Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Response:

As Ms. D[redacted] indicates in her response she approved the move in of the second tenant when it was time to renew the first one year lease in July of 2015. She increased the rent $50 per month and generated a new lease with both tenants name on it. This lease began July 1, 2015. Nearly half way through this lease (November 2015), our financial situation changed and we were considering breaking the lease following the requirements listed in the lease (provide notice and pay a lease termination fee). I spoke with Anita indicating our desire to break the lease find more affordable housing. She agreed to lower the rent $75 per month to work with us and to keep us in the apartment for the remainder of the lease (7 months). As stated in her response to the original complaint, Anita the landlord agreed to this all via writing in text message communication of which I still have copies. At no point did she mention retention of my security deposit from the original one person lease.

As for the cats, she showed up at the apartment unannounced in October of 2015 (prior to the rent reduction which began December 2015). It was not uncommon for her to show up announced which is a clear violation of the lease. We let her into the apartment for her third attempt to fix the broken toilet handle and flushing mechanism. There was no attempt on our parts to hide the two additional cats or to deny they were present. As mentioned in the original complaint- it was a short-term emergency situation and they had only been there a few days. After several discussions with Anita, again in writing via text, she agreed to let us house the cats long term with an additional $50 per month added to the rent to cover a second pet deposit. I had already provided an $850 non-refundable pet deposit to her for two cats on both the original lease and the second lease with the second tenants name on it. With this additional $50 per month for the second tenant and the additional $50 per month for the cats, we quickly realized we could not afford to stay in the apartment with the approaching winter. As I already mentioned the utility bills were incredibly high. Again you will notice in Anita’s response to my original complaint that she allowed the cats to stay without an additional deposit.
In her response, she clearly indicates that she was aware of the second tenant and of the cats and that she agreed to 1) create a new lease with increased rent with both tenant’s names on it at the time of the lease renewal in July of 2015 and she agreed 2) to allow the cats to stay on the premise for an additional monthly fee.

Because she clearly agreed to all of these items, both in writing during the lease and later in her response to the original Revdex.com complaint, we are seeking a full refund of the security deposit for the "reduced rent" listed on our move-out summary as the security deposit was paid by one tenant on the first lease and the landlord had agreed to reduce the rent with no mention of security deposit retention. Secondly, we are seeking a refund of the "pet deposit" since again the landlord made no mention of retaining the original security deposit to cover this when she agreed to reduce the rent. She agreed to both and then tried to keep my original security deposit ($800) after the fact. In addition she has already retained the original $800 pet deposit.

Review: We were going to rent a house from [redacted] of Over the Bay Rentals. She told us that the security deposit for our animals could be paid over the course of the year. When it came time to move into the rental, she told us we had to have the money up front. We did not have the $4000.00 she requested so she said she could not rent to us. We had paid her $1200.00 already so we asked when we could get that back. She told us she was out of town and we could get in touch with her on Sunday, two days later. When we tried she refused to answer the phone putting us in dire straights because that was the weekend we were to move. All of this took place at the end of July and we still have not heard word one from her. She won't return our phone calls or texts and we are our 1200.00. I do not know where to turn at this point and we need that money back. Anything you can do to help would be greatly appreciated.Desired Settlement: I need to get that money back as soon as possible.
