On the evening of May 23, 2020, while visiting a friend in Orlando, I suffered a hit to my chin that caused my left upper molar to break and shatter. Tried to handle the pain but it became unbearable and decided to call numerous dentists in the Orlando area in hope one will be an after-hours pratice. I stumbled upon Dr. Anthony Oswick & Dr. Maria Kashlak practice and noticed the website states the following (http://emergencydentistinflorida.com/emergency-dentist.php):
'Ever had a dental emergency or throbbing toothache and been unable to find immediate help? Ever had a tooth break on Friday, Saturday or Sunday and can't find a dentist to see you until Monday? Have a job where you can't leave work? By waiting too long to treat a dental infection, you can end up in a full-blown dental crisis'possibly spending time in a hospital with an I.V. antibiotic in your arm. When you have a dental emergency, you need a dentist'FAST! So why are you waiting? We all know tooth pain has no predictable schedule and can occur quite unexpectedly. With our expanded hours, we are here to help you when you need us. Based on that statement, I believed that I could get my tooth looked at right away or on a reasonable amount of time to treat an emergency or trauma situation. Decided to call the practice around midnight that same evening. There was no answer, but I decided to leave a message. I did not receive a call back until around 7 am that next morning. Unfortunately, I didn't hear the phone as I was getting sleep since barely slept that night. When I woke up later that morning, I called the number and requested if I could be seen that day (Sunday May 24), the response was that they were full and they could not accommodate me until Tuesday.
I was in disbelief that an after-hour practice would not have openings until 2 days later, so I started making questions to Bob (who appears to be their office manager). My questions were such as: are you staffed 24 hours', are you booked all 24 hours today and tomorrow? Will you have an opening overnight tonight', and I even read their statement from the website trying to make a point that it is misleading to believe that they would take patients at any time or at within a reasonable amount of time. I tried to make the comparison of the hospital ER, where people walk-in and they are not told to come back two days later. Bob never acknowledge the website's misleading interpretation and provided answers such as: 'how can our 2 doctors see patients 24 hrs'?, 'our office works on appointments only since our doctors can't be here 24 hours a day', 'we can only provide you with medication for the pain'. It was a totally frustrating conversation, and I suggested many times they should revise their website if they could not comply.
I made multiple attempts to make them understand that their website is misleading and that something should be changed in order to not make people believe they will be seen at any time (or '24/7') of the day if even if an emergency occurred. Bob never acknowledged it, instead was very defensive.
After hanging up, I wrote a review on Google explaining the situation that had transpired and a warning to people that said that 'I believed it was not a true 24hr operation? practice as they stated. Other similar reviews are found on google as well. See the review here ***
After seeing the review, Bob called me back several times (at least 4) begging me to delete the review. I told him that I would not delete it and to take as a lesson learned and moved on.
That same day, the dentist practice replied to my Review by posting my phone number publicly and encouraging people to call me. I believe this could be a HIPAA violation. See the reply in the review link above.
I was seen by a dentist in Jupiter FL on May 25, where I reside, and required a crown to be installed on the #15 molar, which one week later escaladed needing a root canal, currently scheduled later this month. Aggravation of the damage to the tooth and the amounting expenses could had been avoided if the situation was addressed sooner if this was a 24 hr practice.
One week later, June 2, 2020, I received a 'Cease and Desist? Letter from Dr. Anthony Oswick & Dr. Maria Kashlak's practice (no date, no signature or expected date to complete the request) threating me to proceed with legal actions if the post was not removed. They claim I used defamation in my statement, which I believe to be moot, as I was only stating facts and my opinion of the situation.
This is a method to intimidate their way out of their lack of accountability and responsibility to the patient and this should be unacceptable. Not only are they using False Advertisement, they violated all ethical and professional rules and they are using a bully strategy to gain strategic advantage by manipulating their reviews.
I kindly request this case to be looked at and explore options to solve this matter in a way that makes their practice accountable for their actions and to avoid future occurrences

Desired Outcome

Other (requires explanation) Idealy, I would like to them to fix my tooth at no charge. But I am afraid to let them work on me as they could retaliate and mess up my procedures. So I wish they paid my services at the other dentist I am visiting. Removal of the advertising of 24/7 emergency service is the ultimate goal.

I do not accept the response and lack of ownership by the clinic.

Since the beginning, they have been very rude, unprofessional, untruthful and defensive as they posting my number pubicly and inciting people to call me, which could potentialy be a violation of provacy and HIIPA. Also sending out fake "cease and desist letters" to manipulate and intimidate people in order to boosts their stats online.

I invite the public to make their own conclusion by reading the following adversising in their webpage, and I feel stong that they would agree that is compeltely missleading and contradictory to what I was told on the phone.

Please pay attention to the section that says "Inmediate services provided", which includes fractured tooth and root canals (which is what I eneded up having). 2 days later is not "Inmediate" in my opinion. The definition of Inmediate is "instant or prepared quickly and with little effort". But that inmediate service was not provided by the practice that claims to be 24/7 emergency service and able to take care of your dental needs NOW!

This practice needs to own what is stated in the website or complete the statement completely. From my experience, they are not capable of having a staffed operating clinic 24/7 as they claim. 24/7 means 24/7 (including weekends and holidays). Accomodating a patient 2 days later or just offering pain medication over the phone is not the "NOW" they claim in their webpage (see above statement).

I did receive many calls from other dentists for tele consult, but nowhere did those dentist claim to be 24/7 practice.
Also, please read all the reviews on google with other patients claiming and complaining the same thing as me. That adds to the case that this practice has been false advertising for a long period of time.

The office manager was extremely rude, non-accomodating, non-empathic of my situation, unhelpful, not-knowlegeable of its own practice, untruthful and only called me and message me about taking down the review instead of worrying about taking care of the patient.

I request the Revdex.com to take action against this practice and make them take down the advertisment or put in place procedures to trully be a 24/7 practice able to accomodate patients at all times of the day within a timely matter. I would also like compensation from treatment I had to take elsewhere 2 days later due to the missleading and false advertising of Dr Kashlak and Oswick.

I hope patients see this to avoid being fooled by their missleading advertising practices.
