Placed an order on June 27 online at www.[redacted]com for some signed drum sticks. This website business is apparently run by [redacted] and omega marketing concepts. I paid them for the items. I then received a box that was clearly damaged, bottom had been busted open it appeared and there was none of the items inside. I immediately noticed by email [redacted] and he responded promising to resolve this within 24-48 hours. Well that was the first lie as that never happened. My.[redacted] then proceeded to continually put me off for weeks telling me many different versions of what was going on that all turned out to be untrue. I subsequently demanded my money back, he has refused. He offered to resent me the items but I declined given the deterioration of our relationship due to his lies and inaction. He has told me refunds are not allowed. I reviewed the website and documented the order process and no where does he advertise that a consumer is forever presumed a refund even when items are damaged or missing, there is no suck published policy, another [redacted] lie. He now refuses to respond to my emails and refuses to refund my money. [redacted] appears to be a thief and I would appreciate your assistance.Desired SettlementFull refund as this is not my fault and is between [redacted] and usps, but he cannot be allowed to steal my money.Business Response Customer ordered the signed items and reported that his shipment arrived in a "damaged" box, but the items were not in the box. He was advised that we were investigating the issue and would certainly resolve the situation. The US Post Office in[redacted], Fl told us it is highly unlikely they would have not known of a damaged box since the order was mailed to customer's PO Box and they personally supervise all placements of mail in said boxes. The post office manager also said there has been problems with customer in the past. They did not elaborate. We called [redacted] and was advised by [redacted] to re-send the customer's order and that we were not responsible for issuing a refund as long as customer's original items ordered were re-shipped to him. This was done by our shipping personnel once we decided to end our investigation of the matter. Basically, we absorbed the cost of the items and additional shipping in an effort to resolve the issue. Customer was shipped his replacement order at that time and has since received the items originally ordered. The post office in customer's town also told us that since the customer's post office box is rather small the order would not likely have fit into it in the first place and he would have had to come to the counter to pick it up. This would have, in itself, made post office personnel aware should there be any damage to the original box) that our shipping personnel clearly remember reinforcing with strong shipping tape prior to originally mailing it to the customer. The customer has received a replacement order consisting of the identical items he originally ordered and has not incurred any additional cost. Our company has been out money for the re-order fulfillment and additional shipping. As to the customer's complaint that we wouldn't return his emails...again, he was told the order would be resolved and it was. Feel free to contact me with any further questions, etc. And, for your information we never received the first complaint notice from the Revdex.com. The only one we received was delivered in the mail today: 8-11-14. Thank you. [redacted]Business Response Customer says his replacement order was only a box with packing materials and no drumsticks (what he ordered). First of all, our company would have to be totally stupid to send customer an empty box after his original complaints, etc. Our shippers have verified that the drumsticks were indeed packed into the boxes, double sealed and sent to him...both times. He has received two orders from us with the postal service in his town telling us that the original order would not have been delivered without them knowing it was damaged as bad as the customer says it was. It is a small post office and they are familiar with the customer.As to there being "many other complaints against him (our business, or me as an individual,on consumer websites), this validates the customers willingness to lie since there has never been a complaint against me, my company, or any company I have ever been affiliated with or owned.We are finished dealing with this customer. He has been sent his order...twice, at our expense. Feel free to post this on the Revdex.com website or anywhere else you desire to post it. We are not, nor have ever, defrauded, cheated or in any way sought to "pull a slick one over on anyone", as the customer says. We have a multitude of happy customers that have done business with us for years and there has never been one instance where we have been accused of what this customer is attempting to accuse us of. Our reputation will stand for itself. The next communication the customer will receive from us will be from our attorney.
