RE: file #*** Dear ***: This letter is in response to the complaint you filed with the Attorney General of WashingtonThey forwarded the information to the Department of Financial Institutions as appropriateThe statement that you made in your complaint said that you called and talked to Cindy from Our Community Credit Union and asked to bring the debt current by paying the three months that the loan is past dueA review of your loan contract for the vehicle shows that you agreed to make monthly payments of $beginning 12/12/The payment history shows that no payment was made in September of Payments were made as agreed in the following months; however, the last payment received by us was on April13,Late notices were mailed to your attention on a regular basis and attempts were made to contact you to discuss the loan statusWe left numerous voice mail messages on the phone that we have on record for you, which is *** but you failed to respondWe called your work phone number on 5/5/and left a message for you to contact usYou did not respondOn 5/5/our accounting department received a request from you to have your ach for the loan payment discontinued, but you failed to speak with anyone regarding your intentions for bringing the loan to a current statusWe left another voice mail message for you on 5/12/2015, 5/19/and again on 5/26/We attempted to speak with your parents in an effort to communicate with you, leaving a voice message for *** on 5/26/2015, but we received no responseWe sent an email message to you on 5/28/asking for you to contact usYou did not respondWe ordered repossession on June 2, The agent spoke with a family member at the address you provided, *** *** *** **, who said that you did not live there or anywhere closeThe Retail Installment Contract that you signed clearly defines what action we may take if you fail to pay the loan as agreedSection 3a states that if you pay late we may take the following steps described below: 3bYou may have to pay all you owe at onceIf you break your promises (default) we may demand that you pay all you owe on this contract at onceDefault means: • You do not pay any payment on time; • You give false, incomplete, or misleading information on a credit application; • You start a proceeding in bankruptcy or one is started against you or your property; or • You break any agreements in this contract3cYou may have to pay collection costs3dWe may take the vehicle from youSection of the contract states that you agree that we may try to contact you in writing, by email, or using pre-recorded/artificial voice messages, text messages and automatic telephone dialing systems, as the law allowsYou also agree that we may try to contact you in these and other ways at any address or telephone number you provide us, even if the telephone number is a cell phone number or the contact results in a charge to youBased on the information in the contact that you signed, we clearly have the right to ask for payment in full of the amount you oweThis is not an unfair business practiceIncluded with this letter is a copy of the back of the contract which contains this informationOn 7/16/we contacted a skip-tracing company in an attempt to locate our collateralOn 7/29/the agent spoke with you and asked for you to return our collateralYou said you were in San Diego and gave him a new phone number of *** ***which is the number we have used to try and make contact with youYou promised to call him after pmAt 11:am the same day you called Cindy and spoke with her, saying you had just returned from overseas, where you had been for employment reasons and wanted to catch up on paymentsShe told you that you owed payments for April, May, June and July and because you were seriously past due and failed to respond to our continued attempts to communicate with regard to the loan that you must pay the total balance owed plus fees associated with the loanYou said that your dad, ***, had possession of the truck and that you would ask him to help you and/or would surrender the vehicle so that it would have less impact on your creditYou granted permission for Cindy to speak with your dadOn 7/29/your dad,*** *** called and spoke with CindyHe said he wanted to pay the loan current for youCindy explained that the loan was too far past due and that we would need the balance in full and that you had agreed to surrender or make the truck available for repossession*** asked if that was in the contract and who makes that determination and Cindy told him that she has that authorityHe asked why she wouldn't allow payments at this time and she explained that the loan was too far past dueShe explained that she told you that we would give you time to refinance it or if you were unable to do that, you should surrender itHe said he would not surrender the truck without reviewing his contractCindy told him she cannot provide contract information to him- he would have to get that from you, since the contract is in your nameHe then demanded an explanation of why she wouldn't allow pmts so she explained the loan is in default, with payments due for April, May, June and July and that we require payment of the balance in full or surrender the vehicleShe offered to send someone to get the truckHe became verbally abusive and she then explained to him that as a courtesy to you that she had agreed to talk with him but was going to terminate the callHe demanded to speak with her supervisor, but she was unavailable, so she told *** that she would have her call himHe said "no transfer me now" and Cindy told him she wouldn't do that, was ending the call and hung upHe called back and left a message "that he was not going to put up with Cindy's *** and that he was trying to save both of them the headache of him calling the Consumer Protection Bureau and the Washington State Attorney General so she better call him back"He failed to leave a call back number for her to return his callCindy noted that she called you and advised you that she would not be communicating with your father anymore and that we need balance in full or the collateral as soon as possibleOn July 30,you called and spoke with Cindy, asking if the Ftruck was in default statusYou asked how much was needed to bring it out of default and she told you that we needed the balance in full plus the repossession feeYou asked again if you could just pay the four months past due and were told noYou also asked who the collector was for the loan and she explained that she was the collectorYou said that someone else called you about the truck, which is most likely the skip-tracing company that we assigned the account to in an effort to locate and secure our collateralThey made contact with you at work and when you requested that they not contact you there, they ceased to do soWe have no knowledge of threatening voice mail messages or any stated intent to arrest you***,we saved the voice mail message from your dad who noted that he was going to file a complaint with the Consumer Protection Bureau and the Washington State Attorney GeneralI ask that you return our
