By way of introduction, On-Line Registration is a company that processes New York State Motor Vehicle Registration renewals on behalf of our clients for a processing feeWe have a Private Service Bureau license to do so from the New York State Department of Motor Vehicles (NYSDMV), of which I have
submitted a copy of for your reviewIn return for this license, we are required to follow the regulations of the DMVA few examples of include certain disclaimers on our website, pre-approval of our fees and our receipt template, among others.The case in question was an online order for the renewal of the client’s motor vehicle registrationWhen placing the order, our clients have the option of either paying our standard processing fee, in which the orders are completed as they come in, or our expedited fee, in which those orders are done ahead of all other ordersIn this case, the client selected the expedited processing fee option when placing their order, entered their information, submitted payment, and completed their order on our websiteUpon receiving the order, we processed it within minutes, sent the client their temporary registration, and followed up days later with their official receipt, as required by state regulation.Later that month, our office received a Chargeback notification for the $that the client was charged for our processing feePlease note that the reason listed was “Credit not processed” rather than fraudWe submitted our documentation to the cardholder’s bank, and we were successful in rejecting the client’s chargebackAt this point, no accusation of deception or fraud is mentioned to us in regards to disputing the chargeThese accusations begin when the client filed an appeal with *** ***, in which they protested their decision that we “….provided documentation showing the charge is valid”In this appeal, the client makes several claims:The client states that the documentation provided by us was misleadingThe client claims “… supporting evidence falsely states that the expedited fee is “not applicable”That is untrueThe client’s receipt states “not applicable” because we never give the NYSDMV any portion of the processing fee that we charge, and we are required to state on the receipt exactly how much of their bill went to the DMV and how much our processing fee wasPlease note the language, including the “not applicable” language, was approved by the NYSDMV prior to the granting of our licenseThe client states that “Had I gone to the DMV site, I would have gotten the same expedited service at no charge”I would like to also point out that in their submission of their complaint to you, the client states: “… which I only paid due to misleading advertising”We do not advertise the expedited feeIn fact, the only time the expedited fee is mentioned prior to purchase is on the terms and conditions page, where it also states: “NOTICE PURSUANT TO NYCRR THIS TRANSACTION OR SERVICE IS ALSO AVAILABLE, AT NO CHARGE, DIRECTLY FROM THE OFFICIAL DEPARTMENT OF MOTOR VEHICLES WEBSITE AT ***”, again as required by state regulationIn this case, the client would have seen the expedited fee but yet failed to see the notice on the exact same page that tells him where to do it on his own for free.In conclusion, the client claims we misled them into paying more by using deceit and fraudHowever, the “evidence” the client provides to back them up is without meritWe follow the regulations as required by the NYSDMV, and some of the language that the client uses to accuse us was approved by said department prior to approving our applicationWhile we are sorry to hear that the client did not appreciate the value of our service, this appears to be a case of post-contract buyer's remorse and we ask that this matter be closed on that basisAs the work was performed as contracted, as a matter of contract law, offer and acceptance and the principle of unjust enrichment, we are unable to offer a refund after the fact

I could have registeed my car for no extra fee had I gone directly to the DMV on lineThe service provided by the company mentioned in this complaint came at a cost of $They based their exorbitant fee on my ignorance of DMV chargesSince I was registering the day before my registration expired, it was absolutely necessary to have instantaneous serviceThey clearly implied that if I did not pay a $fee that they would process rthe oder in the order it was receivedThe advertising was clealy misleading to meI will inform the Attorney General of New York of this misleading business practice and have not ruled out private legal action
