This is my response to [redacted] when I signed the contract and ask for a half down due to all the hill storm damage not one Halestorm but taking mine we had three I explained to her were extremely backed up right now it was just me my wife and another helper since then my helper fell from a ladder and hurt himself so then at that point it was just me and my wife which I explained I told her it's going to be a little bit longer before I could get the job done because I was still backed up especially now being one man down and just me and my wife now with all of the Hill storm damage that we had we're trying to get to everybody as fast as we can I explain to her and made several attempts to go over there on days that they were not convenient for her because she had doctor's appointments or she was going to be out of town at that point she made an arrangement to leave the money with a neighbor friend that I had already done a better job for previously and they were going to pay me then she called me back and said I don't feel comfortable with that I'd like to see the job I'm not going to leave the money with the neighbor he does not want to get involved in my business so then that was another cancelled appointment by her when I tried to get there on the day specified then we set another date which I told her again I'm already backed up I'm about a month out and when she asked me for her money back I said what on my Revdex.com profile it says once materials are purchased there are no refunds because once they got this coil to the size of her house we bought that we cannot take that back for exchange or refund the supply house has that rule I did tell her that I would drop off the material if she did not want to use me as a contractor especially when she told me she did not want to use me as a contractor I said I would drop off the material and she could have whoever was going to do the job use the material she said no I want my money back and I tried to explain once again once the materials are cut for her house we cannot take them back for a refund or an exchange we have lost those I have a receipt showing that I bought her materials since then Superior Roofing which is done her Siding & Roofing has hired me to do this job explaining to Jim Martin I knew this lady in the problems that we were having he says that he straightened it out to where my crew could go over there and hang a job but she did not want me on property but yet she wanted my services we have yet to do the job because now Jim Barton from Superior Roofing does not have a credit account with the supply house nor does he have an account at all and they're having trouble getting the money together when they're used to paying time a week we do not float materials or time for people or contractor we are a cash account we have to pay for the materials before we take them out that's the reason for the half down deposit so we do not have a credit account at either supply house Miss [redacted] has been extremely difficult when trying to give her her material that she paid for it she said no I want my money when trying several attempts to break other appointments that I already had previously people that had their gutters jobs up for

If he indicated before I had a motor blew up in my truck or just now getting back on their feet with had tons of rain since then I have not heard or seen anything of this customer since then he should not have taken it upon himself to hire another gutter company to do the repairs for the proper
procedure would be to get an estimate from another gutter company then send me a written statement or a phone call saying this is what it's going to cost to fix the gutters if you don't get out here such-and-such time he did not do that so his warranty now that another gutter company has been there is no invoice I will not contact this person or take care of any repairs from here on out he did not follow proper procedures

No he's correct about threatening the police and have an as arrested the problem was the job group because he added more gutter to the house and felt like under the minimum charge he should be lee still able to get the extra footage of gutters that he was wanting to have on the right side of the
house and I told him that be an additional charge he said no it falls under the minimum charge and I did not want to argue we had already purchased materials we were there the morning to do the job but he asked his to go get more material and finished a job all in one day instead of having to come back I told him that he needed to sign a new contract for the additional work to be done he did not want to do that so that's where we stood he does not get a refund once with a cut material out of a coil we own it so yes we still have this material we were told not to bring it to the house so he does not have this material but there are no refunds when a gutter company cut coil out of a new coil we are still willing to give him his material that he paid for but he has stated that he would have a sore rested if we showed up on the property on his contract it states any actor delayed beyond our control and also states that there are no refunds and also states that the money was for Materials only it also states any above specifications or additional materials would be charged accordingly he did not want to sign this or pay for the additional cost of the materials so that's why the job did not get done and became to this point

not had time to set the repair schedule due to all the bad rain and hail and damaging winds or far behind we will get to our customers as quick as we can but right now we are overwhelmed with what we have now I'm at ***

I am rejecting this response because: It is difficult to believe that this company can outright lie about the facts and think they can get away with it At no time did I request additional gutter As a matter of fact the right side of my home already has a gutter and the left side is well over ft long It would be ludicrous for me to ask this company to do feet of gutter without paying for it The main problem was that he would give me a date and time that they were going to do the job and then the time would pass and I would call them relative to this appointment and he would put me off for another day This continued until I had enough of this over a period of almost two weeks In one of our last conversations, he stated that he would have to go rent the machine to shape my gutters because they were 6" and he needed to do them special He totally fabricates, when he stated that they came to my house with the materials ready to do the job All communications was by telephone and at no time did he, his crew or anyone come back to my house after the initial contract He did tell me that the job was too small and he would give me my money back Then his wife stated I would not get my money back because the contract states "If contract is voided for any reason after purchase of materials, customer will be responsible for any labor or materials involved up to that point." This was clearly a Down Payment as stated in this contract and not payment for materials I did in fact tell his wife that if she came to put any materials on my front lawn, I would have her and the crew arrested for Criminal Trespass After all the trouble trying to get this job done I had exhausted my patience I did tell him that I would take him to Small Claims Court if necessary This avenue is being utilized to avoid this if possible Additionally as you can clearly see by the attachments, he represented his business as a member of the Revdex.com (attachment 1) and I had only the same exact job done by a reputable company (attachment 2) immediately after he stated that he would not do this "small job"The unscrupulous reputation of this particular company, and owner, as I understand it, is well known in this industry Even the Revdex.com has a file on his complaints since he continues to advertise his company as a member I am a man of integrity who retired from the United States Navy after years of service and from the San Antonio Police Department after yearsIf this is not resolved, I will surely see him in court After all, he did state, in a text that the job was too small to do and that he would return my money.Regards,

We have had three hail storms in one year that is very very rare for Texas that's almost like getting a hurricane once a month but will wearing Halestorm type conditions and we're having a hard time getting materials and then when we have a repair we are already backlogged on our jobs almost 2 months in advance and then repair schedules are put on back burner until we can get caught up because then it becomes overbearing and ridiculous I have contacted this gentleman three times one time I left a response on a voicemail the second time he contacted me and told me that a Saturday was not convenient that he was not going to be in town I usually take Saturdays to run my repairs now that he has taken upon himself to get his gutters fixed by another company his warranty is no in void now that they have touched it so we are not interested in renting his gutter now that another company has come in and fixed suppose that problem I would like the Revdex.com to see this in my favor considering I've been your customer since 2008 and I paid my dues in my face and you get people like this that you just cannot make happy no matter what you do or say and everybody's out there for a refund and I'm sick to death with people crying about stuff and have no remorse or have nothing to back up their pledge with I would like to see these pictures that he has or video and I would also like to see the receipt from the other gutter company there's no way that the repair costs almost three-quarters of what the original job for $798 cost it sounds like to me he told the company to come in at a high bid if he was going to turn around and make mr. [redacted] pay for it any probably get the repair done for 150 - 25 minimum charge which is what we charge for a repair I do not trust this man I had a problem getting paid in the beginning and chasing my money after the job was completed as I said before we have had three hail storms this year and we are still backed up almost two months out in advance and we have roofs that had not even been loaded that were paid for back in June because of supply and demand so please take this gentleman off of my repair list and complete list because his complaint shows no bearing thank you sincerely [redacted]
