I am in receipt of your written correspondence dated, January 12, 2015, concerning the Complaint ID given aboveFirst, I apologize for not responding to your email as I did not receive your email because of a change in our service providerYou may direct any future emails
toOlympus Gym at ***The forgoing is Olympus' answer to the complaintOn or around April 1, 2014, the Complainant called Olympus Gym inquiring about a membership he could use on weekends only because he belonged to a gym next to his place of employmentI informed the Complainant that the membership plan he was inquiring about was called a “Limited Use" membership and that I did not currently have the plan available, but I would be happy to create a plan for himinformed the Complainant that I would base the plan on a day use which includes Fridays, Saturdays and Sundays and the plan cost would be $monthly for a period of months (year), I explained to the Complainant that considering the low price of the plan that I would only offer the plan for a minimum of monthsOur year full use plan is $monthlyThe Complainant, agreed and he came into the club on April 4, and purchased a year individual, Limited Use Membership.I have enclosed a copy of the Complainant's contract herewith for your reference along with a copy of our pricing sheetAs reflected in the membership contract signed by the Complainant, the contract terms are as follows:The date your membership begins is 4/14/The date it expires or date of roll-over is 4/4/The amount of the Enrollment Fee is $20, 1* Month's Dues paid in advance $Amount paid now $In addition to Enrollment Fee, you are “guaranteeing to pay" monthly dues of $per month for a period of consecutive months (“the minimum monthly billing term"), beginning on 5/15/14.The Complainant fell behind in his payments on November 15"I sent an email to him at the address given in the complaint along with a copy of his November billing statementOn November 24, 2014, my front desk staff, emailed MrT*** informing him that his November 15", payment was returned and he owed $plus an additional $return charge for each month his payment is returned by the bankSee, Bullet Point #front page of contract as well as the Payment Authorization Section of the contract explaining any fees, including but not limited to collection fees.After the Complainant received our emails, he contacted the gym via phone and spoke with front desk staff requesting we cancel his membership because of non-useFront desk staff informed the Complainant he was under contract until April 4, and has not met his minimum monthly billing commitment for cancellingShe further explained the policies for cancellation under the contractOlympus offer its members a buyout of 65% of the remaining balance on the contract along with a written notice of cancellation delivered or mailed to the facilityI prefer members to deliver either written correspondence or mailed via US Mail to thefacility as I believe it offers 100% accuracy in deliverySee, Bullet point #front page of Contract.At the time of the phone call between front desk staff and Complainant, at no time did Complainant ever mention any physical inability to use the facilities nor did the Complainant produce any written documentation, Doctor's notes, further evidence, etcindicating he was unable to use a substantial portion of the gymSee, Section under Buyer's Rights to cancel, do not dispute that the Complainant may have emailed me, but because of a change in email provider and a change in email addresses, I have not received an email to provide him with an answerHad I received the Complainant's email, I would have responded with the same answer front desk staff provided him via their phone conversation and would have reiterated to him the policies and terms of cancellation under the contract.I have reexamined the Complainant's account and can reduce the amount owed to $He must contact the Collection Agency directly to settle on this debt.I hope this letter provides sufficient information necessary to reach a settlement in this disputePlease contact me should you require anything additional

I am rejecting this response because:
Even though I emailed and made the owner aware of my medical issues, she still turned my account over to a collection agency which required me to pay to terminate my contract approximately $200.00.  The owner is not honest and I really don't want to have anything to do with her or her business in the future so I paid the termination fee, which also included some interest and fee from the collection agency.
