number1, I did not commit or promise her I would do her sale, I did not give her any kind of amount I would charge her eitherShe had items all over house at the time I came in to look and I told her she needed to separate items she planned on
keeping from the items she wanted to sell, I agreed that after that had been done I would come back and be able to give her the amount I think I could get out of the sale and then I would be able to tell her what I would chargeI never promise a possible client a certain date for a sale unless we at the time of the visit we sign a contractIn the 3weeks between our visit I booked three more sales which took me into September, My service is first come first serveI signed all three clients because they want there sales done ASAPIn this business you need to sign up people as soon as possible because there are so many other Estate sales companies out there to sign up forI have no control of when people call me so I tell people what month I have open at the time of the visitI did not ingnore herI did not take on other clients because they had more money for there sales than her, in fact I email her and told her to go on Estatesales .net and see if she could find some one else who could do her sale sooner than meI still offered her to do the sale in late September or early October, and she turned me down, she said I promised to leave a space for her in august which never happenedI turn down sales all the time for clients I think I could charge but would not make them any money, I don't work that wayI have been working days a week since march, I don't all ways remember to call every one back I' m not perfect in that matterThere's many times I just text them to let them know
I received there textBut because of this I will not trust her to do a sale for her because she was counting on the money from the sale to live on, no sale is a guarantee of how much I can make, it's all a game of chanceand she would not be happy if I didn't make enough off the saleI'm sorry she feels the way she does but I can't please all the people all the timeYou can ask any Estate sale company how they do there business and it would pretty be all the sameIn fact last weekend I lost dollars on my sale because not much sold and I did not charge my client the extra amount, I took the lossI earn my jobs by referrals, and I try to be as honest as possible with them all

- Eric told me that he would conduct an estate sale for me in August
-I asked him if he could do it and he said yes, that I considered a confirmation from him
-He never offered any paperwork for me to sign or indicated that he required any documentation signed in order for any agreement to be binding at that time
- I was exceptionally clear with him that I needed the sale done immediately and indicated that I was happy he could conduct the sale in August because all other estate sellers I'd contacted were booked into subsequent months
-He told me that he would charge $and then determine possible other charges once he and his estimator determined all items for sale
-I followed his instructions to separate the items for his and his estimator's review and to then call him upon completion - which I accomplished within four days of my initial contact with him -for him to return to examine all items, which he never followed through on
-When I'd called to make him aware that everything was prepared for his review, he told me he would call back 'in a few weeks' which he did not do
-After three weeks of hearing nothing from him I called him to follow up - it was ONLY at that time that he told me he was booked and not able to conduct any further sales until October (September was NEVER mentioned by him, as he states above.)
-Had I not contacted him, he would have just continued to ignore me as further months and time had passed
- He never emailed me as his also stated; he doesn't even have my email address
In short, he verbally agreed to conduct a sale with full knowledge of why I required an earlier time - that he never mentioned any sort of contract or documentation falls upon his shoulders as his responsibility as a business owner
His telling me that he would conduct the sale for me was taken by me in good faith
Had he not believed he could have conducted the sale for me, I should have been made aware of this immediately to make alternative arrangements instead of only learning of him having no intention of working with me after weeks of believing that he'd agreed to offer his services
Had I not believed that he considered himself in a position to do so, I would have sought out a different seller that could assist me weeks ago
It wasn't until 6/20/that he texted me a website to find other sellers, and information that I'd already found myself
Eric, how long did you intend to wait to come back with your estimator as you indicated you'd do? I was back in touch with you within four days on 6/to let you know that I was ready for your review - why is it you didn't 'take my business' or 'sign me up' at that time if you believe that your work is done on a 'first come, first serve' basis?
His unprofessional behavior simply reflects the fact that he backed out of a commitment and ignored me, hoping that I would just go away and not get back in touch with him

tell her I have nothing more to say other than if she pursues this matter futher I will have no choice but to sue her for defamation of charicture for slandering my name and my companyShe has out right lied about me giving her a price for the sale, a verbal agreement does not hold true court, its her word against mineGod knows who is rightI did not verbaly say I would do the sale I said I could do the sale, there's a difference thereI said I have august open at the time but those time slots filled in quicklyI have no other coment thank you
