Mr [redacted] only decided to give me my pool cleaner and clean up his mess in my backyard after I told him I would be getting an attorney? It shouldn't take this for a business to do their job? Don't rob Peter to pay Paul and be a professional or get out of business? People in hays county and in central Texas deserves better Regards, [redacted]

Every body expects The Wimberley Pool Coto Honor the contract and The Wimberley Pool Cohas! Period But they don't want to! The Wimberley Pool Co has Honored its Contract [redacted] has been completed with in the contract time frameIf he doesn't feel we have, then have his "Team" of Attorney's contact The Wimberley Pool Coimmediately?

Complaint: [redacted] I am rejecting this response because: I am rejecting this response because:Dear Ms [redacted] in regards to Mr [redacted] s response to my complaint to the Revdex.com ID# [redacted] dated 09/14/on his not completing the pool that we contracted with him to build and that he has been paid in full forI never had a problem with the pool being plastered after we moved in I only stated that there could have be time frame of the sequence of events that followed.? To my knowledge there is no "river" that runs underneath our property to a "seasonal creek bed" behind our houseWe do have a dry creek that runs when it rains into a small tank and dries up within a few days of it rainingIt runs perpendicular to the house down a degree slope approximately feet east of the pool and is not an issue as far as our home or pool is concernedLike I stated in my initial complaint when speaking with the Plaster guy who was one of the original guys that plastered our pool he stated that "air must have gotten into the system during that part of the application process and had caused the rough finish" I would believe this is true since this is what he does for a profession and he seemed quite knowledgeable about the plaster application process.? Mr [redacted] did drop off a pool brush and instructed us to leave the pool running for hours a day for days and brush the pool twice a day for days pushing all the plaster dust to the main drain, which we did.? There was no plaster crew on the 20th of September at our house, it was the one gentleman I reference in paragraph twoHe did spend hours at the bottom of the pool sanding, but by no far stretch of the imagination did he smooth out the rough spots to our satisfaction as Mr [redacted] claimsAs I stated in my initial complaint he told me he would still need to come back to finish up the sanding and do some patching.? I did not witness this gentleman test our pool water for PH or Akalinity and there is no scaling or calcium build up around the pool inferring our neglect of maintaining the poolThis is our second home with a pool and I am very aware of the importance of maintaining the proper balance of "chemicals" for lack of a better word in maintaining the plaster and the pool equipmentOur previous home with a pool was eight years old when we sold itThe home inspection process included inspecting the pool plaster to see if it needed a re plaster job and, it did notThe plaster was in excellent condition due to its correct application and my proper maintaining of the pool waterI am very knowledgeable in using the pool water testing equipment with our current pool and do so on a weekly basis and I also take a "pool sample" down to Leslies Pool & Equipment Store in San Marcos TXtwice a month for them to test.To date there have been no abnormalities in our water outside of the pool maintience that I preform on a regular basisIf this truly was a Ph,Alkalinity,Calcium problem would not the plaster in the whole entire pool be affected as opposed to just the plaster in the deep end? Excluding the deep end of the pool the plaster in the hot tub and the remaining areas of the pool is done to our satisfaction.? As far as Mr [redacted] s contractors not cleaning up before they left the job site please reference the attached photosThese pictures show Hayward boxes which is the pool equipment installed, PVC piping that was associated with the jets that are in the pool and hot tub along with the crating material that the coping tile around the pool was delivered inExcess concrete piles that were a result of pouring the pool need to be removedMr [redacted] s framing contractors came by and picked the framing wood and 2x4rs that they wanted to keep for future jobs and left behind all the trash wood they didn't want or couldn't use anymoreI want all this trash left behind by Mr [redacted] s contractors removed immediately.? In closing, what was going on on the job site as far as other contractors were concerned is none of Mr [redacted] s business nor his concernEvery contractor was payed in full including Mr [redacted] and there are no liens on our homeUnlike all the other contractors Mr [redacted] is the only one we are waiting on to complete the job that we contracted with him to do and that he has been paid in full for Regards, [redacted]

Dear Mr***, *** *** entered into a contract for a swimming pool that clearly stated that the pool would be completed in working days after excavationworking days is Monday thru FridayExcavation started on January and was completed on January 20thworking days would bring
us to March 27thSection Paragraph & clearly states that every day of rain extends the contract for days due to drying out and reschedulingIt rained days which added daysIt also states for labor disputes would add daysWe all know on Feb16th called the day without a Mexican most workers did not work. that would have extended the contract till May 22ndAs of April 8th*** *** has had his cleaner installed and his yard has been cleaned upThat's a month ahead of schedule.

I am rejecting this response because: Wimberley Pools was paid in full the week of February 27th and I didn't have my pool cleaner until almost April that's almost weeks The pool cleaner has nothing to do with excavation days That's just not getting my equipment to me after Mr*** was paid in full Unacceptable in my book cause I needed that cleaner once water was in my pool and I had to hook it up myself as well As far as the cleanup once a company is paid in full you should as a company make it a priority to clean up ASAP (like in the next couple of weeks if weather permits, etc) You shouldn't leave a clients site uncleaned for weeks because you think you have extra days left in the contract to clean Especially after you have been paid in full! That's basically robbing Peter to pay Paul Mr*** told me he wasn't required to clean up, then he said he had until May 22nd and then he said its a courtesy that he cleans up So which one is it? It shouldn't be either of them because if you build a pool and are finish building the pool and your paid in full it shouldn't take a pool company weeks to clean and weeks to get the pool cleaner to them The pool company should basically get the client "closed out" and do it in a professional manner

The reason why the pool was not plastered till several weeks after the *** moved in was due to rain the Month of May and we in central Texas no it rained days the month of MayThe was no air that affected the plaster it was due to the river that runs under the property to a seasonal creek bed
behind the house with keep the pool shell wet on the inside of the pool with affected the plasterAfter pools are plastered the have to be brushed down or times a day for to days to smooth out rough spots etcThat's why the pool was not plastered till they moved in! As of the 20th of September the plaster crew sanded down the rough spots? in the deep end of the pool to their standards and their satisfactionWhile the plasters were there the noted that the *** are not keeping their pool balancedLow PH, scaling and calcium build up all over and the total Alkalinity is way offThis in not The Wimberley Pool CoresponsibilityAfter we plaster are pools we have a start up company set an appointment with customers to teach them how to clean their pumps and filters, set their ozone and balance their swimming poolsAs far as the mastic it will be doneAnd as far as the clean up we have cleaned all we are going to clean, there were so many contractors on that job site that we unhappy about getting paid and not doing any more until they got checks it could have been any body's trash? although my pool shell was filled with nasty taco rappers ,rotted food etc we still cleaned it outAs far as wanting 7,settlement NO!!
