RE: Case # ***
This letter is in response to the above referenced complaint
I was most concerned to receive the letter dated June 16, regarding the issues with the driveway which was done in the fall of We have been in business for more than years and we pride ourselves to consistently deliver exceptional and professional workmanship to all our customers
The following is a recap of the events that occurred:
We did in fact pour a new driveway in the fall of The cement used was 1/sack which is the appropriate cement to useThe driveway was inspected and approved by the City InspectorThe City Inspector always has the best interest of his city and the residents of his city in mind and if the City Inspector found any part of the project to be unacceptable or faulty, and this would include the consistency of the cement, he would have immediately ceased all work until the proper corrections had been made
Spreading and leveling of the cement using a wooden board is a common practice in the cement industry, the driveway was completed with a broom finish which is also a common practice in the cement industry
The pitting and flaking of cement are very common occurrences due to our winter weather in OhioIt occurs when salt that is applied throughout the winter months sits on the driveway for an extended period of timeIt can also occur when cars driven on salted city streets sit on the driveway for an extended period of timeWhen the salt sits on concrete for extended periods of time, it causes the joints to be weakenedUnfortunately, pitting, splitting and cracking are not something we have any control over; those are considered acts of godWe always advise all our customers about the importance of sealing their cement on an annual basis in order to keep the elements from deteriorating the cement
We met with the customer at the residence and also spoke to the customer on the phone on several occasionsIn all instances we reiterated that the driveway showed signs of wear and it was not due to faulty product, application or workmanshipIn addition, on all occasions, we reiterated the proper steps that would help to maintain the drivewayOn those occasions that we met at the home, it was evident that the driveway had not been sealed or maintained as advisedAnd although there was no fault with our product or workmanship, as an act of good faith, we did offer to seal her driveway
Based on the facts stated above we did take this matter very seriously and did attempt to come to a resolution on several occasions
We thank you for the opportunity to respond to this complaint
Sincerely,
Albert C***, Owner
Initial Consumer Rebuttal /* (3000, 8, 2015/07/06) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I was very discouraged at TJ Cements response dated 6/25/to my disputeTheir response contained several statementsAs I previously stated, TJ Cement poured the cement prior to the City Inspectors arrivalMy brother in law and myself were present when this happened so I do have a witnessWhen the inspector arrived, he immediately asked Mr T*** why he poured before he got here and was visibly upsetMr T*** said he got here early and decided to pour giving no concern to the inspectors right to carry out his job according to procedure, designed to protect me as the consumerAt that point there wasn't much the inspector could do and he begrudgingly signed off on the job and left frustratedI have since learned from our Building Dept that because Mr T*** had me obtain my own permit, there would be no recourse against him for a faulty job if he wasnt registered or bonded in my city to pour and am sure he was aware of thatThat is deceptionWhen the inspector left, I expressed deep concern to Mr T*** about the watery cement and he did not take my concern seriously at all and continuedI come from a family of cement finishers and I know that too much water in a bad mix of cement can cause exactly what happened to my driveway...immediate and persistent pitting, flaking and crumbling, which all began in less than a year, which is not normalMr C***'s comment on the City Inspector not finding fault with anything was inconclusiveThe inspector was not given a proper chance to do his jobFor four years my complaint was shrugged off and I was told it was the saltAs Mr C*** was leaving on the day he came out, his last words to me were "if you have $1,for an attorney, I will see you in court"I then called Mr T*** once more to see if he could do anything for me and his words to me were "since I reported his company to the Revdex.com and ruined his A+ rating, he was no longer willing to do anything for me"That was his final resolution to my problemI would like to know, as they stated in their last comment, on what occasions and what attempts they made to come to a resolutionAside from what I mentioned, I don't recall any
A number of neighbors had their driveways replaced before mine and they still look new, without yearly waterproofingSeveral of them asked what happened to my "new driveway" and have made negative comments to me so I am not the only one who sees what is going onI will be happy to provide picturesI feel my property has been devalued because of this and expect fair restitution
Sincerely,
***
