Review: I purchased a Master Spas Twilight Series 7.2 hot tub from Orange County Pools and Spas in Middletown, NY in May 2013. Since then, I have had nothing but trouble. The primary issue is what is called “thermal creep”. Thermal creep, I have discovered, is when the hot tub’s water temperature continues to rise, while in use, above the temperature that the tub’s thermostat is set to maintain. In the case of this tub, the water temperature will continue to rise by 1 degree every 15 minutes for the time that is in use. For instance, the outside temperature the other night was 60 degrees and the hot tub’s thermostat was set to maintain a water temperature of 97 degrees. After 50 minutes of use the water temperature was 100 degrees and continues to rise an additional degree every 15 additional of use until turned off. The Orange County Spools and Spas Service Technician came to our house and ran the tub, observed the temperature rise himself, acknowledged that this problem was occurring and stated that it was not normal for the hot tub to operate in this manner. In an attempt to address this acknowledged problem, the Orange County Spools and Spas Service Technician returned to our home several times and replaced the mother board, control panel and both pumps. It should also be noted that one of the pumps was already failing at this point (leaking water about a month after purchase) at the time and needed to be replaced anyway. None of these actions rectified the thermal creep problem. [redacted], from the Orange County Pools and Spas Service Department, also told us that he ran the same model in his store for 2 continuous hours and the water temperature only rose 1 degree and agreed that our tub was not operating as it should. The Orange County Spools and Spas Service Technician did acknowledge that the excess heat was being generated by the friction of the pumps themselves and that the tub has no mechanism for cooling itself off. I have serious health issues, including Lupus and Fibromyalgia. My only son was also recently killed in action in Afghanistan. The hot tub provides a measure of relief from my physical pain and stress, but if I can’t stay in the tub for more than 15 minutes at a time, it makes the tub useless to me and pointless to have. I paid $10,000 for this tub and I should be able to use it. All of my friends who have hot tubs and all of my online research indicate that this degree of thermal creep is not normal operation for a hot tub and should not be occurring. Orange County Pools and Spas’ final offer to us was to charge us $400.00 to come and pick it up, sell it in their show room as a used tub and whatever price it sold for would be paid to us. This is a new hot tub! This tub is under still under standard warranty, we paid for an extended warranty and the problems began- and Orange County Pools and Spas was notified- within 2 weeks of the tub’s installation in our home. This is not how you stand behind the purchase of a new- and expensive- product. After we had exhausted all attempts to correct the problem, we requested that Orange County Spools and Spas take the hot tub back and refund our money. We were then told by the Orange County Pools and Spas Service Technician – who originally acknowledged the problem because he observed it himself during his first home service call- that we shouldn’t run the tub for more than 15 minutes at a time and that we should add cold water if the temperature rises. Neither of these solutions are expressed in the hot tub’s owner’s manual, nor does the manual state that it is normal for the tub’s water temperature to continue to rise. We talked to the Service Department at Orange County Pools and Spas and to Customer Service at Master Spas, the tub’s manufacturer. Each pointed the finger at each other in regard to approving a refund. We have sent numerous e-mails to Orange County Pools and Spas regarding this issue and they have not responded. They did reply to our e-mails promptly prior to our purchase of the hot tub, though. They did finally answer us through Orange County Pools and Spas Face Book page and stated that this was normal operation for this hot tub and that a refund would not be approved. We advised them that they are leaving us no further recourse and that we would be consulting an attorney and contacting the Revdex.com. We also told them that we were considering posting the details of our ordeal to online consumer websites, so that others would not have to go through what we went through. The person on the Orange County Pools and Spas Face Book page then made a veiled threat by stating “beware that all slander issues will be pursued”. I asked several times who I was speaking to and that person ignored the question and refused to identify himself/herself. So now, I have a $10,000 hot tub that is only 3 months old, that I cannot use, cannot be repaired, cannot get a refund for and a veiled threat from an unidentified person at Orange County Pools and Spas to pursue legal action against us for “slander” if we tell our story (we did save and print the Face Book exchange). This is not good faith business. Instead of providing the relief from my illnesses that I thought it would be, it is causing additional stress and possible financial hardship. If you are reading this, please avoid making the same mistake that we made by purchasing a Master Spas hot tub from Orange County Pools and Spas in Middletown, NY.Desired Settlement: at this point we want a refund.

Initially, we take exception to Ms. [redacted]'s claim that we did not respond to her emails. Attached hereto as Exhibit C are copies of all

emails and responses, A review of those emails clearly and unequivocally shows that at no time did any employee of Orange County

Pools & Spas "threaten" her with legal action, In fact, she was told she had a right to post anything she wished and that we had the

right to respond. The only l'efei·onco to legal action came from her'.

With respect to hel' complaints about the fonotioning of the spa, these emails also demonstrate that we promptly

addressed her complaints, Our service technician went to her home on several different occaslons in an attempt

to remedy her complaints, She admits that we replaced a leaking pump, a computer motherboard, and other parts in order

to address her issues with this spa. As seen in Exhibit A, our repair technician did advise her that the condition she described

was abnormal when he first was told of the problem. If the spa is operated as directed in the owner's

Manuel, and this problem occurs, it is, indeed, abnormal. However, when he also learned that she had been running the pumps

for an hour or longer at high speed, he also told her the friction caused by running the pumps for that length of time would cause

the water temperature to rise by a few degrees. Admittedly, that is the condition that she is complaining about. The basic problem

she Is experiencing is called thermal creep. This occui·s when the pumps are mn for a long period of

time, in her case, as she admits, over two hours, at high speed.

Exhibit B is an email from [redacted], Customer Service Supervisor from Master Spas, Inc" the manufacturer of this particular

hot tub. Mr. [redacted] notes that the owner's manual recommends 20 minutes of high speed usage of the pumps.

He also notes that whet1 the pumps are am at low speeds, "the temperature rise is much less and will not affect the spa water temperature

as significantly as using the high speed." Apparently, Ms. [redacted] is simply not following the owner's manual

and is interpreting both the written mid oral instructions in such a way as to indicate thank she should only use the spa for 15 minutes at a time.

That is simply not the case. Running the pumps at high speeds for extended periods of time is the cause of her issue wlth the water temperature. There is no indication that she ever tried to comply with the ownel"s manval by lowering the pump speed after 20 minutesso. And at no time was she told she could only use the spa for 15 or 20 minutes.

Ms. [redacted] is seeking a full refund for product that is not defective, Orange country pools and spas wells and services master spas. We do not nrovide a

manufacturer's warranty since we are not the manufacturer.

We have repeatedly tried to address Ms. [redacted]'s concerns. We do not sell used spas as a matter of courne.. In orde(' to try

to accommodate Ms. [redacted]'s concerns, we offered to remove her spa at the cost of $400, place it in our showroom and attempt

to sell it as a used spa. The proceeds of any sale would be given to Ms. [redacted]. She has rejected this offer and continues to insist

on a full refund for a spa that is not defective. The problem she is experiencing is from the incorrect operation of this spa, not our

installations or repairs.

It is unfortunate that Ms. [redacted] has taken this position. However, wo have done nothing but they to remedy the situation for her. Our offer of removing

the spa at our cost on selling lt as a used spa still stands.

ON SEVERAL OCCASIONS, I WAS GIVEN WORK ORDERS TO REPAIR THE ABOVE HOT TUB BECAUSE THE TEMPERATURE WAS RISING FROM 96 DEGREES TO 103 DEGREES WHILE THE OWNERS WERE USING THE TUB. WHEN I FIRST ARRIVED AT THE HOME OF THE [redacted], I DID ASVICE HER THAT THE BEHAVIOR SHE WAS DESCRIBING WAS ABNORMAL. HOWEVER AFTER LEARNING THAT SHE HAS BEEN RUNNING THE PUMPS FOR AN OR MORE, I EXPLAINED TO HER THAT THE TEMPERATURE WILL RISE BECAUSE THE FRICTION CAUSED BY RUNNING THE PUMPS LONGER THEN FIFTEEN MINUTES WILL CAUSE THE TEMPERATURE TO RISE A FEW DEGREES DEPENDING HOW LONG SHE RUNS THE PUMPS. AFTER SPEAKING WITH [redacted], [redacted] AND [redacted], FROM MASTER SPAS THEY ALL AGREED THAT THE REASON WAS SUCH IN GOOD FAITH, HOWEVER ORANGE COUNTY POOLS CHANGES OUT THE TWO PUMPS; MOTHERBOARDS AND TOPSIDE THE COMPLAINTS FROM [redacted] CONTINUES AND EVEN AFTER SPEAKING TO [redacted], IN MY PRESENCE, MRS. [redacted] WAS NOT HAPPY AND WANTED A NEW TUB BECAUSE SHE FEELS THAT SHE SHOULD HAVE BEEN TOLD SHE CANT USE THE TUB FOR THAT LONG OF A TIME FRAME. THE OWNERS MANUAL DESCRIBES IN DETAIL HOW TO USE THE TUB AND I PERSONALLY SHOWED HER HOW TO USE THE TUB, YET SHE WAS STILL UNHAPPY. I SUGGESTED PUTTING COLD WATER VIA HER GARDEN HOSE TO COOL THE WATER OFF AND SHE DECLINED SAYING THAT SHE SHOULDN'T HAVE TO. SHE IS USING THE HOT TUB IN AWAY THAT IS SHOULDN'T BE AND THAT'S REASON FOR WHY THE TEMPERATURE HAS RISEN SO HIGH DURING HER USE.

We recommend 20 minutes of high speed therapy In our owner manual although the pumps can be run for longer periods of time,

When operated in the manner it is no uncommon for the water temperature to rise approximately 3 degrees over the course of an hour depending on ambient/auxiliary conditions such as ambient temperatures.

The spa control system has safety overrides build into the logic that will shut down the spa pumps if the water temperature exceeds a safe level.

Well I'm back from my vacation and I was hoping to have a message from your store

on my answering machine or an email. But as usual no call from you. I'm tired of waiting. this has been a few months of going back and forth, and I want a refund. you know there is something wrong . even Lloyd said he never seen the temp go up like that. I do not like the solution that Lloyd gave me. to use It for 15 minutes and then let it set for 5" 1.0 minutes.to let the.pumps.to.cool.down then to restart the pumps there isn't anything in the Manuel about doing that, also In the manual there Isn't anything about how long you can stay in ir s long as you stay under body temp, but since the pumps

raise the heat to go over the body temp then we cant stay In It long. we use the hot tub almost everyday because I have lupus and fibro. so I have a lot of pain. I'm not a happy customer I was misled, I wasn't Informed by your sales men about the rise of the temp from the pumps .. but knowing within 2 months one pump over heated and had to be. replace already, I will be filing complaints with Angles list and Revdex.com this week I should not have to wait any longer.

I will also look for a lawyer to talk to. I went with you company because you seemed to have great ratings , I will be giving my reviews this week, and It Isn't

going to be a very nice review. if you do not give me my refund. like I said I'm really tired of Wllitlng. I hav<l gone through hell and back with loosing

my son In afghan while serving his country so I will no longer let people walk all over me. I feel I deserve respect, then I have been given about getting a refund. I think I have given up a lot In my life already, but to have a hot tub that you guys tell me to put the temp down to 92 which Is to cold for me, Is not solving the problem. I have been reading that master does not honor there warranty and that's why they told me I have to go after to you since I bough it from orange county pool and spa.. I really don't want to leave a bad review but you leave me no choice between you and master

spa. So I'm asking one more time please give me a refund for a hot tub that has been nothing but problems. you have had to replace the pumps the mother board, the panel all within 2 months of us owning this brand new hot tub. so if your a professional company I expect a respond to my email. I want to know when your going to come and get the hot tub. so I can have the nilllngs taken down off the deck ,and I can have the electrlclan here to discount It. This is a faulty Hot tub. your service men even stated it to me. Your company is not an honest to its word. your sales people took advantage of us by not giving us all the information if you claim this is how a hot tub runs. Even though it doesn't state this in the manual. you have not offered to exchange the hot tub. you have not offered a different model. I wanted the other model but I let your sales man talk me out of it. now I see it was a big mistake. Steve from Master spa asked me if you offered me an exchange or a different one I said. no. I said I would even take a bigger one that holds more water that wont heat up as fast. But you will not work with me as your customer. you do not stand behind your customers. I had two of your service men tell me that there is something wrong with my hot tub. YOU would rather have a very unhappy customer with a hot tub that does not work the way its suppose to. MY son was killed in Afghanistan and this was money he left to me, so I bought a hot tub. So I find it to be a big disrespect to me and to my son who was . that your leaving us with a hot tub that doesn't work right. shame on you for not honoring and standing behind your products. I would like you to explain to me again how to use this as a therapy hot tub . I would to see if its the same as what your salesman told us when he sold it to us. if we can't use the jets for more than 15 minutes .. Review: We purchased a new pool from Orange County Pools and had them install same. The day after the installation, we noticed the pools was losing water. We went to store and reported the problem. [redacted], the service manager at Orange County Pools contacted a diver to come to our home and find the problem. The diver found the leak and put a patch on it. We went to Orange County Pools and [redacted] told us the hole was a manufacturer defect, which is covered under the warranty, and he would order a new liner and have it installed when it came in. Our question, at that time was who will pay for the water (we paid $580 to have water delivered to our home to fill the pool). [redacted] said he would speak to the owner and get back to us. Three weeks later, after not hearing from Orange County Pools we stopped in to see [redacted]. At that time [redacted] told us the manufacturer will not honor the warranty. He said he could offer no explanation for this. He then proceeded to tell us that Orange County Pools would give us a new liner from another manufacturer in that we could keep in our garage in case we have a problem down the road. They would not reinstall the liner or cover the cost of water.Desired Settlement: I would like Orange County Pools to install a brand new liner and replace the water. We contracted to purchase a new pool free of defects. What we received was a defective pool, which we paid full price for.

This letter is in response to complaint ID [redacted]. On July **, 2013 [redacted] purchased his above ground pool from our store located in Middletown New York. The pool was erected on July **, 2013. The next day, [redacted] called the Middletown store and informed them that the pool appeared to be losing water. After addressing the concern of the customer, our customer service department contacted ow·leak detection service and discussed the situation. The very next day, the diver went to the customer's home and discovered a small leak on the seam where the liner is glued together. At that time the diver triple patched the affected area to stop any further loss of water. [redacted] and his wife went back in to the store the following day to discuss the diver's findings.

It was explained to them that the diver confirmed the leak was found on a seam and that Orange County Pools would be starting the warranty process immediately. It was also re­ explained that the manufacturer holds responsibility for the warranty on their product as they were the ones produced it. It was re-explained, because the customer was previously made aware of Orange County Pools warranty policy when they signed and dated the terms and conditions portion of their pool contract when they purchased the pool.

The warranty process took roughly 3 weeks to complete. The manufacturer took their stance of providing a liner to replace the defective one. In the manufacturer's warranty, which is provided with every liner they sell, they are "not responsible for any labor charges, cost of lost water or chemicals or any other damages that may occur therefrom,,.

While explaining everything to [redacted], he became very belligerent, raising his voice and pacing around. He began to use profanity and make threats so he.was asked to leave the premises .We told [redacted] that we would be provide him with a new liner, which Orange County Pools would assume the cost to re-install. As we do not make the liner, we would not cover the water. It was recommended that he contact the manufacturer himself in order to see if somehow he could persuade them to cover the water if he wished to pursue them further for the defective material. The manufacturer's contact information was printed from their website and provided to [redacted] before he finally left the store. The second option that was presented was that he would be provided a new liner, as in the first scenario, but since the current liner was holding water, he could save the new liner for future use and avoid the cost of totally replacing the water in the pool that the manufacturer will not cover at this time. Orange County Pools would continue to stand behind the liner currently installed in his pool and in the event of any further issue we would continue to service the product as well.

We were completely caught off guard by this letter and in addition we have been summoned to attend Middletown City small claims court in November in response to a judgment in regards to this situation. At that time we expect to show that sufficient effort and resolution was offered in regards to this claim which you have contacted us about.

Review: I went to orange county pool and spa in [redacted] on Aprril **, 2014, and I gave [redacted] a partial down payment in check form for a 15x30 oval pool for $3500.00. I was told that the pool will be delivered and installed by the begining of May. I am now approaching the end of June and still no pool. I called numerous times and I even stepped in to see what is taking so long with this pool. [redacted], ([redacted], the so call [redacted], and [redacted] all stated the pool will be arriving the second week of May, then the third week then the fourth week. now we are in june approaching the end and still no pool. I asked [redacted], a nasty billigerent [redacted], what was the name of the manufacture of the pool. She informed me [redacted], in Long island. I called the company and spoke to [redacted] about the pool who stated the pool company Orange County Pool and spa, knows exactly when the pool is to be delievered and I should contact them, because it doesnt take over two and a half months to get the pool out. These people in Orange County Pool and spa are liars, very unreliable and unprofessional. I now believe they took my check and spent it on their own personal needs. I am tired of getting the run around and want future consumers to know what kind of people they are dealing with unreliable, liars and totally unprofessional. Their behaviorS are unacceptable. This my hard earned money that I have given to these people. I have even requested my money to no avail, but was told by [redacted] on Friday June **, 2014 that he personally will be picking up the pool on Monday June **, 2014 from Wilbar because they dont deliver on weekends. I called on Monday at approximately 130 pm and was told that [redacted] was not in for the day, then I told the [redacted] what I was told by [redacted] on the previous friday and then she corrected herself stating " oh he went at 0800 hours for the pool and not yet returned. My final call was placed at 627 pm and was told [redacted] was still out in Long Island pickin up the pool. What a joke. I demanded to speak to the [redacted] and was told to hold. waite approximately 3-5 mins no one came to the phone. I hung up and called back and was again told by unprofessional [redacted] the [redacted], the [redacted] just left for the day and [redacted] will call me back in morning. I have requested to speak to the [redacted] numerous times to no avail, I believe he is a coward to deal with this problem, however he and his son [redacted] was quick to take my money. the next step after writing to Revdex.com will be filing a civil action lawsuit against this unreliable company.Desired Settlement: I would like a prompt delivery of my merchandise or a prompt refund of my check of $3500.00

On 4/**/2014 [redacted] of [redacted] purchased a pool of her own free will from Orange County Pools at our [redacted] location. [redacted] agreed to the terms of contract, which specifically states all pertinent information on her purchase, no where on the contract was it agreed upon that the pool would be delivered or installed by an exact date.

I would agree that the timing of the project has been a bit longer than antici[redacted]ed due to production issues with the manufacturer. When we sell a pool, we provide a time frame as a guideline for the customer to be able to prepare for when the project should commence (getting a building permit, possible excavation of property, obtaining a water delivery, etc.)This way, all prep work will be arranged prior to arrival of pool. Orange County Pools has bee operating in this manner for a very long time and have not encountered a situation like this before. We have many happy customers amongst the surrounding areas of our three locations and look forward to repairing our relationship with [redacted].

With that being said, the pool is in our warehouse location and several calls were made to the customer today. A message was left in the morning and then again in the later afternoon in regards to delivering the pool tomorrow, 6/**/14 as discussed in our last correspondence with the customer. Tomorrow's delivery would ensure that we could get the installer to erect the pool as soon as possible, weather permitting. An email was also sent from the warehouse as another attempt to further contact the customer, at this point we have still not heard from the customer and will continue to try to contact her and take care of this in a timely manner.. There is a balance that still remains that would need to be paid by certified check or cash in order to release the pool, this was explained to [redacted] at the time of sale and agreed upon with her signature. We will be more than happy to except a certified check or cash at the time of delivery if [redacted] assures us it will be available at that time.

In regards to [redacted]’s response to the Revdex.com, we continue to apologize that the project took a bit longer than initially expected and wish to remind her that manufacturing issues rarely occur, but they do. We could not deliver or install her pool until it actually arrived at our warehouse facility.

Regardless of Revdex.com contact, the pool came in to our warehouse the same day the complaint letter was received and the intention was to get the pool out to her home as soon as possible. The balance owed on her account and the telephone number given to us by [redacted] as her best contact number, which actually was not, held the delivery up even a bit longer.

We are surprised to see that her response continues to be very negative. She has been in to our other local location and left happy and confident in how to care for her product and seems to be maintaining it well. Our staff there has been working hand in hand with her and working very hard to repair this relationship. We obviously know that this doesn’t happen immediately, but we ask her to recognize the effort and try to move on. We are glad that [redacted] was pleased with her installer, his workers and the erection of the pool itself.

Review: I purchased a masters-pas Hot tub with extended warranty on 04/**/12 thru the [redacted] office Located In [redacted] store with Sale-person name [redacted] I got it delivered at the end of 08/**..Now my Question is my spa cover had a rip thru the stitching near the handle of the spa cover only having the spa of only a few months on 3/** that when I noticed the problem and I called [redacted] office call the Service department and she stated to send the picture to her though the email ...04/**..and they will correct the issue..Now not hearing back from her I call for a update 03/** she stated to resend everything again to her..I call the Service Department a few days later and she mention for me to email master-spa directly that she could not help me and to informed them about the spa cover? On or about March,2014 I email Master-spas several time and on June,2014 and several calls they stated that the warranty does not cover it due to normal use /wear and tear ..How can this be wear and tear when I purchased the spa only a few months?I immediately notified the Service Department New Windsor, the fact that the process took so long they didn't cover me thru the warranty..Its seems that this matter is never going to be resolved by my own efforts . but with your assistance maybe..Desired Settlement: New Master-Spa Hot Tub Cover

First and foremost, I would like to apologize that this situation has gone on for such an extended length of time. With that being said, the manufacturer holds the warranty your product and ultimately decide what is/what is not covered. Since the delivery was in August of 2012 and issue was reported in March of 2013, being that the problem was reported 7 months after the tub was delivered as described in the customer's complaint letter to the Revdex.com

We would like to continue our relationship with you and apologize for your frustration. As we do not manufacturer the product we intern have to abide by there guidelines. Which they are stating that after 7 months , normal wear and tear is not a defective issue in the production of product.

I am more than willing to contact them on your behalf to see what can be done to rectify the situation. Otherwise I can go ahead and offer you 50% reduction toward a brand new spa cover with a different manufacturer to help you replace your cover
