Orange Garden Apartments

Review: I applied for these apartments and paid the credit check fee. A few days later a worker at Orange Garden Apartments called and told me that my application was "incomplete" and that they did not run my credit or do anything further until I had my proof of income updated. I was accepted moved into another place and asked for a refund of my credit check since it never occurred since my application was incomplete. They refused to refund my credit check fee even though I did not finish applying and they didn't check my credit. All I requested was my $20 credit check fee that they kept even though my credit was not ran since my application was incomplete and I moved elsewhere.

Business' Initial Response

On November 2, 2012 Ms. [redacted] turned in a rental application to Orange Garden. She was in a hurry to be approved so I told her that I would start her application, but since her proof of income was not in her name I would need new ones in her name. She said she was going to get the paperwork and turn it in to me. I ran her credit check and eviction check the very same day she turned in her application. I did not hear from her for a few weeks, and when she did call she demanded her application fee back. I informed her that we had already ran the checks, that the application clearly states the fee is non-refundable. She also signed a waiver authorizing us to run her credit checks. She then began using profanity and raising her voice. I informed her that if she continued to speak to me I would end the call. She continued so I ended the call. I have not heard from Ms. [redacted] since. Also, the credit and eviction checks I ran are printed after we run them and are dated, November 2, 2012, the same day she turned in and signed her application. I can supply copies of all these.

Like I have already stated my credit file shows no apartment or any other agency affiliated with that purpose requesting my credit information. It lists credit inquiries by every little thing that I apply for that involves my credit for several months. it would have them or an affiliated agency listed under the credit inquiries, my previous apartments request was listed when I rented from them. I know all the sources of the inquiries and none of them was from them. I have spoken with 2 women agents at the apartment complex on this issue, I find it really hard to believe that they have only 1 person working at the apartment complex that's ridiculous, the lies just don't stop (like me being in a hurry but not call back in weeks- such a hurry- and I never completed my application to need my credit checked because I moved into a house), and I wouldn't demand a refund & deal with this if I wasn't told that my credit was not ran since I had no proof of income to complete my application which is what the $20 was for. It would have been listed on my credit file under the inquiries section which I can prove that it isn't on any of the different credit companies files. I do not need a copy of a credit report that was not done at the time when I already tried to be refunded after not finishing my application that they are trying to offer me now. why are they going to run my credit if my application is incomplete? I didn't have proof of income but they're going to run my credit for what purpose? they are just keeping peoples credit check fees whether they do it or not and even if you don't complete an application to need a credit check done to begin with. Both responses to my complaint have been filled with obvious holes in their story and lies. no apartment complex is ran by 1 single person working there and I have my credit files to prove their was no inquiry from them.

I am the only person in my office, so I do not know what other agents Ms. [redacted] is referring to. I never told her that her credit had not been run, and I never told her that she would get her money back. As I have stated I have the dated credit reports and if she would like me to fax or mail them to her I will. As far as her personal credit report, I do not know what would show from us checking her credit, we do a credit history check and we use a site that we pay. It may not say our apartment complex's name on it. Again, I can fax or mail the credit reports that we ran at anytime.
