complaint issued by *** *** on July 21, complaint ID relative to hiring Onsite Engineering, PLLCto provide engineering drawings for the design of a septic system at ** *** *** *** *** *** Onsite Engineering met the owner at the site on August 6, and completed activities associated with designing a septic system. Onsite Engineering and owner agreed to a lump sum of $,for Onsite Engineering to provide engineered drawings to the Department of Health (DOH)Upon arrival to the site on August 6, 2015, trees had been removed in the area of the workIt did not appear that the original grades had been disturbed to a level that would interfere with the projectOnsite Engineering has successfully completed well over a 1,similar projects and did not identify the condition of the site as a concern. The owner was asked for a survey of the property that showed the location of the house with surface topographyA map was provided that showed a larger parcel from which the subject property would be sub-dividedThe plot did not show the location of the house or surface topographyOnsite Engineering advised that a layout for the septic could be prepared but the Health Department may ask to see the exact location of the house with surface topography on a survey mapOnsite Engineering advised that we are not licensed to provide survey work and if necessary the owner would need to hire a surveyor. Onsite Engineering submitted engineered drawings to the Oswego County Health Department dated August 6, for a septic systemThe DOH performed a routine inspection of the property on August 17, to review the engineered septic designWhile at the property, the Health Department observed the presence of excavated spoils from the excavation of the basement had been placed over the proposed septic areaThey also observed a pile of piping at the site and asked what was happening without a permitAs a follow up to the site visit, the Oswego County Health Department sent a letter dated September 9, rejecting the septic design plans to the engineer, owner, and TownIn addition to these questions, the DOH requested the property survey be updated to show the property lines and topographic contoursThe owner hired a surveyor to survey the propertyOn January 22, the owner provided a survey showing the property lines and topographic contoursOn May 4, Onsite Engineering met at the site with the DOH and the owner to discuss the placement of the building foundation spoils over the septic dispersal areaUpon arrival to the site the DOH told the owner that the contractor should not have been given a permit to construct without an approved septic plan and by placing the spoils over the dispersal area it renders this area not suitable for a septic systemOnsite Engineering was asked to help investigate options to put the septic field in another area of the property but was unable to meet the desired schedule of the owner so the owner hired another engineer who designed a system to be placed in another location on the propertyOnsite engineering does not feel we are negligent in any way for the work we have completed on this project and therefore not responsible to provide any reimbursement to the ownerIt is clearly a bad practice for a Town to issue a building permit without an approved septic designLawyers may argue it is against State Code to issue building permit without an approved septic because you cannot occupy a dwelling without an approved septicIf the owner had obtained an approved septic design prior to building the house, construction activities would have been under the supervision of the Professional Engineer therefore spoils from the house foundation would not have been placed over the proposed septic fieldThe DOH has agree, if necessary, to testify to support this factThe outcome of the project is not the responsibility ofOnsite EngineeringWe are not responsible for the actions of the Town, owner, or contractorWe remain of the opinion that we provided the services that we were hired to provide and furthermore request that the Revdex.com continue to give Onsite Engineering an A+ rating as an outstanding Professional Engineering CompanyPlease call if you have any questionsSincerely;Onsite Engineering, PLLCEric EMurdock, P.E
