October 2, 2014Hello ***,I am writing to respond to your letter dated September 30, concerning a GMC we sold to *** ***I have read her complaint and concernsI will address my responses from the beginning of her letter on down*** *** agreed to buy the truck over the
phone so her son had a nice vehicle to useShe mentioned to us that she felt bad and she didn't feel like coming out to the dealershipWe did not tell her that if she died the truck would be paid forWe told her the truck had warranty and if something mechanical happened to the truck that it would be coveredShe never once said at that time she was illiterate and has only since mentioned that when stopping out here recentlyI tried to explain to her here that she did indeed agree to purchase the truckI also tried to explain to her that she had equal responsibility to make the payments on the truck if she was on the note herself or with her sonThe income on our credit application is what she quoted us on the phoneIt is only recently when she visited here that she said she only makes $450, $500, or $a month(She has quoted us all of those amounts,) She complained to me that we had no proof of incomeI explained to her that we only put down what customers tell usIf the bank doesn't ask for proof, we don't ask for itThe collateral is only the truckWe have nothing to do with her house as she mentioned and the bank didn't ask for a down paymentWe didn't do anything without her knowledgeWe only went to her house instead of her coming here because she asked us toWe have never refused to take her calls or sit down with her and answer questions. We have not treated her badly or done anything wrong hereShe acted responsible and fine with everything at the time of the saleOf course it appears that now she has buyer's remorse but we cannot re-purchase the truck back from her at this time.If I can be of further assistance, please call me at ###-###-####,Glenn M***, GM

Complaint: ***
I am rejecting this response because:
class="Apple-tab-span" "white-space:pre"> MrM*** of Opequon Motors must be confused about the complaint that I made The Sales Contract and all other documents provided to me by Opequon Motors relating to my purchase of a vehicle there clearly state that I was being sold a *** SRX Premium Edition vehicle In fact, they sold me a *** SRX Luxury Edition which is a less expensive vehicle In other words, I overpaid for the vehicle I took delivery of and the difference in the mid-point value of a Premium Edition and a Luxury Edition is $5,(per Kelley Blue Book) I need to be reimbursed for this amount of money as I did not take delivery of the vehicle described in the Sales Contract but rather took delivery of a vehicle which costs less than the one described in the Sales Contract I have never indicated to anyone at Opequon Motors that I was satisfied with the deal and I made it very clear to them that I had been overcharged Of course they owe me the difference between the cost of what they promised to me in the Sales Contract and what was actually delivered to me I am single and disabled and live on a fixed income, and I cannot afford to donate $5,to Opequon Motors I require a check for the above-stated amount of money to satisfy my Complaint and I will take Opequon Motors to Court if they will not amicably settle this matter with me through the Revdex.com and refund the amount of money that I was overcharged as stated above Opequon Motors has done nothing to remedy this situation Opequon Motors' "confusion" on the model has not been handled or addressed by them They have done nothing to correct the error The Sales Contract is a legal document and they did NOT deliver to me the vehicle that they promised they were selling me Kindly refer to the attachment previously provided to you in my original Complaint to see that they promised that they were selling me a Premium Edition vehicle, not the less expensive Luxury Edition vehicle It is clear that they should reimburse me for the amount they overcharged This matter is in no way resolved until I am refunded the amount of $5,
Regards,

[redacted] RebuttalInboxx [redacted]Mar 17 (9 days ago)to me As far as Ellen P[redacted] saying she was not there ,she was and maybe she should talk to Jeremy A[redacted] in what he promised to me when I bought the truck. As far as horrible profanity ,yelling obscenities ,that did not happen, getting loud did as anyone would when you spend that kind of money and you was promised that the truck would be fix when you bought it.When I bought it Jeremy said we will buff that right out  I promise well that did happen then the manger said what kind of cash will make this go away, I said I would find out , I did  it was 3,800 they said to much.31,800 was to much for me to but I pay for the truck. The paint was not oxidize from the sun it was a company logo on the doors that's why they said it would be fix . So maybe if  Ellen would have look at  that the truck instead of listen to the  manger she would have seen the problem and the windows where so bad at night you could not drive it. It should not have pass inspection that's how bad it was but it had a new inspection on it . So I had to fix them my self, so I could drive it know thanks to P[redacted] .The lest they could do is have the doors fix like they promise or cash 2,800 and they do have my phone number but they have never use it once, you would think someone that spent 31,800 would at lest get a phone call !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!                                       THANKS

Dear [redacted],Thank you for your letter concerning [redacted]. I was not present for the discussion of any adjustments for the 2006 Ram 3500 truck. This truck is a diesel model (sought after in this area). To my knowledge it is in fine running...

condition. The red paint, about which he complained, on a 2006 truck or car will oxidize over the period of time and I feel the purchase price allowed for that. Mr. Gump's estimates for repairs were excessive, and the manager and I felt we could not possibly reimburse him for the amount he wanted. We did, however, offer to have the spots cleaned off the windows at our expense, though I did not examine the windows in person. In addition my manager and I would have felt much more obliged to help these folks if they had acted in a reasonable manner. They treated us horribly, using profanity, yelling obscenities, and being extremely rude and obnoxious. Customers in the showroom heard them and one such customer commented to one of my employees (after they left) indicating that they knew the Gump's. These folks threatened us to tell everyone about this incident. They weren't happy when we offered to fix their truck the first time. They instead demanded a check made out to them personally. We believe it probably would not have been used for this truck and could have been used elsewhere. There was some time involved in dealing with this matter. It was during the Thanksgiving and Christmas holidays. If you have any questions, please contact me.Sincerely yours,Ellen .P President

Review: I am on oxygen and it's hard for me to go out so I gave permission for 2 sales people to come to my apartment so I could co-sign for a truck for my son who does not live with me. They told me it would be $28,000. The female salesperson said if I died the truck would be paid for. When I asked she said I didn't have to worry about anything. I am illiterate and have poor vision. My sister is filling out this form for me. I am on disability with income of $597.00/month. The sales people told me I was co-signing for this truck. I found out I own this truck when I received a bill stating I owe $629 due on 9-21-14 to ** Auto Finance P.O. Box [redacted] MI [redacted], customer service ###-###-####. I went to the office to get the paperwork for this sale because I had none. They listed $2700.00 as income but there was no proof of income paperwork with it. My name is the only name on the contract that says I owe $41,514.00 in 66 pymts at 6.49% interest. Insurance was put on truck in my name. No life insurance was on the contract. There was no down payment and does not list any collateral but I am afraid that somehow they might have used the house that I co-own with my former husband who is also on disability and just getting out of hospital because of heart problems. I am afraid because they have done all of this without my knowledge. I asked them how they could sell a truck to someone whose income doesn't qualify to pay for it and told them it was not right what they did. They said "we have work to do" and walked out of the office leaving me sitting there. As soon as I found out on 9-20-14 that I was responsible I went after the truck and looked at it for the first time. I have hidden the truck away from my son so they cannot drive it anymore. I have made two trips to Opequon Motors and spoke with Glenn Murphy. I called but they won't take my calls anymore. I also called the finance company. I can't remember the dates but talked to Renodda at ###-###-####, Tracie at ###-###-#### on 9-24-14, Cindy B[redacted] at ###-###-####. They said they would take the truck back and I would probably owe $17000.00. I am presently waiting for that paperwork because I feel have no other option after talking with lawyers and my reliable car dealer.Desired Settlement: I would like Opequon Motors to take this truck back without any cost to me because they deceived me in what I would call a fraudulent sale.

Response:

October 2, 2014Hello [redacted],I am writing to respond to your letter dated September 30, 2014 concerning a GMC we sold to [redacted]. I have read her complaint and concerns. I will address my responses from the beginning of her letter on down. [redacted] agreed to buy the truck over the phone so her son had a nice vehicle to use. She mentioned to us that she felt bad and she didn't feel like coming out to the dealership. We did not tell her that if she died the truck would be paid for. We told her the truck had warranty and if something mechanical happened to the truck that it would be covered. She never once said at that time she was illiterate and has only since mentioned that when stopping out here recently. I tried to explain to her here that she did indeed agree to purchase the truck. I also tried to explain to her that she had equal responsibility to make the payments on the truck if she was on the note herself or with her son. The income on our credit application is what she quoted us on the phone. It is only recently when she visited here that she said she only makes $450, $500, or $597 a month. (She has quoted us all of those amounts,) She complained to me that we had no proof of income. I explained to her that we only put down what customers tell us. If the bank doesn't ask for proof, we don't ask for it. The collateral is only the truck. We have nothing to do with her house as she mentioned and the bank didn't ask for a down payment. We didn't do anything without her knowledge. We only went to her house instead of her coming here because she asked us to. We have never refused to take her calls or sit down with her and answer questions. We have not treated her badly or done anything wrong here. She acted responsible and fine with everything at the time of the sale. Of course it appears that now she has buyer's remorse but we cannot re-purchase the truck back from her at this time.If I can be of further assistance, please call me at ###-###-####,Glenn M[redacted], GM
