This company claims I signed up for their services and electronically signed a contract. I did not sign a contract. On top of that, they are now charging me for their services. I did not get any “welcome” email, instructions to use their services, etc like they claim they sent me other than bulk emails that asked me to sign up. Now they are refusing to work with me and said there is nothing they can do since I missed a deadline I was never informed about.

Dear ***,

It greaves us to have received a complaint as we strive to provide the best level of service possible. We are familiar with ***’s situation as we spent prolonged time with her on the phone yesterday (4/4/2019) to understand her situation and do our best to resolve her concerns and search for a positive resolution.

As per the events that occurred, we received a signed agreement from her on July 11th, 2018 (attached). This agreement can only be generated online by the resident when they input their contact information, review the agreement, click check boxes to acknowledge reviewal of the agreement, and then finally by clicking “I Agree”. In no other circumstance would these agreements be electronically generated. Once that agreement is generated, notices go out to the residents to keep them informed and provide them with information and FAQ about the service such as; price, features, and availability.

Residents that pre-enroll before the service goes live are eligible to receive the first month of service for free. Where *** enrolled on July 11th, 2018 she also received the first month of service free.

On the day this service went live on February 26, 2019, *** received a door flyer (posted on all resident doors when the service is available), a text message to her cell phone (attached), and an email – as all residents do. All forms are communication are those that the resident input to sign the agreement – that way we know we’re using their most updated and current form of contact information. You’ll notice in the text message – “Test Text” (attached) that we also sent yesterday to confirm with her over the phone that she was receiving our texts. She did indeed confirm with us over the phone that she received the text message.

We hope that the evidence laid out before you will show that best efforts were made to communicate with residents about the Media Amenity. In addition to that, this is the first issue like this we’ve run into in all of our projects thus far accounting for more than 10,000+ residents.
