To Whom It May Concern:
I am writing in response to the complaint filed by Mr. [redacted]aka[redacted]...

[redacted] ("customer")
The Customer contacted OnDemand [redacted] after receiving an invoice for $1000.00 as a result of early termination of a contract with [redacted] as he was only aware of the contract ending in June of 2013. As stated in the complaint the Customer was originally enrolled with [redacted] through a Chamber program in January 2011, with a fixed rate in effect through the June 2013 meter read.
Upon further review by OnDemand [redacted] and [redacted] it was determined the Customer was sent a marketing offer containing a website link, along with an offer code. Although the offer was sent based upon the Customer originally signing up through a Chamber program, membership was not required to be eligible for the renewal offer.
Online enrollment occurs by accepting the Terms and Conditions of the offer via a check box, which is the equivalent of an electronic signature. Records indicate the account was enrolled online on February 14, 2014 by Ms. [redacted] as a result of the web offer sent to the Customer.
The details of the online enrollment were provided to the Customer on February 18, 2014. The Customer is stating that this enrollment was not created by anyone in their offices and indicated he did not wish to renew with [redacted]. As a result the Customer was released by [redacted] without penalty.
We attempted to contact the Customer to verify that they had not been assessed any cancellation charges; however he was not available. A message was left providing my name and direct number.

Review: [redacted] My wife, [redacted], and I, [redacted], II own [redacted], which is currently in good standing with the Revdex.com. My wife is the principal owner and Veterinarian of the business - she holds 51% stake of the company while I hold 49%. My wife enrolled our business in the [redacted] back on 12/27/2010. This program, which was offered through the [redacted], would provide a discount on [redacted] through [redacted] through June 2013. I do have a copy of this contract and am giving you information straight from this contract. Approximately 6 weeks ago, we decided to switch [redacted] suppliers from [redacted] to [redacted] with us thinking that the contract signed initially had been fulfilled since it stated that the contract was good through June of 2013. After filing paperwork to switch, [redacted] sent me a bill for $1000.00 on February 6th, 2014 for early termination of a contract. After multiple conversations with [redacted], they said a contract was authorized and renewed via web enrollment through OnDemand [redacted] Inc.I then contacted OnDemand Energy, Inc. and spoke with a [redacted] who is an account executive for the company. (Her phone number is ###-###-####, her cell phone number is ###-###-####, her email address is [redacted]). After multiple messages and very few call backs, [redacted] sent me a response via email (which I have) stating that the initial contract was renewed via the web on 1/6/13 by [redacted].My chief complaint is that this web renewal was never authorized by my wife, [redacted], or I and that this company is just renewing contracts without the business owners knowing. Furthermore, my business is no longer even a part of the [redacted] of Commerce which should mean that our business should not even be able to enroll in this program to receive the [redacted] discount with [redacted].Desired Settlement: I would like the $1000.00 cancellation fee to be waived immediately by [redacted] because the renewal of the contract by OnDemand [redacted] Inc., was done with no authorization of either owner of [redacted]
