My name is Aaron Weatherly this is my story I purchased do you 590 skits Deere loader from Otay mesa I was lied to about the year and the hours. When this piece equipment arrived at my place of business I couldn’t believe my eyes what they sent me for $50,000 was the biggest pile of junk I’ve ever seen all the bushings are worn out broken and missing parts the tracks were worn out they spray-painted everything to make it look new I couldn’t believe what I saw . Ricck Hardwick and Evan Simmons are fraud dealers beware of them they’re both liars and I’m not gonna stop until I get answers or someone listens to me I’ve read several reviews and they’ve done this to several people. We need to get together and stop people like this because they’re destroying peoples businesses credit and they don’t care. Review: This complaint falls under several categories. On 9/16/ 2015 I was looking to buy a Scissor and I found the one I was looking for on Otay Mesa Web Cite. An Up Right Electric Scissor Lift, stock #[redacted]. I called Otay business Office and spoke with [redacted]. I advised [redacted] that I found a lift on their web page and that I would like to buy it. She asked me with one and I gave her the stock #[redacted]. She said I would need to place a deposit of $1,000. to hold the lift and that she would be sending me the paperwork, she then transferred me to sale dept. The salesman asked me about the lift and explained the additional cost of shipping. On 9/17/15 I received the forms from [redacted] by email for the $1,000. and at that time did not notice the stock number on the form was different from the stock number of the lift I had expressed to [redacted] the day before. After paying the deposit, [redacted] sent my the contract of the deal with the remaining cost. I signed it and sent it back, again didn't notice the different stock number. A check for the remaining amount was mail to Otay the following week. The Lift arrived Thursday, 10/8/15. The truck driver advised me the Lift was dead and he had no way to get it off his truck. He went on to explain that I needed to call for flat bed tow truck to help him get the lift off his truck. I ask at whom's expense, his response was you need to call the office I'm just the driver. I call and spoke with one of the Salesman who told me the same thing about the tow truck. I said this extra expenses were never told to me and that I would be sending the receipt from the tow company to them, which I did later that day. While the lift was still on the back of the truck, is when I noticed the stock number. A few days go by and we have yet to get this lift work properly. after numerous calls I finally mentioned the different stock numbers. [redacted] response was "does [redacted] know" To this day the lift sets inoperable.Desired Settlement: At this point since we cant get anything done, I want my money back. After letting them know that I aware of the different stock numbers, Otay Sales sent out a locale company to look at the lift 10/23/15, Forklift Exchange, Inc. After thy examination the Tech advised us that this Lift should have nerve been sold to anyone and that it will not pass any safety inspection.. He cited bad batteries, bad charger, bare wires in controller, E stop button did not work, the joy stick was rewired and by passed, pinched hydraulic hoses, bad leak in Hydraulic motor, Emergency release cable broken. A copy of this report was sent to Otay and we have not head a word from them since. They don't respond to our calls so here we are. We've I left a massages on [redacted]'s phone and sent emails as late as yesterday, 11/3/2015.

Review: Forklift was purchased in December, waited 4 weeks for rebuilt battery to be installed. Warranty on invoice says battery is under warranty for 90 days. Forklift arrived with non-functioning battery on the delivery truck. Had to hire special equipment to get it off the delivery truck. Then another tow to get it to our facility. (we don't have a truck ramp)multiple telephone calls to [redacted] result in no response. No returned calls. He did offer to find someone locally to fix the battery, but nothing further was done. We found a repair company in Portland, called [redacted] to exchange information, again no response from him. Our current opinion of Otay Mesa Sales is that they are crooks. We have given 2 1/2 months effort for them to comply with their warranty. Now we are writing to Revdex.com. Perhaps we will be able to move this very heavy, very expensive paper weight out of our shop.Desired Settlement: Refund purchase price so we can buy one that works. Otherwise, Otay pay for charges incurred to repair the battery.Tow truck for final delivery of dead forklift to our facility was $150 paid to [redacted], paid on 12/28/2013.2/13/2014 Service Battery Incorporated. [redacted]. $85.00 inspection fee charged today. They took the battery pack to Vancouver today for assessment of battery and estimate further charges.

Otay mesa sales, inc did in fact respond to the issues the customer was having with the battery. OMS, Inc also agreed to try and fix the battery locally or have it shipped back to Southern California to be replaced. [redacted] was going to send us the info for the battery repair company in which we never received. How is it that we never responded if in the complaint they clearly state that we agreed to have a local company look at the battery. At no time ever was a tow truck discussed or did OMS Inc agree to pay for unloading of the forklift. OMS will agree to pay for the battery evaluation. All we asked for was a receipt for our records. We will also consider paying the local company in Vancouver to fix the battery at a fair price. At this point we are just waiting for the quotes and receipts. To be called crooks is a bold statement. We have been in the equipment business for over 15 years and have a great track record. The internet sure does make it easy for people to slander when ever they are having a bad day. Its sad the the entire story never gets told.

Review: I paid for two forklift units in February 2013 and when they were delivered to Otay Mesa Sales' place of business in El Centro California, where I was supposed to take delivery of them, when I went to inspect them, they were not in operating condition. I made numerous attempts to contact [redacted], whom represented himself to me as the owner of the business, to find a solution to the problem but he did not take any of my calls or responded to any of my emails. I went as far as having a local attorney write him a request for a refund to which Mr. [redacted] did not respond. This has been going on for the past six months, since February 20th, 2013. I have yet to hear from Mr. [redacted] and the only call I ever received was from a mechanic who had no idea what was going on nor did he have any authority to offer a solution.Desired Settlement: I am requesting a refund for the product he did not deliver. Since I could not get a response from him and he's been unable of unwilling to right this situation, I have had no recourse but to obtain the equipment from another vendor and have advised him I have cancelled the transaction and have requested a refund which has also gone unanswered.

The machines that Mr. [redacted] purchased were delivered to Otay Mesa Sales El Centro, per

customer's request. Both machines were in working condition at the time of delivery but Mr. [redacted]

was unaware of how to operate one of the machines when he arrived to do his inspection.

When Mr. [redacted] could not reach Mr. [redacted], he became upset, several of our sales staff and

mechanics tried to reach out to Mr. [redacted] to offer help and training hut he wanted to return

the machines. This is not our policy, all sales are final.

Both units are stored in a secure warehouse in El Centro, CA., and Mr. [redacted] can pick the units

up anytime.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The response stating several people reached out to me is not true, I had one mechanic call me and he did not know what the situation was nor did he have authority to resolve the issue. He asked me what was wrong with the units and I told him, however there was nothing he could do as he was calling me from San Diego and the units were in the city of El Centro. I did not become upset when I could not reach Mr. [redacted], I simply got tired of calling and having to leave message after message for a week and not receiving a call back nor an answer to numerous emails sent. I have and can produce records of all the calls made to Mr. [redacted] and have documented the response I received each time I called, I also have numerous emails that were send with no response, furthermore I have a copy of a letter that was sent to Mr. [redacted] by an attorney I hired to contact him, all attempts that never received a response.

The response also states, "Both machines were in working condition at the time of delivery but Mr. [redacted] was unaware of how to operate one of the machines when he arrived to do his inspection." At the time I did the inspection in San Diego, I was supervised by one of the employees at Mesa Otay, and when I did my inspection in El Centro I was also being supervised by two of Mr. [redacted]' employees. I am aware of how to operate the units in question, furthermore, when I pointed out to the mechanic at the El Centro facility that the units were not functioning as designed, he in turn attempted to operate the unit and was unable to make it work. Therefor it was not my lack of knowledge that didn't allow me to operate the unit, it was the defective unit that was not working as designed since the mechanic that works for Mr. [redacted] was unable to make it work as designed.

This is the first time I have heard any response from Mr. [redacted] or Mesa Otay since the Month of February when this incident occurred, I demand a refund of my money as I have gone to another vendor for the units I required since I did not receive a response from Mr. [redacted] or Mesa Otay to advise of a resolution to this issue. When I spoke to Mr. [redacted] in February, he assured me that as the owner he would personally make things right since there had been a previous issue with another unit purchased from his company. He gave me his word that he would personally would deal with me and make things right, something he did not do and did not keep his word.

Review: Provision Health Corp. purchased a forklift based upon the assurance of the sales rep that the forklift had a long life and was suitable for the uses Provision explained to the sales rep. Several times during the warranty period Provision contacted Otay Mesa Sales because the forklift was not operating properly. Otay Mesa Sales recommended a repair company. The repair company stated that the forklift was too old and unusable and was not worth repairing. When Provision let Otay Mesa Sales know what the repairman had said, the sales rep said that the repairman must have been "a lazy Mexican." He then refused to do anything to try to repair the forklift or offer any solutions.Desired Settlement: Please replace the forklift with a suitable replacement as represented.
