Prices may exceed face value. This site is not owned by any venue."[redacted] states that he did not know he was being charged in U.S. Dollars. This is inaccurate, as our checkout process details this information. The statement displayed at checkout with the message “All sales are final. All prices are listed in US Dollars (USD).” discloses this information. Additionally, all sellers on our site are notified as soon as an order for their tickets is placed, which means we are unable to cancel orders or offer refunds. We consider this issue closed. generate tickets—instead, we merely facilitate transactions between ticket buyers and ticket sellers. Though Mr. [redacted] has filed this claim, our records verify that Ms. [redacted] placed this order on the telephone with a sales agent.Mr. [redacted] claimed that the price relating to his wife’s order was not divulged to her at the time of placing her order; this is inaccurate. Ms. [redacted] and the agent discussed a number of seat locations and their respective prices. Additionally, the agent and Ms. [redacted] discussed at length the various prices as well as her final order total of $252.31. No order can be placed with us without the customer agreeing to the order total. Ms. [redacted] agreed to the total charge and was asked if she agreed to the sales terms including the “all sales are final” policy. Since our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.Mr. [redacted] has indicated that the sales agent pressured Ms. [redacted] into placing her order; to this we would like to clarify. The agent simply explained to Ms. [redacted] the secondary marketplace and the live market it operates on. The agent stated that, as with any live market, prices fluctuate based on customer demand and market value. Additionally, the agent never addressed the primary market, [redacted], or their prices; he simply discussed the nature of the secondary market and the inventory available on Online City Tickets which sellers had listed.Ms. [redacted] received and downloaded her valid tickets shortly after placing the order for her event which has since passed. Before receiving this claim, we were in contact with Mr. and Ms. [redacted] to discuss their order. We have since offered them a one-time courtesy resolution though they declined. As Ms. [redacted] agreed to the total charge and discussed the additional fees with the agent prior to placing her order, we consider this matter closed. This site is not owned by any venue or box office.”Our customer has stated that their tickets were misplaced, to which we would like to provide clarification. Our customer placed their order on 11/23/2018 for Rod Stewart that is scheduled to take place on 3/24/2018. At the time of checkout, our customer confirmed to receive their two tickets via [redacted] Basic Delivery. Our customer’s tickets were successfully delivered to them on 12/4/2017. On 1/8/2018, our customer notified us that they have misplaced their tickets. As a courtesy, we reached out to the seller to request these tickets being reissued. The seller notified us they were unable to reissue the tickets; we relayed this information to our customer on 1/17/2018. It should be noted that per our sales terms and conditions, “We are not responsible for lost, stolen, damaged or destroyed tickets and are under no obligation, and, in many instances, are not able, to replace the tickets.”Our customer has also indicated they purchased ticket insurance when placing their order, to which we would like to clarify at this time. When customers place orders on our website, they are provided the option to additionally purchase ticket insurance through a separate entity. As we have no affiliation with this third party insurance site, all inquiries should be directed there.Prior to receiving this claim we thoroughly discussed this matter with our customer to address all of their concerns. As such, we consider this matter closed. Thank you for getting back to us regarding this issue. While [redacted]s continues to press forward with this issue, we are not, due to the nature of our business, able to offer refunds once a sale has been completed. Because the seller received notice that their tickets were sold the moment the order was placed, we are unable to honor this request and must enforce an “all sales are final” policy. We must also note that the greatest portion of the order was paid to the seller: as such, asking the seller for a refund would be unfair and in violation of the Sales Terms and Conditions that [redacted]s agreed to before checkout.  If [redacted]s has any additional concerns they would like to discuss, they are welcome to reach out to our customer service department. I recieved my tickets within 4 days of ordering.

In regard to Ms. [redacted] concerns with the price printed on her tickets, or face value, it should be noted that since we operate as a secondary marketplace thatserves as an intermediary between sellers and customers all ticket prices are set by the sellers, not Online City Tickets. The price is set by individual sellers based on their individual assessments of various factors including customer demand and a common occurrence throughout the industry. This fact is explained clearly throughout the purchase process, from a notice on every ticket listing and checkout page stating, "We are an independent resale marketplace. Ticket prices may exceed face value."
 
Since customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry. Additionally, this policy was agreed to by Ms. [redacted] prior to placing her order.
 
This is the first we have heard about Ms. [redacted] concerns regarding her order as she has not contacted us. Ms. [redacted] received her valid and authentic tickets on 12/05/2016 prior to her event on 12/17/2016. We encourage Ms. [redacted] to contact us in relation to any other concerns she may have. At this time, we consider this matter closed.

Thank you for your response regarding Ms. [redacted] concerns. Online City Tickets maintains that we do not advertise as the official venue. Ms. [redacted] suggested that this information may be disclosed in fine print, this should be noted as inaccurate. As we previously stated, directly on the homepage of our website, the following message was presented to Ms. [redacted]: "We are a resale marketplace, not a box office or venue. This site is not owned by [redacted] Theater Knoxville.” This page simply displays all the tickets Online City Tickets has available for multiple events occurring at the [redacted] Theater Knoxville. After she selected the event she was interested in, Ms. [redacted] was shown an additional message across the top of the ticket listing page: "We are a resale marketplace. Prices may exceed face value. This site is not owned by any venue." After being shown this, Ms. [redacted] selected a set of tickets and continued to the checkout page, which again stated: "We are a resale marketplace. We are not a box office or venue. This site is not owned by any venue." Ms. [redacted] expressed concern about the legitimacy of her tickets. We have a 100% Money Back Guarantee in place to reassure customers they will receive authentic tickets prior to their event. We screen the validity of the tickets sold by our professional sellers and have a customer service department available to provide assistance and address any concerns our customers may have. Online City Tickets adequately states, throughout the checkout process, that we are not affiliated with any venue and prices may be above face value. As we stated previously, Online City Tickets does not own or generate tickets. As such, we must adhere to an “all sales are final” policy—a standard throughout the industry which was agreed to by Ms. [redacted] at the time of checkout. Prior to receiving this complaint we tried to contact Ms. [redacted], stepping outside of our sales terms in the interest of customer service, to resolve this matter but have been unsuccessful in reaching her. I am rejecting this response because: I did not speak to them on 9/3 I could not get in touch with anyone even the credit card company tried. I spoke to them on 9/9 and told them there was no way that I could get the tickets via email at that point. I was away, that is why I needed them when I ordered them. I paid an extra 17 to down load the tickets right away. the button that said download now was grayed out.  why was I charged the extra money if they emailed them to me right away? I will tell you why because they are all a scam. At this point I just want my 103.00 that the credit card company did give me. Ok how about this they pay me the 17 x 3 the extra amount that I paid to down load right away.

This site is not owned by [redacted] Ontario Centre.”On 11/09/2016, once our customer selected the event they were interested in, [redacted] Chili Peppers, they navigated to the ticket listing page. The top of this page clearly notifies customers, “We are a resale marketplace. Prices may exceed face value. This site is not owned by any venue.” After customers select the ticket listing they desire, they are directed to the checkout page. Here, customers are provided with an order summary that displays the event details, ticket location, and price per ticket. Our customer was prompted to provide an email address and select a delivery method. After a delivery method is selected, since methods vary in price, a new order total is calculated. To adequately alert customers to this, enclosed by a blue box, the message, “Please note that your Total Charge has been updated” populates. A complete itemized breakdown of our customer’s order including the price per ticket, all fees, and the total price of $469.75 was displayed in bold text on the left-hand side of the page. This information was fully disclosed before our customers are asked to enter any payment information. Below this order summary, our customers are notified in the Ticket Information portion of our site that, “We are a resale marketplace. We are not a box office or venue. This site is not owned by any venue. Price: Ticket prices may exceed face value.” Customers are then presented with our terms and conditions, including a bold message which clarifies, “All sales are final. All prices are listed in US Dollars (USD).” Our customer was required to select a check box signifying their agreement to these terms. Customers are then prompted to select the "Review Order" button below these terms. Once selected, customers are taken to a review page which displayed their payment information, order summary and provided an additional itemized cost breakdown of their order in US currency. Our customer then proceeded to select "Confirm & Place Order" at which time their order was processed.Due to the nature of our business on the secondary marketplace, Online City Tickets is not affiliated with any artist or venue and do not own inventory; instead, we act as an intermediary between customers and sellers. Since our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.Prior to receiving this claim we thoroughly discussed this matter with our customer on 11/9/2016 to address all of their concerns. We maintain that all order details were sufficiently displayed prior to placing their order; nevertheless, we offered our customer a one-time courtesy offer in an attempt to reach an amicable resolution. However, our customer declined this offer. Online City Tickets maintains that our checkout process -- which did display ticket prices and quantity, all fees, and the total charge for Mr. [redacted] order prior to purchase -- was sufficient opportunity for Mr. [redacted] to review all relevant information. After being shown this information, Mr. [redacted] proceeded to enter his payment details and check the box to accept our Sales Terms and Conditions and agree that all sales are final; upon submitting his order, it was then immediately confirmed by the seller. At this point, we are unable to refund Mr. [redacted] as we do not own or generate any tickets; we merely facilitate the transactions between buyers and sellers. The ticket seller has not violated any of our Terms, so we cannot void the transaction. Although Mr. [redacted] continues to press forward regarding his conversation with our customer service agent, we have addressed this matter thoroughly in our previous three responses and maintain that we did not advise selling on venue premises on the day of his event. Rather, we simply suggested that he could resell his tickets to friends or family or through an online ticket resale marketplace. Though he was not entitled to a refund per the Terms and Conditions to which he agreed at checkout, we were in contact with Mr. [redacted] in an attempt to reach some amicable resolution; however, our offer was declined. We trust that we have sufficiently addressed Mr. [redacted] concerns raised here and in his previous complaint to the Revdex.com, number [redacted]. We have also addressed a dispute that Mr. [redacted] filed with his financial institution, which was ultimately ruled in our favor on 10/5.
