Prior to buying her home, When *** *** inspected her home carefully and provided us with a punch list of items to correctWe corrected all but item on her list (marble door saddles with hairline fractures)This item was not yet completed due to the need to wait for the supplier to find replacement saddles with a similar color to the original
We understand *** ***’s consternation at the malfunction of her boiler, which resulted in not having hot water for a long periodHowever, we thought that she had agreed with our suggestion that she contact the boiler repair company directly to arrange for access and repair, at our expenseWe regret the mis-communicationWhen we learned that there was a misunderstanding, we contacted the boiler company ourselves and arranged for the repair to be completed on an expedited basis, which was done to her satisfaction
We met with *** *** on Thursday, October *** to inspect and discuss with her all her other concernsWe are making arrangements to repair all items that are our responsibility under our post-closing warrantyWe also took the time to let *** *** know that some items on her list fall in the category of homeowner maintenance, such as periodic cleaning of gutters and downspouts and yard drains, and replacement of burned-out light bulbs and wear and tear items that were not in existence prior to her purchase of the home nearly a year ago
The exterior doors were built as drawn by the architect, as per NYC building codeWe will not be acting on this complaint

After reading the response made by Getz Obstfeld & [redacted]., I see that they are still not willing to be honest about the poor contracting they have subjected my family to live in and they did not contractually honor. First off, I contacted Getz cooperation the first day that the issue occurred with my boiler. Alerting him about the severity and inconvenience but there was no response. Furthermore, Getz did not address the issue with the boiler until quite some time after and only when I verbalized retaining legal services. Most importantly, there are unsound structural issues such as 20 feet of loose siding which is still not addressed, a hole that is in my ceiling from the leaks coming from the badly installed lentil in the front of my home, the multiple, unbearable, drafty windows and wall sockets throughout the home due to the insufficient insulation behind the sheet rock. This is just to name a few things in which I have been  dealing with. The roof was rightfully fixed due to the structural warranty of 10 years, again after continuous pictures and alerts to Getz. The facts are very simple, Getz was and is suppose to provide services to me that he has not held up to. I am not happy and will like him to simply fix the many issues that has arose in my home over the last year. Please help, I have children that are being affected by the extreme temperature changes in my home as well as by bills have gone up as a diverse affect. Review: I, [redacted], purchased [redacted] on 9/**/2013. Prior to closing there was a punch list that I created and signed by the developer and I, on 9/**/13. As per my contract, there are items such as the roof, appliances, electric and other structural items that are under builders warranty. Within the first year, as stated in my contract, this new development in which I reside would be covered for any repairs that had to be done. From the time of closing to now, which is almost a year later the punch list has not been addressed. Over the last 6 months, on multiple occasions, I have diligently attempted to communicate with Getz's [redacted]oration to have my prior list and other increasingly damaging issues fixed. I am a single mom and it is hard enough to have a new home and be a mother. I should not also be subjected to Getz's unprofessional work ethic and lack of concern in honoring my contract. It took him 2 weeks to fix the "brand new" water heater which left us without any heat or hot water. We were bathing from buckets of water and utilizing an immense amount of extra gas and electric to heat the water. We have 5 children in the home whose health is very important to my family and one child who has a variant asthma. I feel as though we are living in a third world country. I am put in a very uncomfortable position right now due to me having to go through these lengths. Not only that, I have spoken to [redacted] from [redacted] and [redacted] from the development [redacted]., that funded the [redacted], to contact Getz but there has been no resolve. I really thought NYC was bigger than Getz but I suppose not. Everything that is listed below is apart of the bucket list and major structual issues that need to be dealt with now because things are getting worst fast. Please contact me as soon as possible and thank you in advance for your time.

1. Roof has rot

2. Roof is leaking

3. Skylight is leaking

4. 3rd floor kitchen ceiling is leaking

5. Walls in the third floor hallway is leaking

6. The lights in multiple parts of the entire building is no longer working (all floors)

7. All of the windows in the front of the building is leaking

8. All of the windows in the back of the building is leaking

9. The water heater is no longer working (fixed on 9/**/14)

10. The siding on the right side of the building is coming off (which puts bystanders and my neighbors property at risk of being damaged.

11. Saddles in multiple parts of the home needs to be replaced

12. The tile in the 3rd floor bathroom is broken (before we moved in)

13. The toilet on the first floor is broken (before we moved in)

14. The door leading to the exterior in the front and back are put in badly... the hinges are facing the outside in which can be knocked out and the door can be taken off

15. The bathroom cabinet on the second floor of the first unit is broken

16. When there is rainfall the bathrooms back up

17. The drain in the backyard also has issues going down with sever rainfallDesired Settlement: I need all structural issues fixed and completed. I am going to be following up with my lawyer as well to put Getz on legal notice for not honoring the contract and warranties signed at closing. I am also planning on moving forward with a lawsuit and making all parties involved responsible for the poor quality work and materials used for my home.
