Review: I first became concerned about not receiving rental income on my Imperial Beach Condo in November 2014. I am Active Duty US Navy and due to travel for training, fleet and ship exercise work ups and deployment (July-October 2014) I had limited access and limited internet bandwidth onboard the ship I was unable to regularly log onto my bank (USAA) website (and even then, in only limited view) in order to track the rental payments.Shortly after returning to homeport (on 31OCT14) and setting up my new home, I reviewed my bank account(s) and noticed that I had not been receiving rental payments regularly.On 13 NOV 2014 I sent an email to [redacted] inquiring as to the status of my Condo and asking if I had a rental tenant. I received a Welcome home greeting, but no response to my inquiry. I tried calling and texting Mrs. [redacted] several times, but got no replies, so I re-sent the email on 5 DEC 2014, stressing my concern as to the status of my condo, especially as I hadnt received any rental payments since July 2014. Again, I got a greetings email, but no response to my inquiry. I left additional phone messages and sent additional texts and emails on the 9th and 11th of NOV.[redacted] finally sent a short apologetic reply on 11DEC14, saying that [redacted], her daughter, had started looking into my stuff and that she thinks checks may have been sent to a Monterey address by mistake. (my agreement/file with [redacted] Reality had always been to submit rental payments to my bank/USAA, not to mail them to me or any other address) Again, I heard nothing resolving my inquiry.My husband, [redacted], called and spoke briefly with [redacted], but only passing the importance of responding to what I had already asked for. I estimate the amount they owe me is about $5,500.To-date I have yet to recieve my missing funds or a tax breakdown of rents paid for 2014.Desired Settlement: Approx $9000. Tax statement from the property management company so I can file my taxes.

Review: On 1-23-2010 we have signed a property management agreement with the RE company to manage our condo in IB. In the beginning we were satisfied with the service. Since May 2014 we are having problems getting the rent money they have collected for us and did not get any statements. We could not reach them on the phone or by email. When we went to their office personally we just heard all kinds of excuses of delays of having their brokerage funds tied up in legal matters. Since we had done business with them for 5 years we tried to work with them to get them back on their feet - but we have not received any funds to this date.Desired Settlement: To receive the funds owed to us and collected from the tenants of $ 10,812.5

Review: We had a property management agreement with One Choice Realty for many years. Most of the time they provided decent services. We started having problems in April 2014. They failed to pay us the rent amount for that month. When we inquired about it, they said they would look into it. As we went back and forth over time, they failed to pay us the rent for July, and again in September. They continually made up excuses as to why this was happening. First they played dumb and just said they didn't know how they could have missed any payments to us and were looking into it. Later they said it had to do with some legal issue they were trying to resolve and kept telling us it would be resolved soon and they would fix everything.

At that point we wanted to cancel our agreement with them because we weren't getting any resolution. They failed to pay us October's rent and then we spoke with the tenant and explained the situation. We told them not to pay One Choice anymore and to pay us directly. They received some advice from others to keep paying One Choice, so they paid Novembers rent to them as well, which One Source of course never paid to us. At that point we fixed the issue with the tenant so they would start paying us directly.

In total, One Choice received rent from our tenants for the months of April, July, Sept, Oct, and Nov 2014. Five months in which they did not pay any amount to the owners. The rent was $1,600 a month, plus the security deposit of $1,600 which they have not paid us, comes to a total of $9,600 they owe us.

I still follow up with [redacted] every month or so and just get the same answer stating the money is tied up and it has not been released from some legal matter. I really don't believe anything they say anymore because nothing has turned out to be true. They just seem to want to delay everything forever.Desired Settlement: To resolve this issue we want One Choice to pay us $9,600 they owe us that was received from the tenants of our property.

Review: In early April 2015, I met with [redacted] to discuss rent that had not been paid for several months prior. This amounted to $4968. She had also miscalculated how much she was taking as a management fee for several over a year (10% vs. 8%). This came to $528. She signed the attached promissory note, although we crossed out the date and initialed as she said that she did not know when she would have the money. I have attached a copy of both promissory notes.

We also agreed that I would put together a lien against her current property (1016 Ocean Lane). She agreed to sign the lien with the understanding that she would not be able to sell the house without having to first pay off the lien (or at least have money taken via escrow when the house was sold).

I expected to be paid the April rent when it came due. I did not create the lien because I have not been paid for April, and now May, and expect to put this amount on the lien as well.

After trying in vain to get a hold of anyone in person at the property management office, I sent a letter to One Source Realty ([redacted].) to cancel my contract with them and to get the renter’s deposit back ($2100). A couple days later I sent a letter [redacted]’s home ([redacted]) as I had heard that her office was closed. That letter is attached.

I did not receive payment of the April rent as expected. When I contacted the property management company, I spoke with [redacted]. She stated that the tenant come in and said that some of the people that were staying at the house were in Mexico and she would not be able to pay rent until April 27th, when they returned.

At the end of April, I sent a letter to the tenant asking them to please contact me. The tenant, [redacted], called me on May 6th, a day after she deposited the May rent. She stated that she would try to cancel the deposit. On May 8th, I gave her another call to see what she had been able to do. She said that she called the property management company, One Source Realty, and talked to [redacted], an employee/secretary. [redacted] said that [redacted] called [redacted] who told [redacted] to tell [redacted] that everything was okay and that they would continue to accept rent payment. Further, she mentioned that she had paid April rent and had the bank statement to show the payment along with all her other monthly payments.

At this point, the following is a list of what I believed to be owed by One Source Realty:

Total $10,908Desired Settlement: To resolve the financial obligations, I propose the following actions:

1) A letter written by [redacted] to the tenant confirming that One Source Realty will no longer takes her rent payments and that I am the owner of the property that is going to take over the management obligations. This needs to be done immediately as I would like the tenant to have clear expectations of what she should do with her rent payments going forward.

2) The rent that was collected in May ($1800) be immediately transferred to me. [redacted] received notice that she was no longer contractually able to take rent on my behalf and should not have accepted payment.

3) The renter’s deposit ($2100) should be transferred to me within 30 days. I believe it is illegal for [redacted] to not have that money on hand, regardless of the situation.

4) April’s rent along with the other back rent and miscalculated fees will be lumped together ($6624) and included in a lien against [redacted]’s current home at [redacted]. The terms of the lien will be set at a market standard interest rate of 10% (starting on June 1st, 2015, with a due date of December 31st, 2015. Failure to pay by this date will result in further legal action.

Review: have been awaiting business documentation for more than 6 months. they rarely answer phone calls. they rarely return text messages or emails. they keep making promises to follow thru on simple tasks and never do. they always have an excuse not to do it. outatanding documents are security deposit receipts(over 7 months) for 2014 tax year, and 1099 tax form (have been promising me these for over 6 weeks). I follow up several times a week and rarely make contact. when I do make contact they have an excuse why it didnt get sent and make a promise to deliver it the next day. this goes on and on. I have an estimated 5 hours of my time invested in trying to colect these simple documents. they have probably spent over 2 hours making excuses and promises to me. if they have the documents it would take less than 5 minutes to email it to me. I dont know what their problem is. I feel scammed and cheated. they also owe me over 4 thousand dollars in back rent but thats an issue for another complaint. thanks,[redacted]Desired Settlement: give me my tax forms and rental receipts ot the 700 dollars if you dont have receipts.
