Once Again Children's Boutique Reviews (1)

Dear [redacted] :
This message is in regard to your complaint submitted on 8/5/201* 12:00:00 AM against Once Again Children's Boutique.  Your complaint was assigned ID [redacted].
I understand that you would like to update your original rebuttal statement (shown below)
Please provide your updated rebuttal statement. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The owner of this business told me to call her at the end of the day, Tuesday, July 29, 201* or the following morning.   This is the day I brought in three boxes full of our property.   I asked her for a receipt but stated she doesn't provide a receipt and gave me a business card.    She has stolen our property and actually threatened me harm while my daughter was present.  My daughter was in fact shaken with her mean words and anger and said she wanted to say something to the woman but was in fear that she may harm me or her.   My daughter was also offended by hearing the owner scream that the items she enjoyed and had pride in wearing was garbage and trash.   MY daughter was present to help collect our property and the owner's screaming and emotional state and threat to harm me was very upsetting to my daughter.   There should not have been a "situation" of any kind if the owner did not disperse and remove items to sell without my permission or acceptance of an offer.   If I would have know that the owner was such an unkind and extremely angry individual I would have never subjected my daughter to her.

There were very few tags (which is really irrelevant) that I were on my property I dropped off and her justification is extremely dishonest.  I didn't care for her low offer and didn't want it as I would rather take it to my place of choice whether it be Once Upon A Child or our parish sale.   The fact that we decided to have a last minute garage sale has no relevance on what she has done. The fact that she is treating this as I donated my property to her or gave it to her with whatever amount she felt like paying is unacceptable.   Ms. [redacted] said that she didn't have clue where all of out items went.  She was screaming look around.   It was evident that her store is chaotic and unorganized but this was not my problem or relevant either .   If I wanted to give our items away I would have delivered them to Good Will or other place of choice.   I did not donate nor did I give her permission to do what she wanted with my items.  I actually wanted to wait in her store on July 29th but she said that she was too busy and backed up.  It is clear now why she did this.

There is no sign stating that by leaving your items with her to go thru that she takes ownership of your property at this point and is entitled to give the owner whatever she determines.   There is no sign stating the she will remove your property from her store without your permission for someone to begin tagging.   She has no sign stating that by leaving your property with her, she takes ownership and can begin to profit from your things.   Rather, she stated to me that she is not a consignment shop but operates in a similar way as Once Upon A Child but gives more money to the seller than they can receive there.  Therefore, a consumer, like myself, would assume that it is up to the consumer if they want to sell the items or not.   A consumer, like myself, that has sold to Once Upon A Child, would assume that the business would keep the consumer's items together and provide an offer and would not begin to sell or tag until the consumer makes a decision.   She was not authorized to remove the items from her store or begin tagging and selling.  No money had exchanged hands and no offer excepted by me.

If she is going to remove consumer items from her store without an offer being presented and accepted by the consumer and all of the consumer's items kept together, she should tell consumers/sellers this is how she operates rather than stating she is similar to an upfront, honest and professional establishment like Once Upon A Child.  She should put a notice out and in writing that by leaving your items in her shop, your property belongs to her at that point to sell and pay out whatever she chooses.   She should inform the consumer once leaving her/his property in her store that she is authorized to begin selling your property before any money has exchanged hands.

This is the most unethical and dishonest business I have ever encountered.   She claimed that she had no idea where my property even was and probably was out being tagged when I went it to get my property on August 1.   She had some of our items on hangers behind her counter as she was yelling I was lucky that she would give me anything for our garbage.   She evidently believes that stealing is legal and I had entrusted that she did things on the up as she compared herself to Once Upon A Child.   She gave my husband two items back and we received only a small portion back prior to this on August 1.   She told my husband this past Monday, August 25th, that she had a few of our items and $20 for us from items "she had sold."  Still she did not understand that she is selling our property after I told her on August 1, I wanted all our property back.  Again she stated that day that she did not even have a clue what was ours or what she done with it.

I have been in contact with Once Upon A Child as I have done business with them in the past and the amount that I have requested is more than reasonable for the items that I left for her to review for me, the consumer.  It was for me to decide whether or not I wished to sell to her.  Good and ethical business practice is what a consumer would expect and whether or Once Again Children's Boutique itemizes a consumers' things or not is not then entitlement or permission for this business to separate items and begin to sell.   She used the excuse of "look around" at the chaos as reason to justify dispersing our things.   It seems reasonable that a business owner would not have chaos if a consumer's items were kept together and not removed from the store or separated prior to a consumer making a decision.

I walked into Once Again Children's Boutique on Tuesday, July 29th, and a month later she has been selling our items and the majority of the things I left her were never returned.   I did not want to spend the time at small claims court but it seems that since [redacted] sold some of our items against my request nearly a month ago leaves us with no choice.  She had stated very clearly and loudly on July 29th that she had no idea where our items were or what was ours and yet she told my husband on Monday, August 25, that she had $20 for some of our items she took the liberty to sell.  Our only solution seems to be small claims court since she which would then more than likely cost her a good deal more money then the monetary value of our property as I will request that she pay the fee to file since we have the expense because of her unethical means of conducting business.

My daughter would then testify to the things that the owner was yelling and the large number of items that we do not have returned.   My husband knows what we brought to her business and was told by Ms. [redacted] that she had sold some of our property.   I will also have direct information from Once Upon A Child to indicate the value of the property of ours that Ms. [redacted] has assumed ownership.
Regards,
[redacted]
