Mr. [redacted] did hire my company to repair the imperfections to
the walls, prime and install wallpaper which we did. ...

A few days after Mr. [redacted] paid for the work
performed.  About a week after Mr. [redacted]
called and stated some of the wallpaper was not adhering to the wall.  I went back and checked and found that to be
true.  The wallpaper was not adhering to
the wall properly, but there was no damage to the prep work or primer.
Prior to hanging the wallpaper the instructions it came with
was vague and we contacted the manufacture, talked with the representative and
was given more detail verbal instructions.
When Mr. [redacted] presented the problem, I again contacted the manufacture
talked with a different representative and was given different instructions to
hang the wallpaper.  Since it was verbal
they did not want to take responsibility for giving out the wrong instructions
and therefore was not going to provide additional wallpaper to correct the
problem.
My agreement with Mr. [redacted] was for him to provide the
wallpaper to install.  He gave us two
rolls to work with, in which it took a little over one roll.  When hanging wallpaper there is always going
to be some waste for cuts and matching.
Typically the person who provides the materials does just that when
additional material is needed to complete the job as long as there was no negligence
or intentionally misused of the materials provided.  When the job was completed Mr. [redacted] stated
he was very happy with the job, paid the agreed upon price and there was never
a conversation about how much wallpaper was left over.  It was only after there was a problem with
the wallpaper not adhering did he start talking about additional paper.
I told Mr. [redacted] that I would purchase only enough wallpaper
to correct the problem, which will take one roll, and he is insisting on me
providing two rolls. Mr [redacted] is an insurance adjuster and I have no problem
giving him my insurance information if he feels he has a valid claim.
To resolve the issue I am offering to provide at
my cost the materials to correct the problem and not use any of the left over wallpaper,
which the amounts he did not have an issue with when the job was first completed.

Review: None of the repairs he was contracted to fix are fixed. They either have continued, or the "repairs" he attempted have created new issues.

Curtain Drain installed - still getting water in the basement AND placement of original drain for curtain drain caused a sink hole in my yard.

Beam installed to support second floor; second floor still sinking.

1st Bathroom remodel still leaked; ruined 250+ CDS that Mr. [redacted] said he would pay for and didn't.

Vanity/sink inferior; too small; cracked within one month of install. Towel rack not installed properly. Falls off all the time. Sheetrock screws that were "accidentally" drilled through bathroom wall and stuck out into hallway all show through again.

Additional column that was added for support in the basement is not level AND was sunk into dirt, not a concrete base as the others were.

Essentially NONE of the work he did (35K's worth) was completed properly or held up for even one year.

Desired Settlement: I would like a refund for ALL the work he was supposed to do. He left a wake of problems and not one portion of the contracted repairs was completed satisfactorily. All of the problems he was paid to correct still exist (except one - the bathroom doesn't leak ((so far)) after the SECOND time he fixed it.)

Business Response /* (1000, 5, 2013/08/23) */

This project was done thur the [redacted] Community Loan Fund via a grant/loan to be forgiven after 5 years. The Loan Fund had their inspector write the specs for the work and materials, and inspected the work during the course of the job. There also was a local building permit issued for this job for the project. Both the Loan Fund inspector and the Building Official approved the work completed as satisfactory. A final sign off was done by Ms [redacted] and she was given a one year warranty, which has expired.

Prior to the completion of the job Ms [redacted] had voiced some concerns and a meeting was held with all parties present. Ms [redacted] agreed to the resolution and the work was completed accordingly, approved and signed off by Ms [redacted].

Therefore, it is my position I did complete all work in accordance with my contract, program inspector, and the local building codes. Ms [redacted] was given the manufacture's warranties for the materials and if they failed within their time frame or there is an issue with the type of materials she should contact them and/or the Loan Fund for relief.

Consumer Response /* (3000, 7, 2013/08/26) */

(The consumer indicated he/she DID NOT ACCEPT the response from the business.)

1)The loan is a lien against my home that uses up all the equity in it which forces me to live in the house for 10 (not five) years or sell it at a loss before then.

2) I voiced concerns on several occasions throughout the process (when his men didn't show up, showed up for 2-4 hours and left; showed up drunk; made holes in the walls when they were carrying stuff; when the new lolly column in the basement was crooked; when the curtain drain caused a sink hole in my yard; when he men removed the siding from one spot of my house to patch an area they had worked on on the other side; when his men pried up a tile of the parquet floor from under the bed in the guest room to repair the floor where they cut a hole in another room to access the floor joists underneath; when rust spots started showing through the paint on the first tub they installed that was supposed to be new less than a month after being installed; when the leak they were supposed to fix started pouring water down the onto stairs and into the closet below; when I came home and there were giant outlet covers in the bathroom because they had cut the new outlet holes without measuring so they used "oversized outlet covers" to make up the difference; and so on. I was exhausted "sharing my concerns" and hearing time and time again that [redacted] Painting "would fix it".) I said that I did NOT want Oliver Painting to continue working on the project but the GNHCLF representative said I had no choice but to continue with him. Wes Oliver said in response that time that he was sorry and had a "better" crew and project manager now.

3) After the last batch of problems, I also said I did not want Oliver painting to be the ones to fix the problems, I did not want Oliver Painting to return to my house at all. I wanted to get a different contractor to fix and finish the work but the [redacted] rep said state law says that Oliver Painting must have a chance to rectify the problems himself and I HAD to let him in to fix the issues.

4) At NO point was I EVER satisfied with the work his company did but the [redacted] told me there was nothing I could do about it.

5) I never received ANY warranties.

6) And Wes Oliver did not address the part of my complaint where he was going to pay for the CDs that were ruined by the still present leak after the bathroom renovation. There were almost 400 CDs ruined. He went through them one by one and made a stack of the ones he felt were unsalvageable which amounted to 250. We tried to negotiate an amount - I said $5 a CD which wouldn't even cover purchasing them all again used and he said $2.50 a CD; I said no to that. He said he would talk to his insurance company and get back to me; he never did. He just ignored my attempts to contact him instead.

Business Response /* (4000, 9, 2013/09/03) */

First of all I would like to mention that I have been in business since 2001 and completed several projects for homeowners thru the GNHCLF and this is the first complaint I have had filed as noted by your web site. We have always been committed to provide quality workmanship and complete a project to the customer's satisfaction.

Almost from the start of this project there were complaints and concerns raise by Ms [redacted]. We had a meeting at the [redacted] office to address her concerns. I had the employee she mentions removed from the site. The loan fund increased their loan limits for new repairs to address some of those concerns, and I was asked and agreed to do some of those repairs without compensation. They brought in a structural engineer to consult with the [redacted] Inspector and they came up with new specifications that would provide the best solution considering the budget restraints. This work was completed and signed off by the Building Official, the Inspector for [redacted] and Ms [redacted]. The Building Official, the engineer and the [redacted] Inspector made Ms [redacted] aware this may not be a guarantee fixed because the house was built on a slope, on top of wetlands and ledge, the house may continue to settle and there may be new issues as a result.

Regarding the CD's I never said the damage was a result of my negligence. They were stored in an area of the house that had water damage prior to my involvement. When the CD's were discovered in a box of standing water we had no way of telling how long or when they got wet, as there were no other visible signs of any water leaks once we did our repairs. I was giving Ms [redacted] the benefit of doubt and tried to negotiate a compromise to settle the matter that was rejected.

Review: I hired them to wallpaper my living room and dining room. I paid extra for them to do all of the preparation work as well. They installed the wallpaper and its falling off of my walls. Wes said that he agrees that he installed it wrong, that he will replace the paper. I paid over $1,000.00 for the paper, when he found out how expensive it was, he changed his story to he'll only replace one roll and try to reuse and salvage the damaged wallpaper that's falling off of the walls. I was supposed to have a roll left over because I ordered an extra, but they went through it because they kept mis-cutting it.

At this point, he's not returning any of my calls or text messages.

Next, I will be filing a complaint with the state of ** and taking him to court for all of the damage that he did to my house.

I would like the name of his insurance company as well, so please provide that to me.

Thank you,

[redacted]Desired Settlement: I want my money back, and I want him to replace the wallpaper that he destroyed.

Thank you,

Business
