Let us start out by Saying that this will be our final correspondence with regard to the wedding gown you purchased from Gowns By Design on September 5, We feel that the following points bear repeating:1. Nowhere in your correspondence do you acknowledge the fact that you signed a Contract which states in part "Stock and clearance merchandise is sold "As is" and cannot be returned for refund or store CreditALL SALES ARE FINAL." Displayed on the front Counter is a sign stating "Store Policy - All deposits or payments are non-refundableALL SALES ARE FINAL"This information is printed on all invoices as well 3.According to Pennsylvania State Law: "There's no right to cancel contracts or purchase agreementsWhether you can receive a refund is dependent on the retailer's return and refund policies." You made the informed decision to purchase the gown after your second visit, knowing our policy and an estimate for the alterationsThe alterations were in progress when you chose to discontinue the processYou also fail to acknowledge the fact that the body of the gown fit after the first fittingAny other changes made were at your requestIt was your decision to not have the dress completedSee enclosed photo of the gown as it was on April 28, and as it is currentlyIt looks accurate to the original design with the requested adjustment of the shoulder placementStreet sizing is irrelevant when comparing it to the sizing of a Pronovias wedding gownYou now have the generous benefit of not being billed for any of the time spent in fittings and the many hours of sewing work that was done over a period of months as well as free storage for the past yearThe fact that you chose another dress to wear for your wedding is not the responsibility of Gowns By Design.Finally, we just want to advise you that you have until Saturday, September 10, to pick up your gown and flower accessory with no additional charges being billed to youThe gown will only be released to either one of you unless you provide written permission instructing us to release it to another partyIf you have not picked by September 10, 2016, the gown and accessory will become the property of Gowns By Design and you will have no further claim to itThe contract states that the gown should have been picked up by no later than your wedding date of July 17, 2016, but we are allowing you this extra time.Sincerely,Karen J*** and Jennifer M***Owners

Gowns by Design: Jen M***, Karen J*** Dear Ms***: This is in reponse to the recently forwarded email of 7/13/of Gowns by Design which was received by your office and more recently received by my daughter (*** ***) and me. While it is unfortunate that this whole scenario is still dragging on, I feel I must address the comments made by MsM***. First of all, my daughter, *** ***, is quite simply a size 4. She has never been a size or above. The dress we purchased was a size 14. Subsequently, no other professional seamstress polled has expressed other than alarm at such an attempt at a reduction in size. Regardless of how Pronovias desires to size their dresses, or how these sizes may be interrpreted, *** is a size in standard clothing. There is no disputing this readily provable fact. Unbeknownst to us at the time of purchase, this is a huge undertaking (to drastically alter a garment from a size to anything more than dress sizes). I am not disputing the talents of MsM*** as the alterations were not seen to completion due to the looks of the dress changing. It should also be noted that the dress, as it is now (to the best of my knowledge) is not in a wearable condition. This is what we were to have accepted. It is neither a size or a size - - it is in an incomplete state. I would also like to note that on 3/30/MsM*** and I had a conversation which she does not mention in her presentation to The Bureau. I specifically and emphatically requested that she not do any more work on the dress until we (the three of us: Ms***, MsM*** and myself) could meet again to discuss a resolution to the process which was not going well. During each fitting, my daughter expressed concern and misgivings about the fit and subsequent looks of the dress. This was always glossed over by MsM*** with suggestions and alternatives. I took her at her word. The looks of the dress were changing and simply did not look like the original dress decided upon. And when it comes to bridal gowns, isn't that the whole idea? You like it, you buy it. We were told REPEATEDLY by both owners and staff that MsM*** "can do anything" when it comes to alterations. We were swept away with the beauty of the dress and the promises made. The date of 4/28/was originally planned as a fitting but was changed to simply meeting (per the phone call requesting no more work done on the dress). It was amicably agreed by phone (MsM*** and myself) that if we could not get together prior to this pre-set date, that would be the time we'd meet. This meeting found us (my daughter and I) perplexed and upset in that MsM*** had taken it upon herself to modify the dress after we'd requested she not work on it anymore. While she may have been anxious to please, she apparently was not "hearing" ***'s concern and misgivings during the prior fittings, nor my specific verbal request to not continue on and instead chose to pursue her own agenda. The gown, with her newest adjustments and additions to the shoulder straps, was hanging quite visibly in the dressing room where the three of us were gathered, so the statement that *** "refused to look at it" is unfounded. The looks of the dress were no longer the same as what was originally purchased and thus *** did not see any point to continuing further with the dress. It should be pointed out again that throughout the fittings, MsM*** mentioned on more than one occasion that "no material has been cut" and that the dress could eaily be restored to the size 14, which would seem to imply that there was an option and we were not locked into this dress. While MsM*** did not "quit on the gown" as she states, efforts to continue with alterations to ***'s size would have been futile. It only made sense to stop at this point. During the upsetting meeting of 4/28/16, when we reached an impasse, MsM*** summoned her mother and business partner MsJ*** to join us. She was apprised of the situation and dilemma and could see that *** (Ms***) was visibly upset and in tears. It clearly was not working out for her and for the dress and she was understandably upset about the whole situation and felt bad that time had been spent working on the dress and it was not coming along as expected. It was then that Karen (MsJ***) suggested that since *** was so distraught that no decisions be made at the present time and offered another chance at finding an alternate dress there. On 5/3/16, another possible gown was set aside and we were to "sleep on it" and get back to them regarding a decision. This dress was another size 14. The gown would have needed altered down to a size 4, as the original one. At no time were fees discussed or the possibility of anything in that regard being waived. There were aspects of the gown that prohibited *** from viewing it as the dress she desired. I must say that throughout this whole experience, *** has tried to spare feelings, tried to go along with everyone's encouraging suggestions and be compliant. I will also add that MsM*** and MsJ*** throughout had been seemingly anxious to please and accommodate. Karen even said at one point that they'd never come across a situation like this before. For these and other reasons, I had hoped that this could be resolved to the benefit of their business and my daughter's happiness and my wallet. Ideally, the cost of the alterations could have been deducted from the cost of the gown, they could have kept the gown and resold it. Instead, we were asked to take a gown that is not in a wearable condition after having spent close to $1,000. This does not seem equitable or a good business practice.
