I just spoke with *** LED and they are not aware of the sign not workingThey do not have a truble ticket on anything and the last one they have has been closed out as "completed"If the customer is not willing to open trouble tickets when something isn't working, there is nothing we can do to assist.There is not implied warranty The "contract" that he is speaking of is a purchase agreement for the parts of the sign, which have been delivered and installed completely Any service issues must be directed to the company that supplies the monthly service, *** LED.There is no contract between either Optimum Signs nor the customer, it was a purchase agreement of which the terms of the agreement have been completed

Optimum Signs was contracted to supply a custom made monument sign with a full color LED message board, which we did The continuing service and warranty on the LED message boards is the responsibility of *** LEDOptimum Signs does not provide continuing service on these boards We
are not the provider of the monthly cloud service nor are we a warranty provider for the LED boardsThere is nothing wrong with the monument or the LED message boards Any problem that has occurred with the programming of the LED message board a trouble ticket should be opened with the company that supports the LED message board In the past, *** has responded and made the necessary corrections *** went to the extreme of offering to create all of the slides that the church wanted to help *** offered to spend almost as much time as needed to train someone from the church on how to create slides and to maximize the performance of the LED boardsOptimum Signs went to the extreme of replacing boards and the brain box at no charge to help make the customer happy We even paid for the electrician to replace the brain box so it wouldn't inconvenience the churchFrom the date of install, our customer has tried to argue for a more expensive message board (16mm)If there was a problem with a board, he asked that we replace the entire sign when all that was needed was to replace a single component When we replaced the brainbox, they asked us to upgrade the sign because they thought that they were owed it for the inconvenience. If there are service issues with the hardscape sign, and as of today I have not been made aware of any, we would be all too happy to assist If there is an issue with the programming or the contiuing service provided by *** LED the customer needs to direct their request to ***

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[To assist us in bringing this matter to a close, we would like to know your view on the matter.]As we expressed in our initial complaint, our contract is with not with [redacted] but with Optimum. There is nothing in our contract with Optimum that is expressed that [redacted] is responsible for the warranty. Thus, it is implied that the warranty of the sign and the LED’s is the reasonability of Optimum signs. Please find attached a copy of the signed contract with Optimum, you will see from this contract that there is nothing stated that [redacted] would be responsible for any part of the warranty. You will also find two attached copies of emails from just the last few weeks when optimum is working to fix the issue, and get the LED’s replaced. Second you will see that they have worked out for the LED’s to be Returned to the manufacturer. The problem becomes then that when the LED’s are pulled because of the way Optimum designed the sign no other LED boards will fit without losing more than half of the space we have for LED’s. Also, the Monument manufacturer has said that the monument would have to be rebuilt due to the change. This is when Optimum changed their stance and completely back out and pushed us to [redacted].  We have all the emails and the video and pictures to show that the sign is now working correctly. This is only a few of them, we are willing to provide more.

Again, our contract is not with [redacted] but with Optimum Signs. We have even sat down with legal counsel from our denominational Headquarters to have them review the contract. As stated before, the contract does not express that the warranty is through anyone else, so per what our legal counsel has said it is an implied warranty that is the responsibility of the main contractor Optimum signs.  As to the issues we are still having Optimum is aware of all of them and even referred to them in emails on April 21, April 18, and March 27 where Optimum tells [redacted] we are threatening legal action when we were not, but you can see a list of issues there as well. Only one of these to date has been resolved, and that was the scheduling issue, the rest are still outstanding and have not been resolved and Optimum is aware of that. To date neither Optimum or [redacted] have been able to resolve or explain why all the issues are happening.Optimum has been aware of these issues, we have not reached out to anyone once we started this to wait and see what resolution would happen, or if we would need to proceed to legal action. We are attempting to resolve this before we have to go to that step.Optimum says it’s not a contract but in their response on May 1, 2017 they state “Optimum Signs was contracted to supply a custom made monument sign with a full color LED message board”. This is a contract that was drawn up by Optimum signs, A copy of the contract was provided in our second response. You will notice in the contract that it does say “Custom product & Services for both the monument and the LED system.As you will see from the emails provided in the past response Optimum was working to resolve the issues and to replace the LED system. As was stated already they changed their stance once they realized that because of the design they created they would have to replace the whole sign to fix the issue.As of today (May 4, 2017) we were informed by the city permit office that Optimum never applied for the revised permit for the new monument design by providing the updated drawings. We did forward this email to them in hopes they would correct this. This is the only contact that we have had with them since we filed this complaint.
