Review: There was a fire in my home in September of 2012. I signed a contract in December of 2012 to have this company restore my home. As of today 10/1/13 I am still not in my home because they have not completed the work. The inside of my home is nothing but beams, studs and insulation. They have had more than enough time. The contract stated they would be completed in 180 days. I am currently incurring rental fees of $1,300 a month because my home owner insurance only pays for my rental expenses for one year. I am on a retirement fixed income and I cannot afford this. I have tried countless times to reach the owner of the company ([redacted]) and he as not returned any of my calls. When I do reach his secretary she gives me excuses why they are not working in my home. I have contacted the building inspector for the city of [redacted] and He said he has run into problems with this company with my home as well. The inspector said they have given him the run around as well. This company is stalling with excuses after excuses. Weeks go by and no contractor is in the home doing work. When they get tired of hearing from me, they send someone to do one thing and more weeks pass with no one in my home doing anything. I don't know where to turn now. I am 74 years old on a fixed income and they wont complete the work they were contracted to do. They have received two payments from the mortgage company already but the inside of my home is nothing but studs, beams and insulation. Please help me.Desired Settlement: I would like my home construction completed by November 1st. which would be well over the 180 days contracted. If they can not complete the work as contracted I would like a refund so I can get another contractor to do the work.

Review: The reason for my complaint is because my house caught on fire last year 06/17/12 and I hired USA Water & Fire to work in my house to repair the damages. They started working in my house after the fire but, have not yet finished the job and are now ignoring my calls/emails and when they do communicate with me they give me/my spouse the run around. We are still left with an unfinished bathroom, kitchen and basement amoung other minor touches that needs to be done. They have been paid for the job however; they are not completed. My family and I have been back home since 05/03/13 and they have not made any attempt to finish my home. I call them regularly and my spouse send them email and we get very little to no answers inregards to the matter.Desired Settlement: DesiredSettlementID: Other (requires explanation)

I would like for USA Water & Fire to complete what needs to be completed in the house (bathroom, kitchen, basement ect.) and be done with the house once and for all.

To whom it may concern:

At this time I do not accept the offer given to me by Omni General Contractors/USA Water & Fire due to the fact that they never come thru with their word. My house was supposed to have been done back in December of 2012 and due to USA Water & Fire negligence and not staying on schedule we did not get back home until May 3rd and here we are August 1, 2013 and still my house is not completed. Ever since December all they do is ask for extensions after extensions. I'm honestly over all their broken promises and the stringing us along. I have been waiting to receive a schedule from them for a couple of weeks and all I get in return is No reply or "We are waiting for the shower door that we ordered to come in so that we can put a schedule together". Dealing with Omni General Contractors/USA Water & Fire has been an eye opener as well as a nightmare. They have been to me as a customer very unprofessional as well as careless. This was submitted to me on 07/22/13 as "proof" that they ordered the shower door.

Where here does it mention "shower door"? Yesterday I send Omni General Contractors/USA Water & Fire an email making them aware that we have not yet received a shower door & if they can check the status on it; I received a call from Linda stating that the shower door was "damaged during transit". I don't believe for a minute what she said. It took for me to ask her to follow up on the door for her to find this out really? I emailed Linda this morning to find out the status of the new shower door and she stated it will take another week before she can place a new order. All that I ask for is for Omni General Contractors/USA Water & Fire to be done with our house once and for all.

Business

Response:

To Whom It May Concern,

I write in

response to Complaint #[redacted] which was filed against my company on January

25, 2014. My response, and the facts surrounding this matter, is as follows:

On June 8,

2012, [redacted], entered into

a Building Repair Contract with [redacted] relative to a fire loss

sustained to her home on March 24, 2012. During the repair process, Ms. [redacted]

requested of this contractor several supplemental (extras) items not included

within the scope of work provided by the insurance company or within the

aforementioned Building Repair Contract. The requests were as follows:

·

That [redacted] tear out,

purchase, and install siding to all elevations of the home. This, despite the

fact that the insurance company, as well as our contract, only included a small

portion of siding to be removed, purchased, and replaced.

·

That [redacted] provide a

new kitchen and bathroom in the basement level of the home despite the fact

that neither were included within the insurance company's scope of work, or

within USA's Building Repair Contract.

To these

requests, Ms. [redacted] was told that we at [redacted] would do whatever

possible to provide her with said extras. It was explained to Ms. [redacted] that we

would attempt to work within our budget and use any surplus money that may

become available to provide said extras.

During the

early stages of the repair process, it was brought to our attention by the

[redacted] Building Department that the third level ceiling height of the property

was in violation of local building code. We at [redacted] were

informed that the existing ceiling height was too low and that Ms. [redacted] could

not, and would not, be issued a Certificate of Occupancy until and unless said

ceiling/roof levels were raised so in order to conform with said building code.

At our own

expense, and in a good faith effort to ensure that Ms. [redacted] would be able to

utilize the third floor as living space, we at [redacted] proceeded

to prepare drawings, meet with the building department, and finally, construct

a 15' dormer on the roof of the house. In addition, [redacted], at

its own expense, extended the width of the stairwell to the third floor to meet

code requirements. The cost for the dormer and the stairwell was approximately

$15,000.00.

Notwithstanding

the exorbitant cost of the dormer, [redacted] went forward and, as

promised, removed, purchased, and installed vinyl siding on the entire home.

During this process, a significant amount of exterior electrical work,

including but not limited to the removal and reinstallation of the exterior weather

head, was required in order to adequately complete the installation of the

siding.

As [redacted] proceeded to the repairs at the basement level of the home,

our work efforts were thwarted by a deteriorated flooring system and substrate.

This, also not included in the scope of work provided by the insurance company

or within the four corners of the repair contract. The deterioration was a

direct result of the age of the home. Within this floor system were plumbing

pipes and lines that would have also required replacement in the event we had

gone forward to repair said flooring system.

Despite

all of our efforts and all of the additional money spent, Ms. [redacted] persisted

that we perform repairs not included within our agreement or to ever be paid

for.

In an

attempt to keep Ms. [redacted] satisfied, I met with her approximately one month ago

to review all of the items that she felt [redacted] was responsible

to complete. The meeting concluded with the agreement that Ms. [redacted] would call

on her own independent contractor to provide her with an estimate to complete

the repairs in question. Once received, Ms. [redacted] was to forward said estimate

to my attention so that I may review the same and discuss with her a final

resolve.

Approximately

4 weeks ago on a Saturday morning, Ms. [redacted] contacted me to advise me that she

was in possession of an estimate for approximately $19,000.00. I requested that

she forward the document to me for my review as previously agreed. Ms. [redacted]

immediately responded by stating that the basement level kitchen and bathroom

were included in her independent contractor's estimate and that I better

"[redacted]" replace both of them.

I

explained to Ms. [redacted] that she was out of line making demand for building items

that were never owed to her. I also told her that the way she was speaking to

me was inappropriate and completely uncalled for; especially after all that [redacted] has done to improve her home. As Ms. [redacted] continued to yell

and scream, I elected to terminate the call.

So

although Ms. [redacted] may be correct that her house is not yet complete, it is

apparent that she has failed to give you a true and accurate representation as

to why. We at [redacted] are certainly willing to complete any

repairs included within our contract. We cannot however complete said repairs

where there are preexisting conditions that preclude our forward progress.

Ms. [redacted]

needs to understand that she suffered a fire loss - She did not win the

lottery. She has taken a course of action rife with indignancies, selfishness,

and purposeful ignorance of any facts that do not serve to her benefit.

Please

contact this office with any questions or concerns that you may have.
