Review: I purchased a used car from the orlend auto auction and I was tould it will pass smog and it was legal to drive on the street after 5 miles driveing on the road home the check eng lights came on and Monday after the auction I took the car to a shop to check out the prob and the shop tould me the was no way the car will pass smog and it was not safe to drive on the road so I took the car to the Chrysler dealer in yuba city ca and the shop there tould me the same and thay did a smog on the car and it failed for well over a month I been trying to get a smog paper from the auction and thay would not send it and the people that would pick up the phone where veary rude and not help full at all and tould me it was not there probDesired Settlement: I just want my money back I feel I been lied to and ripped off

Dear Mr. [redacted] On February 9, 2014 you purchased a 2005 Chrysler Pacifica License# [redacted] VIN#[redacted] for the [redacted] of $2300.00 Plus Buyer Fee, Document Fee, Smog fee, Registration fee, License fee, and Taxes.

On March 17, 2014 I spoke to you over the phone for the first time and you requested a copy of the Smog Certificate. I mailed a copy to [redacted]. I also emailed a copy to [redacted].

On a later conversation that we had over the phone and a Text message you stated that you were looking for a Refund requesting all your money back for the purchase of the car, because it had a 1999 engine on a 2005 model and the smog was made illegally.

I suggested for you to take the car to a License Mechanic or a Dealer and get a diagnostic and Fax me or email me a copy of the results so I can take a look at it and consider the situation. On March 19, 2014 I received a Faxed Copy of an Invoice and a Smog Certificate from John L. Sullivan Dodge Dealership I contacted Mr. [redacted] on March 20, 2014 he is the Service writer for John L. Sullivan Dodge, he advised me that he car had the check engine light on and he advised you that the car would have not passed smog.

His Diagnostic was that the car needed an 02 Censor to fix the problem. I was also advised that the vehicle passed the Comprehensive Visual Inspection which means that all the necessary parts were in the vehicle at the time the vehicle went through Smog, and the engine is not from a 1999 model.

I also spoke to Mr. [redacted] from the Department of Consumer Affairs Bureau of Automotive Repair in Sacramento and he advised me that the consumer has to go to a Referee if they have a question, and the referee will decide if the Smog was correct or not.

By looking at two different Smog Certificates from two licensed Smog Shops the Comprehensive and Visual Inspection Passed both times. A sensor in the car can go out any time this is what I was advised by Mr. [redacted] he is the Service Writer for Sullivan Dodge.

Taking in consideration the Smog Certificate and the diagnostic from John L. Sullivan Dodge plus the written contract that we have where proofs that the car was sold as is with no warranties. You are liable for any additional costs for repairs and this AS-IS was signed by you. A copy has been attached for your records. After reviewing our records we came to the conclusion that we cannot issue a Refund.

I am rejecting this response because: thay sent me this letter also and that is full of lies I called on February 12th to get a smog cert and the people in the auct tould me thay would send it and never did I called every week to try to get a copy of the smog In tell march 17th and every time I called the business to try to resolve this prob the people that would pic up the phone where veary rude and refused to help what so ever at this time I have the state bar in pounding the car for a complet inspection becuse of a fraudulent smog that thay had done to the car I was tould at the time of the sale of the car that it was California smog legal and legal to drive on the street and I found out I was lied to and tricked by the business so I would buy the car this is a business the should be shut down becuse how meny ather cars have been sold to people just like this and how rude thay are when people call to ask for paper work and I am California state employee I will do every thing I can to make sure this dose not happened to any one else's
