Initial Business Response /* (1000, 5, 2015/11/16) */
This driveway is a resurface and as is stated in the customers warranty, there is no warranty against crackingthis driveway is very narrow and it appears that someone may have driven off the edge causing some of the crackingThat being
said, we have sent someone out to crack fill the larger cracks

Initial Business Response /* (1000, 5, 2015/09/10) */
After receiving this complaint on Thursday 9/3/I went to this residence to look at the drivewayEven though it is out of warranty by years I was concerned that the customer stated that it was dangerous for his son to play basketballI
saw nothing that would be dangerousThe driveway was installed in August for a price of $7,not $6,as the homeowner statedHe actually paid by check $7,and we reimbursed him $overpayment in The driveway has some scaling of the surface most likely from salt dripping from cars parked on it in the winterthere is also some minor cracking, again most likely caused by the harshness of the last two wintersThis customer has a warranty that is signed by him clearly spelling out these thingsI took numerous pictures showing that this is a fine job with no dangerous situation that I could seeI'm not sure who told him that our crews were laid off for the winter in October as that has never been the caseI think the driveway is in good condition considering that it is years old and has gone through of the worst winters in Ohio history
Initial Consumer Rebuttal /* (3000, 7, 2015/09/20) */
(The consumer indicated he/she DID NOT accept the response from the business.)
My online bank statements do not go back to that date, so I didn't want to overstate the dollar amountI am glad Tallmadge had the correct, higher amountThe attached photo (with shoe) shows a large missing chunk near the hoop that is quite dangerous to run and jump onThe bad scaling and actually major not minor cracking -- again, their inspection missed a foot long, 1" to 1/4" wide split portion where the slabs have separated from themselves almost completely and will result in water penetrating and freezing/thawing underneath slabs-- attributed to salt and harsh winters is nowhere to be found on neighbors' drives which have been done the same year as mine or beforeI am well aware of the signed warrantyAs I stated, I began contacting the company less than one year after completion because of missing chunks, only to be completely and repeatedly delayed and put off by their salesman Mike D***And it baffles me why the company would say they are not sure who told me about the crews being laid off, because again, as I stated, it was their salesman Mike D***Whether they actually lay off for the winter or not is not the issue, it is that he told me they didHe put me off numerous times and would not answer or return calls and emailsFor Tallmadge to state the driveway is in fine condition is simply not accurate to say the leastOne need only compare to similarly poured drives near mine to see that is clearly not the caseIt's very difficult to have this conversation without an impartial third party (as I had a concrete consultant come out to evaluate the drive and tell me it could not be repaired, before I lodged this complaint) to actually view the damage and see for themselvesAll I can apparently do is let others know of the extremely poor quality and customer service provided by the company

I'm not sure what else to say about this drivewayI have pictures from my September 3rdvisit showing no missing chunks of concreteThis driveway is out of warranty but is still in good shape

to me
In response to Case #*** which is a complaint by Mr***Once we pour a
concrete driveway and debris from trees falls on the wet concrete, there is no way for us to get back on the driveway to remove themThis does happen from time to time and would be considered an act of God
Cracks in the concrete that are 1/inch or wider are under warrantyHairline cracks are not covered by warranty
Neither of these issues should effect the integrity of the driveway
Sincerely

Initial Consumer Rebuttal /* (3000, 7, 2015/08/20) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Additional cracks are forming along side the original cracks and there are sections where the concrete will break outIn addition, the concrete is beginning to raise on one side of the cracks in comparison to the otherThis is not an act of GOD! I have had other contractors look at this and they have indicated that because of the junk in the concrete and the cracks that are forming the driveway should be replacedThe depressions left by the leaves are 1/inch deep in some placesThe cracks are wideningTo blame shoddy workmanship on God is unacceptableNo one ever mentioned that there would be leaves in the concrete even though I'm sure they knew itAt one point over the winter, the driveway heaved up inches above the garage floorIt did go down in the spring but I was still shockedSomething is not right with the concrete and it needs to be fixed
Final Business Response /* (4000, 9, 2015/09/03) */
There is no way we could have known that there would be leaves or sticks falling from his trees onto the wet concrete driveway! Hairline cracks are not under warranty as it is common for them to occur from time to timeWe had an exceptionally harsh winter and a lot of driveways heaved inches or more and then settled back down in the springMy own driveway that was installed years ago did thisThere is nothing we can do to prevent this as it is a "force of nature" as is spelled out in the warranty that Mr*** signedAgain, we feel that this driveway is a good installation and nothing that Tallmadge Asphalt did or did not do is responsible for the debris falling from trees

I have enclosed the letter that I received from Ms*** on November 2, I have also enclosed a copy of the contract that she signed and two pictures of her driveway before it was resurfaced. I called Ms *** the day that I received her letter, prior to that, I was unaware of a
problem. Unfortunately, John, (her salesman) has been very seriously ill. I explained to Ms*** that as soon as John was able to return to work, I would have him contact her regarding her concerns. John is back on a part time basis at this point and he will be contacting her within the next few days. As is clearly stated on her contract, there is no guarantee against reflective cracking. This will normally occur on a resurfaced driveway. It really has nothing to do with driving on it or not. As you can see in the pictures, there was a large crack in the existing driveway and that is what has re-appearedEven though there is no warranty on this, we did send a crew out to crackseal the crack that formed. Charlie did not do the cracksealing. He is a salesman, we have separate crews that actually do the work so they, nor the sealcoating crew that worked across the street, could answer her questions. I’m not sure who she talked to or met on October 18th.Ms *** paid for a resurfaced driveway. A total tear out and replacement would have cost her several thousands of dollars more. John will be in contact with Ms*** in the next few days and hopefully can address her concerns

Revdex.com received phone call from business
The business feels the consumer is being untruthfulTo begin with, the business did pour a driveway for himDriveways are COD and his check bouncedAfter numerous phone calls, they finally got a
check that clearedThen a week or so later, they got a phone call that a corner of the consumer's driveway had crackedIt was obvious that a vehicle had driven off the edge of it prior to it curingAt first, the consumer claimed to not know what had happenedThen he said, he saw an employee of the business drive off of it when the employee came back the next day to saw cut itThe business had denied responsibility for the repair because they did not damage the driveway; so the consumer hired a company, ***, to perform the repairMr*** told Mr*** that he (Mr***) had driven off the driveway during earlier landscaping*** related this information to Tallmadge Asphalt's business owner
The 4xpad the the consumer claims the business was to install: the consumer asked the business' salesmen to tear out the areaWhen the salesmen asked if it was to be replace, the consumer said noBill asked what he was going to do thereThe consumer answered that he didn't know, but he would plant something there laterTherefore, the pad was not included in the contracted work

Initial Business Response /* (1000, 8, 2015/10/06) */
Mr.[redacted] called to complain about his sealer work that we had performed. I went to his house the same day to look at the job. I did find that we had sealcoated over some debris on his driveway. The edge by his house was done as I would have...

expected. The sealer is within 1/4 inch of his foundation wall which is normal. Our technician noticed some black material on his foundation wall and called his supervisor before sealing the driveway. He took pictures of it to prove that it was on the wall before we sealcoated. As Mr.[redacted] stated, the foundation is 3 to 4 feet from the walkway that we did seal. It would not make sense that we got the sealer on his wall. The sidewalk that is in question leads to and continues underneath a deck that was obviously built over top of it. We cannot sealcoat under the deck as that would require our man to crawl under the deck with equipment. That is just unreasonable. Our man did the best he could by sealing up to the deck and under the bottom step which is how some sealer got on the deck step and post. I did have him return and clean the sealer off of the step and post at the same time he touched up the debris in the driveway. Mr[redacted] complained again about the sealer not being up close enough to the basement wall. I took another supervisor with me to look at the job again just in case I missed something the first time. Upon second inspection, we found that all cracks were filled properly and the sealcoating job was done quite well. Mr.[redacted] has still to date not paid for the job.

Initial Business Response /* (1000, 6, 2015/06/16) */
Revdex.com had phone conversation with business.
The business has contacted the consumer and they go out and repair the consumer's sealcoating.

I am rejecting this response because:November 15, 2017I did send a letter to the owner, and she responded with a phone call a week to 10 days ago.  She did say John H[redacted] would call and come out to look at the problem again. John H[redacted] and Todd did come out this morning (7-15-17).   I explained to John H[redacted] and his supervisor, Todd, that while I understand that the driveway was a re-surface and cracks will appear:  a) I did not expect such a severe crack within a month after re-surfacing; and b) No one returned my calls for more than 3 weeks after my inquiries.  The owner told me on the phone that John H[redacted], my salesman, was sick.  While I appreciate and understand John was ill and unable to respond, there is simply NO reason that someone else couldn't call me back for three weeks.  In my opinion, Tallmadge exploited someone's illness for a reason for not calling me back.  This is unacceptable.  Imagine my feelings after seeing the cracks so soon after the re-surface and then NO ONE responding for three weeks.  I spent over $6,000 for this repair.  I did have a chance to speak with Todd and John this morning.  They understood my disappointment and apologized.  I let it be known to them that I would not have Tallmadge come out in the Spring of 2018 to seal the driveway.  I will not deal with a company whose customer service is so poor.  I do not blame John H[redacted] for this poor customer service.  I blame Todd and Tallmadge Asphalt.
