I am rejecting this response because:
Mr*** has stated that, on May 16, 2013, I paid $
got sq feet of zoysia. That would be
about $per sq ft A phone
respondent at Old River Sod (661-397-7611) told me that the price for zoysia is
$per square foot
My Visa statement for that date states $59.13. This must be for the sq ft I bought at
about $per sq ft
Mr*** further stated that, on July 14, 2014, I bought
sq ft of zoysia for $18.28. That is
$per sq ft. I have only been to Old
River Sod twice to buy zoysia, never sq ft
At my former Bakersfield home, I had a back yard of Old
River zoysia that a landscaper installed.
When I left that home, it was a
beautiful living product that had been regularly mowed and fertilized. I know what it looks like and have had
success taking care of it
On the day that I bought sq ft of sod, I questioned that
it did not look like zoysia. The woman
who helped me told me that, when the weather warmed, the rye grass that was
then showing would burn off, leaving zoysia.
When the rye burned off, I contacted Old River to tell them that there
was not much zoysia present. I was told
that it would fill in.
Because the original sq ft of sod purchased did not quite
fill the lawn, a year or so later, I bought another sq ft
When the zoysia had not filled in a year after that second
purchase, I contacted Old River Sod again.
Mr*** responded to my email by explaining how to use ammonia
sulfate to kill of the persistent rye and strengthen the zoysia, further
stating that a couple of years of that treatment and the zoysia would be
thriving. In the first sq ft, I had
been told that I purchased zoysia and I had not. There never was much zoysia there to begin
with and now, I have thriving crabgrass, etc.
It was inappropriate for Old River to expect me to remedy its sale of
rye grass as if it was zoysia. I was
miles away in Templeton and so hoped what *** told me would remedy the
problem. However, ***'s plan was
based on the premise that there was sufficient zoysia to flourish. There never was
I asked to be reimbursed for the sq ft of sod originally
purchased (The sq ft that I picked up later was all zoysia.). Old River told me it cost $per sq ft. I asked a landscaper what it would cost for
him to remove and haul off the existing sod with a sod cutter and he stated
$300. That is how I arrived at $900.
Mr*** makes issue that it has been almost years
since my purchase before I filed this complaint. I complained year after year and Old River
strung me along by encouraging me to give the zoysia time to fill in. Two summers ago I received ***'s
instruction that after a couple of summers of the ammonia sulfate treatment,
the rye should be gone, leaving the zoysia.
After two summers of ***'s treatment, I don't have a zoysia lawn and
so I have had enough and I asked for my money back
Lastly, Mr***'s contention that the sod is sold "...AS IS..." is not consistent with California implied warranty law that suggests
that a product be fit for its ordinary purpose.
I was sold rye grass as if it was zoysia and when I told Old River Sod that it was not, Old River Sod encouraged me multiple times that it would "fill in".*** ***

Almost a year later, Mr. [redacted] purchased (picked up at farm) 20 sq. ft. of Zoysia grass inv.10083993 on 7-14-14 in the amount of $18.28. His total purchases amounted to $77.41. On 10-10-47, almost 4 years from his initial purchase and 3 years from is subsequent purchase, Mr. [redacted] contacted us expressing his dissatisfaction and demanding restitution in the amount of $960.00. After thoroughly investigating the above facts, Old River Sod declines any responsibility to Mr. [redacted]'s claim. Furthermore, as stated on our invoices, all sales are "made OD an as-is basis without warranties expressed or implied of any kind". Mr. [redacted] received 120 sq. ft. of healthy Zoysia grass sod. [redacted] Operations Manager Old River Sod.
