Osgood Paving

Review: I contraced with Osgood Paving to pave two driveways. The contract was signed on July 9th, and the $3,000 deposit check was cashed on July 14th.

The vendor told me that he would tear out the driveway at the end of the month, and the driveway would be paved a week later.

I did not document all of my calls at this stage, but I believe that he did tear out the driveway the first week of August.

I expected the driveway to be completed the following week.

On 8/18 the vendor told me that he required additional fund to proceeded. I informed him that I would deliver a check the morning that the asphalt was delivered, he said that was OK.

on 8/20 he texted me that he would pave on 8/22 or 8/25

on 8/25 he texted me that he would pave on 8/28 or 8/29

I had additional conversations on the phone with the vendor where he told me that he would show up on additional days.

on 9/24 he texted me that he would pave on 9/26 but he required an additional $3,000

I stated that I was not going to give him any more funds due to his dealing in bad faith so far, I would provide funds after the driveway was paved.

on 9/26 he stated he could not pave on that day and would pave on 9/29 or 9/30

Calls on 9/30 were not answered or returned.Desired Settlement: I need this job finished. I am concerened that the plants will shut down for the winter. Or I would like my $3,000 back so that I may contract with a vendor who will complete the job.

Review: We entered in to an agreement with [redacted] from Osgood Paving on Oct 8, 2014 to pave our driveway for $3,000. He took a $1,000 deposit and was supposed to have the work completed by 10/10/14. He did a minimal amount of prep work but never came back and we have been unable to get him back to complete the work despite his numerous promises to do so. We asked him for a refund of the $1,000 so that we could hire another contractor but he continues to tell us that he will finish the job. The snow has now fallen and the paving plants are all shutting down for the season so his promises are ringing empty.

We also just discovered that he is operating without a valid (or current) contractors license. This is all a surprise as we have used [redacted] in the past for other jobs and haven't had these issues.Desired Settlement: We would like to either have the $1,000 refunded or have the job completed by 12/6/14.
