Complaint: [redacted] I am rejecting this response because: As usual with One Hour of Las Cruces they are trying to make the deal seem different than actualityI purchased the GeoThermal Unit for the efficiency more than the costsThe efficiency that I barely got to use They did ONLY start up/shut down services and the other 40+ calls were due to system failure that were 100% under warranty unless they lied about that (wouldn't put it past them)The $8,REC was not a loanThey traded me a discount on the unit for the Renewable Energy Credits which I did not want to mess with and they were happy to takeRon called them his "retirement fund".The reduction in price can from TAX incentives from the state and federal govt, NOT One HourThey were paid the full amount for the system for which aside from months out of the first season (2014) needed service every couple of weeks just to runIn order to get the system to run each year they had to add at least 20-lbs of freon, but according to them there was no leakThe ground unit (entire purpose of the Geothermal unit) had to be segregated from the condenser until the middle of June and then again by the middle of SeptemberFor this I only received energy benefits for maybe a total of months but definitely not an entire seasonNow they state it is due to increased need for service but it was never explained that this service included venting hundreds of lbs of freon into the atmosphere nor did they explain how many days off of work I would need to take off to allow them to perform said "free" maintenance under (warranty)Valve replacements due to improper installs, hundreds of lbs of refrigerant, capacitors, and even a ground unit replacement in after of their techs said the major leak was coming from itMany days off for this "free" WARRANTY serviceAnd it did not last yearsIt made it a mere seasons and months and that is not including all of the downtime and part of the season when only half of the unit was active.All this culminated at the beginning of this June when they still could not figure out why it would not cool they way it was supposed to or where the constant leaks were coming fromI guess my need to have a system, that they were paid handsomely for, to work as advertised and as supposedly designed was too much for them and I was told they were just giving upI agreed to have the unit replaced with a standard unit because Ron stated that they couldn't figure out why it NEVER worked the way it was supposed toI was fed multiple excuses like "the water table is too high here" or "there is something in the dirt"Either way, they no longer wanted to provide service for the unit and I was very upsetRon promised he would have a new unit out to me the next week which turned into weeks and only after I called a few times saying the geo was starting not to cool again.So now we are here and I am asking for the DIFFERENCE back (again they didn't even read the complaint just like when all of the failed services happened)One Hour of LC was paid the full amount for the system (and still is receiving benefits from the REC's) that never worked to spec and now I do not even have the energy saving potential of the geo You say what I have now is $11,even though you advertise it for less? Then fine pay me the difference between what you were paid $after the Renewable Energy credit discount and the cost of the system I have now, $11,which is $You also NEED to have one of your people come take care of the safety hazard you guys left and haven't come to fix! Complaint: [redacted] I am rejecting this response because: Regards, [redacted] ***[To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the responseIf the consumer does not provide a reason the complaint will be closed Answered] Response to One Hours information With my last response, I included several dates that One Hour Air Condition was not aware ofSo much so, that it is being copied with my dates on their last response to somehow flaw my statement I say this solely because the business was clueless about how to proceed with the contractOne Hour Air Conditioning dropped the ball in providing service to my home after they spent the money and gave no alternative to stop the process The sales associate that sold the package was a representative of One Hour Air Conditioning, and speaks for the Company even after his termination From the Home visit from Tom [redacted] (January 2018) after my complaint was issued, new information was established that Tom knew nothing of He was unaware of the contact hours along with the several mishaps and service calls to my home I provided him with this information and he apologized for the company He also apologized for recanting his statement that we agreed to about the water heater and later took back the statement saying One hour doesn’t do plumbing On that conversation, I advised him of trying to back out on the contract that was promised and that if One Hour doesn’t do Plumbing, how are they doing Electric? Because Andrew no longer works for One Hour Air Conditioning does not absolve him on the contract that was negotiated on behalf of the business He along with Rocky agreed on the day they both arrived to my home to receive the additional monies of the 5, On May 2, and prior, I stated repeatedly the work that was needed to complete the jobThis work entailed an electric water heater along with the connection and installation At no time during the visit prior to May 2, or before was there to be any charge for work done on the Electricians part as a cost to the customer ( [redacted] ***) Along with the response I am deeply saddened that both business men (Tom [redacted] , Rocky B [redacted] would boldly lie I would appreciate them humbly saying they messed up and could not make good on the job But to say that I asked for additional work to be done is a bold face lie To top it off is that there was a hand shake involved from both gentleman as they looked me in my eye and told me how the work was to be completed Secondly, I would even offer up a statement that they may have forgotten they said somethings that they could not honor But again, to say that I asked to add 5,more dollars to have some side work to be completed is beyond disheartening and dishonors my integrity This should dishonor their business knowing that after almost a year of not having a contract to be completed and receiving 30,to ask for more money and not finish what was promised On the statement from One Hour with a date of October 7, I disagree again and call a liar a liar Tom says that I agreed to cover the cost for the water heater and they pay for the wiring shows that the whole statement is flawedWhy would you pay for the wiring and not purchase and install the water heater? And then say that this was not a part of the contractThis shows that this is a lieThen on top of that since I filed the complaint the company, I am now being charged for the work that was in the contract to begin with To add to that conversation Tom called back approximately a week later saying he would get someone out to complete the job of the water heater based on our conversationI told him about the cost associated with [redacted] because he was taking a long time to get back to me about the job I did not give him that information suggesting I pay for the installation or heater He was puzzled about the cost to the company and I was relaying to him because he said he wanted to work with someone who he knew that worked for him personally in the pastAlmost a month had passed until the gentleman showed up and assessed the situation When I called Tom after the Thanksgiving holiday he advised that It would cost me to install I was furious at this point because he was not recanting our conversation from two months ago, trying to pass the installation cost to meThis is when I questioned his integrity yet again as to the company playing games and lying, trying to not make good on what was promised on the entire job from their company As of today January 29,the Electric company has placed the meter on the solar panel but with no instruction of the system and how it works A technician came out on January 26, and he was clueless on how it worked eitherAll he could tell me is that he knew if the button was flashing orange, I could push the reset button to greenThis shows you how messed up the service is that I continue to receive From that service call, I am awaiting an appointment on Friday February 2,at to show me how the system should work Lastly I am still awaiting work to be completed on the air conditioning and heating installation After the evaporative cooler was removed, I still haven’t had anyone remove the thermostat from the wall to the unit The vents channeling the air through the entire home were never replaced except for the return air underneath the unit Overall I am still receiving the worst job ever I would like to conclude finishing the job and to start my warranty period of a completed installation

However, El Paso Electric Company has two sets of paperwork, one set for Texas and another set of forms for New MexicoThe set of Texas El Paso Electric Paperwork was then emailed to herMs*** did not respond to this email for about a month, a set of the Texas paperwork was sent to her via the United States Post OfficeThese documents were then executed by Ms*** and returned to us.On October 7, Tom *** reviewed the job with Ms*** at her homeThe subject of the water heater aroseHe told her that he was aware that the salesman, Andrew C***, agreed to cover the cost of wiring for an electrical heater, but did not agree to the purchase or install a hot water heater. In response to the
business I do not agree.
 
On March 18, 2017 I not only received a proposal for the
work that was to be completed, but signed an agreement with One Hour Air
Conditioning and Heating, LLC (One Hour). 
On this day One Hour was paid 23,000.00 through their salesman Andrew
C[redacted] I discussed with Andrew, the components of the installation and what I
wanted to be completed with the service. He toured my home and took pictures of
the electrical boxes, the crawl space, the closet where the furnace and hot
water heater was installed. 
 
Upon him taking pictures and notations he advised that I would
receive a new thermostat, upgrade to refrigerated central air and heat unit and
electric water heater.  Andrew told me he
would leave the evaporative cooler on the roof and the current water heater
installed for a couple weeks until the electric was upgraded. He also
told me that he would take the furnace out immediately because the weather was
getting hot.
 
On March 22,2017 One Hour sent two techs to install the
equipment along with a representative from [redacted] Electric.   On this day in which I took off work. The subcontractor showed me the work that was
to be completed per the order of One Hour Air Condition. The contractor advised that a separate box
would be installed in the closet for the water heater.  He advised that one hour had to pay an
additional charge that I need not worry about but to call Andrew to
confirm.  On the same day, I called
Andrew to confirm the what the tech addressed and he advised that this work
would be completed with no charge to me. The contractor from [redacted] electric
spoke to Andrew on the phone in my presence about the box for the water heater
and confirmed that it would be taken care of and there was no cost to me.  One hour would have to pay the charge.
 
On March 23, 2017, the techs Jo and Juan had completed the
work that they could on their end.  What
was completed was removal of furnace and duct work.
 
 
On April 12, 2017 I received a call from A&M electric
that I needed to call the Electric company due to some issues with the electric
being installed.   I spoke with Mr. [redacted] who is the Land Management Representative over the project. He
told me that One hour could not proceed with the project until they addressed
some issues with them. At that time I
had not received any calls from one hour advising me of any problems.  I called One hour and they assured me that
they were working some things out with paperwork issues with the electric
company and that there would be a halt to the electric upgrade and the rest of
the installation. 
 
Several weeks went by and I began to feel like I had been
scammed because I had nothing to show in my home that cost 23,000.  No heat and air, no solar panels and no
answers. 
On May 1,2017 Andrew called to set up a meeting at my home
on the dilemma that the company was facing on the project.  I advised I could take off another day of
work to meet with them on how to proceed.
 
May 2,2017 Mr. B[redacted] said that he wanted to be straight
with me about what happened to the work being completed. He advised that the
electric company required a transformer upgrade to hold the capacity of the
system.  He said that for the past month
he had been trying to negotiate the price down to about 10,000.  He said that his company would be taking a
hit on the cost and if I could meet him in the middle by paying half.  I asked him what other choice would I have
because he had been paid.  He said once
this phase was done he would make good on the work to be done.  I advised him of the water heater and how I
had to refill the propane tank because the process was taking a long time.  Mr. B[redacted] advised that I should only have
it filled one more time before the water heater was installed.
I filled out finance forms for another 5,000 and a hand
shake completed the transaction.
 
June 5, 2017 I spoke with [redacted] who is the Engineer from
EL Paso Electric who advised me that he had the plans for the transformer but
One Hour had not sent the payment for the work to be completed.
 
I called One hour and they advised me that Andrew would call
me back on this but a Tech would be out the next day to install my Solar.
I took off another day of work on June 6, 2017 for the solar
install.  The techs installed the solar
on the roof of the garage.
 
On June 20,2017 [redacted] Electric advised that they could
not complete their part of the electric again due to the solar panels being
installed on the garage and not the top of the house.  The representative chuckled advising that a
ditch(trench) need to dug to connect the conduit from the house to the panels.
He then said that he could do it the same day but it would cost One hour more
money.  I contacted One hour about the
issue and they send a crew on June 26,2017 to dig the ditch.
 
June 28,2017 One hour sent solar paper work to be signed
saying that the paperwork was out of date. 
I resigned the paperwork again still not having anything completed on
working.
 
August 3, 2017 [redacted] from EL Paso Electric had me come
sign the paperwork to have the transformer installed because he just received payment.   So from May 2 when one hour received 5,000 to
August 3, 2017 I was told several lies about why the Electric company had not
completed their part.  But on August 3,
2017 I received the truth that One hour had not paid the Electric company until
that day I signed the paperwork. Had the
electric company been paid 3 months earlier the work could have been completed
sooner.
 
Since August 3, 2017 I was told I should stop paying
electric but I still pay an electric bill and propane.  I also have a debt of 29,000 for work still
not completed by the ONE Hour Air Conditioning. The Electric contractor completed his portion
in September / October with installing the wiring for the electric water heater
and removal of the Evaporative Cooler.  
Between October and November 2017 I had to place 3 service calls in
which 2 were on a Sunday to try to get the heat and air system working.  Finding out from the technician that the
installation wasn’t done correctly fixed on the last service call.  Upon that time, I receive several thermostat
alerts daily on how the auxiliary heat is powering the system.
 
Today is Jan 11,2018 and I still do not have the project
completed. I never get updates and it always comes up that something has been
done incorrectly. Since the initial agreement,
the salesman Andrew no longer works at the company and the Owner refuses to fix
the issue.  The company has since hired a
manager Tom A[redacted] who has been clueless throughout the process and has given
me the run around. He has promised verbally
that the issues would be fixed along with the water heater being installed and
then tried to take the statement back.
 
Through the entire process, I have been ignored and given
incorrect information by the company. I
still do not have the service complete and now I am in litigation through the
bureau.  The resolution should include the
work to be complete, which includes the water heater.  The more time that it is taking to resolve
this issue includes time off work that needs to be considered and the inconvenience
and costs associated with payment rendered for services not performed.

There are several issues that developed during the installation of the air conditioning/heating, and installation of the solar panels that were not know by either side at the beginning of the project. It was both time consuming and costly. On March 18, 2017, a proposal was presented to Ms....

[redacted], by One Hour Air Conditioning and Heating, LLC (One Hour) salesman Andrew C[redacted] Included in the invoice was a cost to upgrade her existing system for $1,999.00. This service upgrade was needed to operate the new air conditioning and heater system, and the new solar system. Upon submission for a Service Upgrade to El Paso Electric, both parties were made aware that the service from El Paso Electric Company had to be upgraded by adding utility poles and a larger transformer had to be installed prior to completing the service upgrade. On May 2, 2017, Rocky B[redacted] Managing Member of One Hour and Andrew C[redacted] met with Ms. [redacted] to discuss this issue. At this time, it was estimated that the cost would be approximately $10,000.00. It was understood that each side would pay one half of the cost for El Paso Electric to perform the service upgrade. Ms. [redacted] submitted and received permission to add an additional $5,000 to her existing loan. The actual cost from El Paso Electric Company for the upgrade was $11,378.62. One Hour also agreed to pay for the cost of an electrical upgrade toward the installation of an electric water heater by Ms. [redacted]. The cost for this upgrade was $500.00. This amount was deducted from the $5,900.00 invoice. Net amount due on this invoice is $3,401.00 During the period Ms. [redacted] requested other additional work be performed by the electrical contractor. The attached bill reflects the additional amount due of $4,090.31 for her share of the cost of installing the larger transformer and the personal additional electric work performed by the electrical contractor from Ms. [redacted].

I disagree again and call a liar a liar. 
  Tom says that I agreed to cover the cost for
the water heater and they pay for the wiring shows that the whole statement is
flawed. Why would you pay for the wiring and not purchase and install the water
heater? And then say that this was not a part of the contract. This shows that
this is a lie. Then on top of that since I filed the complaint the company, I am
now being charged for the work that was in the contract to begin with.     To
add to that conversation Tom called back approximately a week later saying he
would get someone out to complete the job of the water heater based on our
conversation. I told him about the cost associated with [redacted] because he was
taking a long time to get back to me about the job.  I did not give him that information suggesting
I pay for the installation or heater.  He
was puzzled about the cost to the company and I was relaying to him because he
said he wanted to work with someone who he knew that worked for him personally
in the past. Almost a month had passed until the gentleman showed up and
assessed the situation.  When I called
Tom after the Thanksgiving holiday he advised that It would cost me 900.00 to
install.  I was furious at this point
because he was not recanting our conversation from two months ago, trying to
pass the installation cost to me. This
is when I questioned his integrity yet again as to the company playing games
and lying, trying to not make good on what was promised on the entire job from
their company.
 
As of today January 29,2018 the Electric company has placed
the meter on the solar panel but with no instruction of the system and how it
works.  A technician came out on January
26, 2018 and he was clueless on how it worked either. All he could tell me is
that he knew if the button was flashing orange, I could push the reset button
to green. This shows you how messed up the service is that I continue to
receive.   From that service call, I am
awaiting an appointment on Friday February 2,2018 at 9 to show me how the system
should work. 
 
Lastly I am still awaiting work to be completed on the air
conditioning and heating installation.  After
the evaporative cooler was removed, I still haven’t had anyone remove the
thermostat from the wall to the unit. 
The vents channeling the air through the entire home were never replaced
except for the return air underneath the unit. 
Overall I am still receiving the worst job ever.  I would like to conclude finishing the job
and to start my warranty period of a completed installation.

I am rejecting this response because:
As usual with One Hour of Las Cruces they are trying to make the deal seem different than actuality. I purchased the GeoThermal Unit for the efficiency more than the costs. The efficiency that I barely got to use.  They did ONLY 4 start up/shut down services and the other 40+ calls were due to system failure that were 100% under warranty unless they lied about that (wouldn't put it past them). The $8,996.40 REC was not a loan. They traded me a discount on the unit for the Renewable Energy Credits which I did not want to mess with and they were happy to take. Ron called them his "retirement fund".The reduction in price can from TAX incentives from the state and federal govt, NOT One Hour. They were paid the full amount for the system for which aside from 2 months out of the first season (2014) needed service every couple of weeks just to run. In order to get the system to run each year they had to add at least 20-21 lbs of freon, but according to them there was no leak. The ground unit (entire purpose of the Geothermal unit) had to be segregated from the condenser until the middle of June and then again by the middle of September. For this I only received energy benefits for maybe a total of 3 months but definitely not an entire season. Now they state it is due to increased need for service but it was never explained that this service included venting hundreds of lbs of freon into the atmosphere nor did they explain how many days off of work I would need to take off to allow them to perform said "free" maintenance under (warranty). Valve replacements due to improper installs, hundreds of lbs of refrigerant, capacitors, and even a ground unit replacement in 2016 after 5 of their techs said the major leak was coming from it. Many days off for this "free" WARRANTY service. And it did not last 4 years. It made it a mere 3 seasons and 2 months and that is not including all of the downtime and part of the season when only half of the unit was active.All this culminated at the beginning of this June when they still could not figure out why it would not cool they way it was supposed to or where the constant leaks were coming from. I guess my need to have a system, that they were paid handsomely for, to work as advertised and as supposedly designed was too much for them and I was told they were just giving up. I agreed to have the unit replaced with a standard unit because Ron stated that they couldn't figure out why it NEVER worked the way it was supposed to. I was fed multiple excuses like "the water table is too high here" or "there is something in the dirt". Either way, they no longer wanted to provide service for the unit and I was very upset. Ron promised he would have a new unit out to me the next week which turned into 6 weeks and only after I called a few times saying the geo was starting not to cool again.So now we are here and I am asking for the DIFFERENCE back (again they didn't even read the complaint just like when all of the failed services happened). One Hour of LC was paid the full amount for the system (and still is receiving benefits from the REC's) that never worked to spec and now I do not even have the energy saving potential of the geo.  You say what I have now is $11,794.23 even though you advertise it for less? Then fine pay me the difference between what you were paid $16910.03 after the Renewable Energy credit discount and the cost of the system I have now, $11,794.23 which is $5115.80. You also NEED to have one of your people come take care of the safety hazard you guys left and haven't come to fix! The Copper pipes sticking straight out of the ground right next to my gate waiting to impale me, an animal, or my neighbors kids!!If you would have only done that last month I probably wouldn't even have bothered with all of this. As per usual One Hour LC attitude of "eh we already have his money" I still have this issue!Regards,
