Initial Business Response /* (1000, 8, 2015/12/29) */
***
Hello, My name is Stephanie T***Walerie T*** and I our Owners of Over the Top LS Construction LLCWalerie T*** is also know as
Larry T***I'm COMPLETELY aware of this job and WHAT WAS AGREED uponFirst off this job was Quoted originally at $When my husband and I spoke to Mr.*** (he was on speaker), we broke it down to him on the phone, the cost for the material and the separate cost for laborMr*** had replied " if you can bring it down to $i'll except the bid"We agreed to it being a newer company were trying to spread our nameThe jobs that were originally discussed, which was 1.) Running the power line from the house to the barn and installing two outlets, 2.)Replacing the old breaker to the hot tub because it was tested and it came back as a bad breaker, was the arrangementAfter the new breaker was installed there was also a problem with the hot tub as wellAfter Larry assessed the situation further and found out that there was also a problem with the hot tub itself, Larry told Mr*** that he did not have the expertise to resolve the problem with in the hot tub, and that Mr*** would have to get in contact with a hot tub technician to resolve the internal problem with the hot tub
Mr*** did mention to Larry about his heated floor and hot tubLarry did say he would look into it, but this was not part of the original pricing and or agreementAfter reviewing the floor and looking into it Larry called Mr*** and explained to him that he is unfamiliar with this floor and doesn't feel conferrable trying to fix it and suggested to Mr***, the Customer Service representative that Larry spoke to about this floor said to "contact the people who had installed the floor because there is a warranty on it and they should be the ones to come out and repair at no costMr*** had said that Home Depot was were he had purchased and had them install itLarry also explained even if he was to try and correct the problem, in the future if something were to happen to the floor, that Mr*** would have to pay out of pocket for repairs on the floor because it would void out the warranty
The 220v line was never installed or priced out because Larry explained to Mr.*** that he would have to cut into drywall or run the line external with conduit pipingMr*** did not like that idea and declinedThere for there was no additional charge for running the 220v line
There was no agreement on siding work being done on Mr*** property
Break down of Material cost:
1.) Wire @ $
2.) xoutlets for barn @ x= $
3.) Hot Tub Breaker quote at $sale price with tax $
4.) Box @ $
5.) Breaker uninstall old and install new @ $flat rate
Total of $
Total labor cost left $@ hrbreaks down to $16.00/hr for a grand total of $Really how much cheaper do you want?
All work that was agreed upon has been completed
Also note that Mr*** nor was his wife there 1st day of workSecond day of work only wife was there3rd day only Mr*** was at the residents
Also Mr*** paid with a gift card of $collected from his wife for services rendered
**Can provide Receipts for material cost upon request.**
Initial Consumer Rebuttal /* (3000, 10, 2016/01/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I work hand in hand with small businesses at my current job and have successfully helped them growTo be successful, I teach them integrity needs to be at the front of everything they doMrsT***'s reply to my complaint has multiple erroneous statements
As stated in the original complaint post, the $job was for fixing the hot tub (not just changing the breaker), running a line, running power to my shed and fixing my heated floor
The hot tub breaker MrsT*** referenced in the cost break down is not installed in my breaker boxAlso, MrsT*** comments "2.)Replacing the old breaker to the hot tub because it was tested and it came back as a bad breaker, was the arrangement." is falseMrT*** was the first person that looked at the breaker, so it was never tested prior to MrT*** arrival at my houseAt my house, MrT*** stated he thought the breaker was bad, so he swapped it out for a new oneHowever, the new breaker he installed did the same thing, so the issue wasn't the breaker and MrsT*** reinstalled the original breaker and took the new breaker with him to returnIf MsT***'s comments above are accurate, how can an agreement be made before MrT*** tested the breaker?
Furthermore, the line job was not cancelled because MrT*** needed to cut into my dry wallIt was cancelled because MrT*** stated he was not capable of fixing the heated floors and the hot tub (confirmed by MsT***'s response to my complaint)Once he told me this, I told him I did not want him to do the line and that I would have another electrician handle it and the other two jobs
Another interesting item is the receipt states I paid $for payment of "work done" and MsT*** references this in the second to last line of her reply: "Also Mr*** paid with a gift card of $collected from his wife for services rendered." How could the work have been done / rendered if we paid for the job prior to any work being done?
Furthermore, MrT*** damaged my Hot Tub panel and sidingOver the Top should be held responsible for fixing the damage caused by MrT*** tucking the two power cords behind the siding and leaving the hot tub panel open
Another example of erroneous information by MrsT*** is the comment: "There was no agreement on siding work being done on Mr*** property." If that was the case, why was MrT*** scheduled to visit my house on 11/21/15? MrsT***'s comments support the line to the shed was already installed and MrT*** was not able to do the other three jobs, so why was he scheduled to visit my house? The purpose for the visit was to fix the items damaged by MrT*** and to return the $for the jobs MrT*** was incapable of completing
I should not be held responsible for MrT*** incompetenceWe agreed to four jobs being done by Over the Top LS Construction LLC and only one job was completedMrT***'s lack of knowledge prevented him from completing three out of the four jobs and he should not have agreed to do jobs he is not capable of completing
As I stated in my original complaint, I want to be fair and pay for the work that was completedThe facts are the only job that was completed by Over the Top LS Construction LLC was the line for the shed
Based on the cost breakdown provided by MsT***, the cost to run the line to the shed cost $(it took one day - 8hrs at $p/hr., $for the wire and $for the box and outlets)
Even though MrT*** originally told me he would refund me $400, I will accept $based on MsT***'s cost break down
