I am rejecting this response because: the disposition of the Portfolio Minimum of $was not returned to us the Property Owner nor was the Bose Surround System returned*** only provided the documentation of what the invoice charges were against the tenant for the move out (some of the charges Emily's did not incur but still charged them) and a copy of a check with our names on it for the remaining amount owed to the tenants (which we are not keeping).

I am rejecting this response because: based on the Notice to Tenant Change in Management, the company previous broker is no longer managing the property as of July 4, this is days after my lease termination and inspection with the company By Texas law my deposit has to be returned within days or a itemized list of deduction or forfeiture I turned my keys in At the end of May

I am rejecting this response because:I am rejecting this response because: As I stated in my complaint *** was notified that the documents he alleged he emailed (the one I request invoices and the last lease) were not received He never responded back to my email to state he did not email them as he previously stated but he actually mailed them If he mailed them where did he mail them to/ what address did he use? If he mailed them like he attempted to mail our remotes and keys then he intentionally mail them to an address (the property in question in which he knew we would not receive the information This goes back to my point that they are being difficult when it is not necessary The items *** listed for repair are just a few of the repairs we made from the second tenant If those are the only repairs they are tracking then something is really wrong because I have the annual roll up from our account by year for the hundreds of dollars they deducted from our account for alleged repairsIf Emily's Rental provided the original vendor receipts why would a property owner have to request them? If they are posted in the account you should be able to log in and see them I have email traffic where the invoices were requested several times in the past two weeks and they were never provided.Yes, I did decline to receive the last tenants deposit and move out sheet as they entered into a rental agreement with Emily’s Rentals so that was your job to clear them out I had a property management agreement with you so it is your job to return our property and adhere to the term and conditions of our agreement Attached is the summary sheet from and in which you can see we were charged more than the few repairs *** mentioned in his response. It also shows they have the last known address on file for us (that we provided to them) so why would they send something out to us within the last week address to the property in question? I am also attaching email correspondence I had with *** over the past week requesting the same items I requested in my original Revdex.com complaintThe response provided does not address what we deem as clarification from this company with regards to our inquiry Again I am not sure where they forwarded whatever it is they forwarded but if it is to the property address in question we will not get it because they had to go the post office yesterday to pick up the first certified package they attempted to send us because it was undeliverable (we have moved four times since we last lived at that address). If it was sent to another address I would question why did they send the first package to rental property address and they know we do not live there anymoreIt should be against the law for them to conduct themselves in this manner and call themselves a business

In the course of the time frame that the property was managed (Five + years) Ms *** completed the following repairs; Replaced carpet in room, replaced a microwave vent hood (plastic handle broke) replaced kitchen faucet (plastic connector broke) and repaired water damage under the sink &
touch up painting Ms *** has had tenants in the home in this time frame Ms *** received monthly statements and an annual statement each year Invoice details are inputed into the management software and At any time she could request a copy of any invoice Ms *** declined to receive the last tenant deposit and inventory form to close out the file with her Realtor as she felt necessary Ms *** was sent copy of the lease via email as well as a copy of the from the vendors invoices, with their contact information Her realtor has picked up the keys She is welcome to contact any vendor in reference to the jobs they completed Additionally we forwarded the a copy of this items and the balance of the deposit to her via USPS and have notified the previous tenant We have completed all items and I wish her luck in the sale of your home .*** ***

I am rejecting this response because:We do not have our $nor was the Bose System and remaining components returned to our Realtor as of email traffic on June with ***/Emily's Rentals As of the June *** was informed of what it would take to resolve this matter It was also requested for *** to stop contacting/harassing me His resolution does not require him to contact me As of May the tenant was still in the house and my Realtor did not have a key *** was suppose to transition everything on June As of June of his own admission I have it in writing that he has not transitioned everything he was suppose to transition

Ms *** claims that she has spent $1000's in repairs. and is requesting the invoices. I reviewed the statements that she uploaded and there are inconsistencies with her claim. She has a Residential Service Contract, often referred to as a "Home Warranty" thru American Home Shield. In She spent a total of $in deductibles for service calls relating to Plumbing, Appliances and Air Condition. American Home Shield paid the cost above her deductible and they will cover items that fail due to wear & tear. If the vendor assigned by American home shield feels the damage is caused by the tenant the item is not covered. Additionally she had a Bill of $for the back flow test required by the City of *** for her Irrigation system and a minor repair needed to pass the test. That was the total of her maintenance expenses for 2015 For the statement carpet was replaced in the family room for $and the microwave was replaced for $274. The microwave was not covered under thru the warranty, the plastic door handle was not covered. The basic black whirlpool was replaced with an upgraded Stainless version with a metal handleThe ***'s also paid appx $for repairs that were in excess of the departing tenants security deposit. The owner had the annual back flow test and the cost of re-keying the property for a new tenant in also. There were $in service to American Homes shield. For a property that was built in the maintenance has been relativity low for the time frame that it has been leasedThe closing out package was sent certified mail to the property address in error and when MS *** informed the office that the USPS would not forward it to her she requested a copy be made and allow her Realtor to pick it up. This request was completed the same day. We do not get invoices for any vendor contracted thru American Home ShieldDetails are input for each invoice received by vendors contracted thru the company, if an owners request a copy of an original it is sent , It is not time friendly to individually scan and attach over invoices per month, to individual property accountsAdditionally Ms *** is provided with the annual statements so that they may take all appropriate tax deductions

There is no amount due to this owner, the property was in sub standard condition when it was transferred to our company in June 2015. The owner did not provide any funds to maintain the property and the last tenant was evicted for non payment of rent . The security deposit was applied to
the eviction and bring the property ready with funds available. The previous tenant has an outstanding balance

The owners portfolio is in the process of being finalized for close out.  We expect to complete this process by 16 June.  As of today we still have not received the USPS package return that contains the GDO remotes.  Her agent has had the keys to the property since the end of May

I am rejecting this response because: The portfolio minimum has not been returned nor has the BOSE Sound System with the remote been transferred to our Realtor.   I am not aware of any USPS packages nor do I care because [redacted]/Emily’s Rentals should not have attempted to mail the items for the transition as they agreed to pass the items off to my Realtor on 1 June 2017.  The agreement was they would schedule a time for her to collect everything not for Emily’s Rentals to mail anything nor for them to keep a backup copy of anything they were transferring.  Our Realtor has had a key to the property since the end of May at our request for Marketing Assessment purposes.  That does not have anything to do with [redacted]/Emily’s Rentals not returning our portfolio minimum nor the Bose Surround System and remotes.  It also does not have anything to do with them mailing items they agreed to physically transfer.   So whatever games they are playing by sending UPSP packages to undeliverable addresses does not remove their liability for the missing items that they have not returned.

I am rejecting this response because: I have asked for the owner to call me multiple times. I have proof the landscaping was never finished when I first moved in. I have proof the handle on the refrigerator was never there when I first moved in. I have proof of our multiple phone calls to them on June 24, 2017, when we were told our move out inspection would be. I have already spoken with two other recent tenants as well and they had the same problem. I was never told the move out process was on the portal, I was told they would email it to me, and I never received one. The only reason the owner will call me now is because I went through the Revdex.com. The Business had 30 days to send me the charges as to where my deposit went, and they failed to do that.

I am rejecting this response because of the following reasons:The
owner is an active duty military officer stationed out of state and was unable
inspect the house at the time of transfer in June 2015. There was no
documentation or communication of the condition of the house in June 2015 from
Emily’s Rentals. Documentation of the “sub standard” condition has been
requested from Emily’s Rentals to the owner multiple times since April 2017 and
as yet no information has been provided. The owner has received no evidence or
documentation of a walkthrough performed by Emily’s Rentals at any point prior
to April 2017.

The property owner was given the information that was available.  Very little documenation was provided from the the previous property manager.  I am sorry that Mr [redacted] has his opinion but that is his right.  There is no further action that can be taken at this time

I can review the files and forward the move out inspection for the 2 separate tenants that had occupied in 2015-2017.  The owner was given other documents at his request but there is no ,justification of his ludicrous claim of $13000.

The property inspection was completed on the 26 June 17.  This was the the original date and time.  There are no inspections on weekends since there is only 1 person working on Saturday half day.  The maintenance and move out instructions were given at the time of lease signing...

and were posted on the tenant portal at her request.  The yard had been recently mowed but it was not edged nor was any of the landscaping maintained.  The tenant was not charged for any carpet replacement, they we charged for carpet cleaning with a pet enzyme treatment  as a requirement under the lease.  The were also charged for a medium clean, which included but wasn't limited to ceiling fans , ac filter, base boards, the range , behind the refrigerator, bath vanities, exterior patio door, and garage. It was noted that the garaged had a strong urine / pet oder and had to be bleached / power washed.  They were charged for general maintenance ;  patch and paint for nail hole scratches and marks. door stops, 9v smoke detector batteries , but the majority was for the pet damage to the door / frame and sheetrock entering the home from the garage. The tenant was also charged for the handle to be replaced on the refrigerator witch the appliance repair company indicated tenant damage.  Additionally the tenant was charged for pest control as required under their lease.  A copy of security deposit accounting statement with all of charges was sent to the tenant.  There were 46 photos of the property taken at time of inspection.  I If the tenant feels that any charge was in error I will be glad to review their request and will be glad to call them next week on the 28th or 29th.   V/r[redacted]
