Dear Ms***:I have received and reviewed the complaint submitted by *** *** on his fire/power surge claimI apologize for the delay in responding as the complaint was not received in our office until yesterdayThe claim was reported to Oregon Mutual Insurance on December 21,
as a flash fire in a wok caused a power surge and soot damage to other appliancesMr*** has a Homeowners policy written by Oregon Mutual Insurance with effective dates of December 11, to December 11, The policy has a personal property deductible of $
An independent adjuster was assigned to inspect the loss and he met with Mr*** on December at the apartmentMr*** reported that there was a fire in the wok from putting liquor into the pan and then the microwave above the stove started smokingHe then noticed smoke coming from the back of his two TVs and laptop that were plugged in at the timeThe apartment manager was going to replace the microwaveMr*** indicated that he threw away one of the TVs that was smoking, a laptop and a vacuum cleaner due to smoke/soot so we were not able to inspect these itemsMr*** provided us the attached inventory list of items totaling $12,in replacement cost
We hired an electrical engineer to inspect the apartment and see if they could determine if there was a power surgeMr*** reported that his appliances would turn themselves off at random time causing the dishwasher and washing machines to not go through a whole cycleThe electrical engineer inspected the appliances and could not find any evidence that they were not functioning properlyThe electrical engineer then installed a power quality meter to see if there were fluctuations in the powerThe power quality was found to be remarkably cleanMr*** is in an apartment building with other unitsWe checked with the other units and no one had experienced any electrical problems recently
Our investigation concluded that there was no evidence of a power surgeA denial of coverage letter was sent to Mr*** on March explaining that there was no direct physical damage to the items from a covered peril under the policyA copy of the engineer’s report was also sent with the denialWe have spoken with Mr*** on several occasions to explain why this is not a covered lossWe feel that we conducted a complete investigation but unfortunately there is no coverage for this loss.If you have any questions, please feel free to contact me at the number below

[redacted]Date of Loss: 4/24/2017Dear [redacted]I have received and reviewed the complaint submitted by [redacted] on her deck collapse claim. The claim was reported to Oregon Mutual Insurance on April 27, 2017 as deck is starting to collapse due to rain/snow.We inspected the deck with Ms. [redacted] daughter, [redacted] on April 28, 2017. Ms. [redacted] explained that due to weight of ice and snow that the deck has collapsed. We observed a beam holding up the second floor deck that showed deterioration. It was explained to Ms. [redacted] that the policy does not cover wear and tear, deterioration or collapsing of the deck. We sent a denial letter to Ms. [redacted] dated May 2. The homeowner 5 policy specifically excludes collapse of a deck unless it is a direct result of the collapse of a building or any part of a building.Ms. [redacted] then called to complain that she didn’t agree with the denial.
