Response taken over the phone: This job has been much more complicated than it sounds Before we could even start to remove the retaining wall we had to remove heavy vegetation We also had take out re-bar and metal beams to remove the old wall There is a pond nearby the
wall We dug a trench for the new wall, it filled with waterThere is also a gazebo on the top of the wall which is dependent on the ground beneath being stable The water and weather has been the biggest issue We have all the materials and intend on completing the job as soon as possibleMore importantly, we want to do the job correctly or the wall will not hold and there will be even bigger problems We have checked the conditions on a regular basis and will continue to do so

*** *** I removed all of the vegetation before he started workingI have pictures with dates on them from July and he did not start work until AugThere has NEVER been standing water at the siteThere has NEVER been a drainage problemHe actually said that it was too wet to do any work but I was able to remove feet of timbers two days after we had inches of rainI have multiple pictures of the site and there has NEVER been a water issueHe saw the site with the pond when he bid the jobHe has not been to the job site during the day when I am home and his worker who has been there needs a new muffler on his truck so I know when he shows upThere is a concrete footer that I dug out and no water issuesIt has been months since he took my money and all he has are excuses

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  I would like to add that Paul has come over 2x, not 4x as stated in his response. Both times he has failed to complete the repairs as promised. I accept this settlement if he ever plans to finish it? I have received these same promises over the last 2 years which is why I submitted the complaint in the first place. I hope this has a final resolution soon. Thanks you.
