Review: This store has done nothing but give me the runaround sine day 1.1.Demo Not on time2.Cabinet install 1 week later. Cabinets were incomplete and it took them 5 days to complete. Hinges werent installed correctly and the corer cabinet hinge just hung there. I had to pay my handyman to repair.3.Cabinet shelf was damaged. I had to take into shop to show. I still have not received the replacement shelf4.I was without any counter sub tops for over 6 weeks, making my kitchen completely useless.5.Granite fabrication was done on-site at my Townhouse while I was out of town on business. The toxic dust went everywhere, upsetting all my neighbors with the dirt and noise. My neighbor had to take his wife to the dr. due to the dust and her breathing condition. His A/C system was also filled with dust and had to be serviced. I received a seize and desist order from the HOA.6.OC Kitchen did come over and saw the mess. They did not have a solution, so I had to hire a cleaning crew and rent a power washer to clean up the mess. It took over 2 weeks to get me reimbursed.7.The granite was not cut correctly. There is a hole by the kitchen sink that was filled only with epoxy. The side by the refrigerator was cut incorrectly and caused damage to my brand new refrigerator. 8.I have had to make several trips to OC Kitchen and Cabinets shop, as they wont come to me. All I get is excuses, the runaround and non-responses. On 11/16 I went in, listed my complaints and asked that they provide a resolution. I have not heard anything back from them.Desired Settlement: 1.Repair of damaged granite - Properly fill hole, seal circular bar area and properly trim refrigerator side of granite.2.Replace damaged shelf3.Discount job by 5% for all inconveniences

Dear Sir/Madam, please note that we delivered and installed the

material per our mutual contract and agreement.

The nature of any construction job is dust and Mr. [redacted] did not like

to accept that fact! He requested a $180 refund for the presence of

dust for his granite installation!

Since we have good customer service policy, we accommodated Mr.

[redacted]'s request any way.

MY staff and l have been trying to reach Mr. [redacted] for two weeks since

the beginning of January 2014 to address his concerns and we were

ignored completely!

Finally, after two weeks, he answered his phone on January 13th, 2014

and I asked him to fax me the list of his concerns and we will take

care of them as soon as possible.

We have warranty on all of our jobs and customer service is our

number one policy.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Upon review of the response from O.C. Kitchen and

Flooring, let me reiterate the degree to which this company has breached their

duties. Let me start with the

introductory sentence O.C. Kitchen & Flooring (O.C.K.F.) began with stating

that this job was “delivered and installed the material per our contract and

agreement.” This contract was signed on

9/23 for demolition and remodeling of my kitchen with new Granite countertops

and on 9/25 a contract was signed for new kitchen cabinets. The agreement was that the job was to

begin on Monday, Oct. 14th, 2013.

The first breach was that the company did not begin the job until

Wednesday, Oct. 16th, two days after their promised start date,

which in turn pushed the cabinet guy out as well. I had several conversations and “agreements”

with O.C.K.F., prior to starting this job, regarding the fact that I am a

traveling regional sales manager and am out of town on a weekly basis. They were aware of my work schedule; hence,

the time we discussed and arranged for the performance of this contract was

critical for me as they were aware that I had to pay someone to be at my home

to let them into my gated community of Cancun Racquet Club that embodies very

strict CC&R’s. Not starting on the

agreed upon date changed the arrangement I had made to accommodate the

agreement we had, which in turn, caused me extra problems.

The second paragraph, O.C.K.F. states that Mr. [redacted]

“did not like” the dust that is the “nature of any construction job.” Upon meeting and discussing this job with

O.C.K.F., at no time did they inform me that they would be setting up a milling

and construction shop on site, directly outside my garage door, within the

compounds of a very exclusive, private homeowners association neighborhood. This HAO has very strict CC&R’s and had

they mentioned this fact to me, I would have never agreed to this, nor would it

have been allowed by the HOA. These

strict CC&R’s can be evidenced by a ‘cease and desist’ letter they sent me

on Friday, November 1, 2013, at 5:03pm after several neighbors complained about

the construction site, the mess, and the excessive cutting, grinding and

fabrication of the granite countertops happening in the front of my garage. I

was not present at my home as I was out-of-state conducting my job. Please

refer to the attached cease and desist letter.

The neighbors have complained about the excessive dust getting into

their ventilation system causing medical problems for them. This too can be evidence by the receipts of

the next door neighbor not only having to admit his wife to their doctor, but,

also having his air conditioned serviced and cleaned out from the excessive

dust entering their home. At no point did I agree to this, nor would I be

allowed to have a construction site on the common area of this property. All past remodeling jobs I have undergone,

the construction of the pieces needed were always fabricated at the place of

business contracting the job. I

understand that this job, after hiring them, was subcontracted out to third

parties. I understand that a delegation

of duties is a viable option for independent contractors, but this construction

site on my property was never agreed upon nor discussed. Moreover, I repeatedly asked to see their

contractors license and was only reassured that they had one, but was never

shown one. When I speak of the dust and

mess that was a problem, I have photographs that show the debris of cutting

granite going 3 houses down onto neighboring properties. I have photographs

that show the bottom floor of my home completely covered in dust. I had discussed this with [redacted] several times

and [redacted] did not understand why I was “making such a big deal out of

this.” After several phone calls and two

separate visits on the same day, Fri, Nov. 1, 2013, [redacted] finally agreed to

come by after work to view the disaster shown in the photographs. At that point [redacted] conceded to the mess and

that he would in fact have a cleaning crew come over and address the mess. However, he did not have a crew, nor anyone

available to him to service this situation.

He informed me that he may be able to get it cleaned up at some point

the following week. Cancun Racquet Club

was not in a position to wait for [redacted] to solve the problem, so I mentioned to

[redacted] that I may able to get my cleaning lady to come over and facilitate the

cleaning process, which she did do at a cost of $180, employing three people

for three hours. I paid this amount out

of my pocket. [redacted] speaks of her “good

customer service” and how they “accommodated Mr. [redacted]’s request anyway”, yet

O.C.K.F. took two weeks to reimburse me for my out-of-pocket expense to fix

their negligent hiring. This is what she

considers “good customer service?”

In [redacted]’s, O.C.K.F’s, 4th paragraph she

states that the company has been “trying to reach Mr. [redacted] for two weeks since

the beginning of January 2014.” This is

odd for her to say considering I have made multiple attempts to mitigate their

damages caused in my home, all to no avail for an entire 6 weeks. From 10/16 to the day after I filed the

complaint with the Revdex.com, California State Contractors Board

and with the finance company, GE Capital, only then did I hear from [redacted] and

O.C.K.F. So for her to suddenly accuse

me of “ignoring them completely” [sic], I find that not only offensive, but an

outright lie. My last attempt to

mitigate with this company was on 11-16-2013 when I handed them a list of all

the problems of their negligent job performance. At that time, I could no longer take my

valuable time from my work schedule and chase this company around. As mentioned earlier, I am a traveling

regional sales manager and I have great responsibilities to manage in my own

business life. This company took no

interest in aiding their negligent job performance until I contacted all three

prior mentioned entities. For the most

part, I was out of town as my job requires me to be.

Moreover, [redacted] mentions in her 5th

paragraph to fax her a list of my concerns and that she would “take care of

them as soon as possible.” This is odd

to me since I personally dropped off this exact list of on November 16th,

which she and O.C.K.F. had in their possession for over 2 months. Naturally this list didn’t mean anything

until I contacted The Revdex.com and then suddenly she seems

concerned.

Further, let me take a moment to reiterate the

damage that was done to my brand new KitchenAide stainless steel counter depth

refrigerator. I have a receipt to

evidence the purchase and the damage done to it. Part of the negligent work that was done

regarding the granite countertop was along the left side of the kitchen. When the subcontractor cut the piece of

granite, he cut it by hand, this created a bowed type of edge. Meaning, it was not a straight line. It was semi curved. Hence, when they pushed my brand new,

$2,500-3,000 refrigerator into the spot it was to go, the bowed granite cut scratched

the entire left side of the fridge.

Further, due to the bowed cut of the granite, the fridge will not sit

flush against the wall. Please refer to

the pictures sent to verify this.

Moreover, among the list of negligent fabrications

of this granite, please note the picture of the granite backsplash that is

missing an entire 1’x1’ section of granite.

I find it incomprehensible to pay $5,000 to purchase a brand new

countertop and backsplash to only have it missing an entire square inch of

granite. [redacted] responded to me with, “why

you only telling me this now?” As

mentioned supra, I am out of town the majority of the time, hence, when I did

get home and did notice it, I called him as soon as I noticed. His solution was to fill the hole with epoxy

and then when they came back, two months later, with another attempt to fix it,

they simply smeared caulk over the missing granite area. This is not what I paid $5,000 for.

Please refer to my list of 10 bullet points referring

to their negligence.

The corner cabinet was missing the top hinge causing the door to hang

loosely and non-operative. The molding

for the cabinet above the fridge is not flush with the ceiling, the molding on

the left edge, the outer edge, was not even attached properly and hanging

loosely, attached at one corner, ready to fall off.

The use of the kitchen was suspended from 10/16 to

11/16 with no running water, no countertop, no kitchen appliances, no use of

the kitchen whatsoever. To be without

running water and the ability to cook any food for a month is ridiculous. I have been inconvenienced beyond what is

reasonable for a remodel job.

The fact that [redacted] and O.C.K.F. has responded to

the Revdex.com in a way that portrays me as the negligent one is

beyond comprehension. [redacted] and O.C.K.F.

have shown no concern to all my pleadings and attempts to reconcile this

abomination of a remodel job until I have contacted The Revdex.com. I find this behavior highly offensive and I

will be seeking consequential and general damages if this negligence in

workmanship is not rectified.
