks to meet that deadline before the permit expires. We are unable to begin work until after the survey is complete. We are waiting on a callback from [redacted], who approved our permit, to see if we can get an extension. But, the lady we talked to yesterday made it sound like we would have to reapply for another permit, which will be another $600 down the drain.Regards,[redacted]
