Option Property

Review: On 4/9/14 I read two online adds for the property lease option. I called and Option Property, [redacted] (BRE #[redacted]) called back and made a appointment. I met [redacted] on 4/10 @ 5:45. My wife had to come later. We Jointly met him 4/11 @ 11:30. We asked about the owner taking care of repairs. He stated he's managed the property from day 1 and the owner paid cash for this and other properties so there was no mortgage and very quickly take care of all repairs. On the walk thru we noted and [redacted] agreed to a repair a number of items prior to us moving in. Having the house cleaned, Fixing Kitchen Sink, Master Bath tub leak, Garage Floor cleaned (Oil), Lawn & shrubs trimmed, Pest control, Kitchen sink stopped up. Based on his representations we moved forward. On 4/11 we gave him a $1,000 deposit. We filled out an application he said the owners approved & accepted and He prepared the Residential Purchase Agreement, Residential Lease for (18 months)and Lease Option to Purchase, documents on 4/12 and would have the home cleaned. On 4/13 we received and electronically signed the Purchase & Lease Option agreements. On4/14, my wife met [redacted] and gave him certified funds of $4,274.50 and received keys. He stated he had an appointment with the owners and would get the owners signature and return our executed copy in a day. AS of today we are still waiting and have never received a fully executed agreement. He has made many many promised to take care or stated the owner would do the repairs. None are completed. We have had to chase & call him. He never performed. After 2 months we ask to cancel, receive our funds and move. He promised he would and did agree. He then said the owner would do it! He hides in his office and has now disappeared and will not return calls, emails or text. We moved into this home to buy it not rent. He misrepresented he had our executed contract, lied about the property and deceived us.He misrepresented material fact and has taken our funds and left.Desired Settlement: We solely moved into the home due to his representation he had approved & accepted terms and contract by the seller/owner and that he has worked with this seller numerous times previously. We want a full refund of the $4,274.50 Lease Option fee, $1,000 in other payments and $$3,220.00 in rents, $3,575.00 in moving expenses and $785.00 in repairs.
