I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
We are currently in the process of trying to get estimates to repair the concrete so we can pursue this further in small claims court. However, we are having difficultly getting estimates from companies that do this work. I understand that the damage was done by a contractor that Over The Top Roofing uses but we did not pick that contractor, our contract was with Over The Top Roofing. As for the response from Over The Top, this is more than they communicated with us on their thoughts on the offer from the 3rd party. When the representative from Over The Top initially came to our house to take picture of the damage, he assured us that he understood the damage and they he agreed with us that it should be fixed. This response is now a full turn around from that. After he came to the house for the pictures, he contacted the 3rd party. I am not sure what was stated in the discussions with the third party because I was not party to them. The third party did eventually send an insurance adjustor to our house to view the driveway. After repeatedly following up with the insurance company, we received a copy of the adjustor's report. We had questions regarding this report that we forwarded to the insurance company and these questions were flat out ignored. We were told that this was their final offer and we could take it or leave it. We feel that we have no choice at this point but to pursue the matter in small claims court.

This issue originated from damage that was incurred by a 3rd party company that delivers material to job sites for Over the Top Roofing and Construction (OTTR). This 3rd party company is not affiliated with OTTR  other than they provide services to us and our customers.  Before we use a vendor we ensure they have proper insurance to handle any claims such as this.  That being said when we were made aware of the difficulty in dealing with the 3rd party and dealing with their insurance company from our customer we got involved to see how we could be of help.  During that process we nearly doubled the amount offered by the 3rd parties insurance company. Based upon our inspection and what we see needs to be repaired we feel that the amount offered is fair to repair the damaged concrete.  We also see the homeowners request to repair the entire concrete driveway when this 3rd party did not damage the other areas in question.  We understand the stance that the insurance company is taking in the depreciation of the condition of the existing concrete.  In speaking with the homeowner the concrete had previously been mud jacked the year before reiterating the fact that the concrete is older and helps us to agree with this depreciated value.

To whom concernsWe have went out to this customers house approx. 8 time after the roofing project was complete. We have addressed all issues and the entire project was inspected by the city. We have emails from the city saying we went far and beyond anything we are responsible for and the roof was...

complete. I received a call from Nick on 12-1-15 about a leak in his sun porch. At that time I set up a time on 12-2-15 to inspect the issue. At that meeting I found that the leak that was accruing was a leak in his sun porch roof below and away from our shingled roof which we are not contracted to repair. He asked since we did his asphalt roof why didn't we tell him that his sun porch would fail over time. At that time I told him that all thing in a house can fail at anytime such as his water heater, furnace, windows, etc. could fail and there is no way we can predict timing of failure. We recommended him to call his sun porch company and have them repair his roof over the sun porch. We stand by our work. Please let me know if there is any thing else you need. Thanks [redacted]

the leak and repaired on Friday 8/22.  It appears the area is very small at the base of the chimney and water leaks in only during a driving east or straight down rain. Brad is willing to work with me until resolved. I would like to rescind the complaint against Over the Top roofing.

Here is an update to our complaint-After the Revdex.com forwarded the complaint to Over the Top, we were contacted by [redacted].  He came out to our house and inspected the chimney and determined the cause of the leak.  He provided us with a quote for 2 options to stop the leak.

Review: New roof put on in Nov. 2013 Paid in full

- On 11/17/13 a couple of days after installation it rained. Water ran into utility room and garage. Communicate to company via e-mail on 111/18/35 (received and read)

- Spoke with Brad who said the leak would be fixed.

- Over the Top checked roof - Downspout from second floor to the gutter was not put back after the roof was done. New downspout installed.

- Leak continued.

- Over the top thought the rain/water was going under the siding North of the chimney and running into garage. Contract for following work at cost of 1550. signed ion 6/19/14.

Part 1: Removed siding in problem area near chimney up the walls & remove some

shingles. Installs ice & water membrane to prevent leaks up and behind the

siding. Install 8x8 tin shingle. Re-install existing siding and shingles.

- Leak stopped for a while and started u again around the chimney. Company checked and caulked area.

- Company again notified in January 2015 - leaking into utility room. Over the top said it was caused by melting ice/snow going over the membrane. Installed an electric cable to melt ice and snow.

- 4/9/15 chimney leaking again.

- 8/15 Over the top notified again - chimney again leaking and roof East also leaking into garage. No response from Over the top

- 8/10/15 big rain storm - utility room ok - water coming in garage roof and around chimney. Informed again via e-mail.Desired Settlement: I am concerned that if Over the top does come to repair what has been done it will be worse then originally. I'm not able to go on the roof nor do I have the knowledge. I am not considering hiring another company to assess the whole roof and fix the leak.

I feel Over the top should pay for another roofer to repair what has been done.

Review: We had a new roof installed by Over The Top Roofing in June of 2014. When our shingles were being dropped off, the truck pulled on our driveway and cracked our driveway and caused some of the pads to buckle. My husband was outside when this happened. We immediately contacted the company regarding this and he came over and took pictures. We then contacted [redacted] because it was their truck that was dropping off the shingles. For the past two and a half months, we have been trying to get some resolution to this problem. We have had absolutely no support from Over the Top Roofing on trying to resolve this matter. I sent an e-mail to Over the Top after dealing about this for a month expressing my displeasure in the service. I immediately got an e-mail response saying they were going to help, but did not receive any help. We have been on our own trying to get this fixed.Desired Settlement: We just want our driveway repaired. We would like a driveway free of cracks and one that is even. We would like our driveway to be in the condition it was before our roof was installed.

Review: Having water leaking in new roof. Had the roof inspected and there is no ice and water sheild between sun room and roof. States in contracts that ice and water sheild will be applied to ANY penetrations. And also have felt paper installed witch there is none just shingles over osb underlaymnet.Desired Settlement: Would like the issue fixed and have all water damage paid for and fixed.
