The contract for this work was originally issued in October 2015, and the work was scheduled for 4th quarter thru 1st quarter The specifications for the work included instructions to install materials not allowed for that application per Louisiana Building Code For over months we struggled to get the Owner to agree to allow us to use the proper materials for the project This is a typical Federal project that is using specifications and products that are 10-15+ years out of date And even with that, the materials they wanted used have never been designed or intended for use in this particular application Finally, we sent notice to the owner that we wanted to terminate the contract since they wanted us to install a non-code compliant roof At that point, the owner changed their mind and decided to allow us to use the proper materials However, by that time, our summer work schedule had begun I advised the owner that we would start the work as soon as possible, but due to the delays caused by the owner we may not have manpower available to complete the work within the original timeframe that was anticipated when we had the work scheduled for over the winter, which is our slow season I also advised the owner that I would not pull workers away from projects that had been previously scheduled, as those project did not deserve to suffer due to this Owner's failure to provide a proper and viable set of specifications for this work, or negotiate a viable solution in a timely and good faith mannerAdditionally, there have been major storm events that have directly impacted our offices in other cities that have caused a surge in demand for our workers, and the floods in Baton Rouge have drained the local labor pool The work is currently in progress and we hope to complete it over the next couple of months However, none of this situation is CMR's responsibility as there was no way that we would install a roof system that didn't meet code, and it should not have taken months for the owner to realize that they needed to revise their specificationsThere are additional relevant facts regarding delay of the project due to other contractors, etc, but I believe the circumstances described above are sufficient to explain our situation and why this project has proceeded in the manner it has
