June 28, 2016Dear *** ***:Please be advised that I represent Wyoming Valley Auto SalesI have received the complaint filed by *** ***Please allow this to serve as a response to the complaint made.Upon obtaining a vehicle, my client has his vehicles inspected by an independent garage
He has a long standing good reputation because of his business practices*** *** did purchase this car from my clientAt some point thereafter *** *** did make complaint of a brake issue.Although not necessarily obligated to do so, my client addressed the issue at no charge to *** ***Although *** *** indicates several other issues with the vehicle that occurred months after purchase, she made no further complaints to my clientHe found out about these issues when she filed this complaint about months after purchaseMy client attempted to contact her by phone on several occasions, but never received a call back.*** ***'s indication that the entire brake system is bad makes no sense as she continued to drive the car for at least monthsMy client has no way to fully respond to the other complaints since he has never been told of them or given a chance to look at the car, except that *** ***, by her own admission, indicates that the problems were not there upon purchase, and did not occur until months after purchaseMy client is always willing to go above and beyond to resolve any complaints, but in this case, almost a year has passed from the time of purchase until the time of the complaint to you, and my client has not been given any information or an ability to inspect the car when the problems occurred.Yours truly,*** **, Esquire

I am rejecting this response because: Wyoming Valley Auto is not acknowledging that none of these problems would exist if they would have not sold us the car under PRETENSES My elderly mother should not have to be dealing with a car that lets her down and is completely undependable when we saw a problem ( the check engine light was illuminated) before the car even left the lot and we let the salesman know Carl disabled the light and told us the car was fine!!!!! The car has been taken to several reputable garages and each has offered their solution The $fix that Fred, the owner, refers to was made at our expenseThe mechanic did say it was due to a catalytic converter problem, but the car could be drivenWe did accept Fred's offer to pay for that, but the check nor the paper we were told to sign never arrived Anyway, following that repair, the check engine light came on again Since then, it has been a series of engine cut-outs, white smoke and the car not starting at all It appears that the problems with this car are numerous and will take a great deal to fix This whole situation has been very stressful for our mother Wyoming Valley Auto's representative has certainly made it sound like an easy solution to this problem Just take the car somewhere and have it fixed However, there is so much wrong with it and the problems occur randomly, so it would be nearly impossible to get it to a garage at the exact time a problem occursAlso, despite Fred's claims, he has not been responsive to us in the past , why would we believe he will respond to us when the problems arise I believe that considering the deception that occurred at the time of sale, this problem is Wyoming Valley Auto's problem to contend with, not my mother's She needs a dependable car to get her to doctor's appointments and she really cannot mess with the unpredictable reliability of this car Again, we would have never driven the car off the lot and had these issues to deal with if Carl, the salesman at Wyoming Valley Auto would not have been so deceptive If this is acceptable business practice, even for a used car lot, then I am astounded I reiterate, the only acceptable action from Wyoming Valley Auto would be to take the car back for the full amount paid, because the car was sold under PRETENSES They can dispute the details, which again I stand by our recall of the events, but that is the bottom line We should not have to be dealing with all of the problems this car has when we would have made a different decision about purchasing it if we would have been told the truth at the time of sale Fred only becomes responsive when he feels that his business will suffer if he does not take some action I am clearly saying, short of returning the car for the price paid, we would rather share our truthful review with as many as we can, rather than accept his offer to "fix" the car , which based on past performance, he would not do anyway

June 28, 2016Dear [redacted]:Please be advised that I represent Wyoming Valley Auto Sales. I have received the Complaint filed by [redacted]/[redacted].To begin, my client does not agree with all the facts indicated, but he continues to be willing to rectify any issues. The warranty purchased by the...

[redacted] indicated, and my client initially insisted, that any work be done at the service shop he regularly uses. He does this because he can the needed diagnoses directly from the garage which clears up any confusion. In this case, several mechanics that [redacted] has taken the car to have given different or incomplete information. This has potentially caused confusion about what her own mechanics believe is wrong. My client's offer of $200 was based upon his understanding of what was wrong with the car after speaking with [redacted] and her family, and the cost it would take for him to get it fixed. If they are now saying something else is wrong, he needs to know exactly the issue, and he will address it. They can either have the work done at the location where my client has his service work performed if they are willing to bring the car there, or he can pay them the amount said station would charge for the fix and they can take it anywhere they like. The cost quoted by the dealership is not reasonable for this type of fix, even considering the request for the upstream part as they indicate.My client has attempted to call [redacted] after the complaint was made, but she refused to speak with him about it to resolve it. Yours very truly,Jeffrey Y.Esquire

I have received the Complaint and have multiple issues with it. First, while he accuses me of misrepresentation, the actual sale price of the car was $4200 not the $4800 he indicated. Further, while he makes allegations that I tried to hide parts of the [redacted] report, his Complaint states that the...

report I showed him "clearly" was missing pages, but that he bought the car anyway, and did not ask for any further documents. If he thought something was missing, he could have asked me for it before he bought the car. As my reputation shows, I always do what I can to make a customer happy. Upon receipt of this Complaint, I immediately called [redacted] and left a message on 2 occasions, that if he was not happy with the car, he could immediately return it for a full refund. Of course, he has not even bothered to return my phone call. At this point, there is nothing further I can do, and it appears that he is very happy with the car, which was sold to him in great condition at a great price.

In his response, [redacted] generally repeats his initial complaints, and unreasonably rejects Wyoming Valley Auto Sales' offer to fully repair the complaint.  Wyoming Valley Auto Sales has already indicated that they do not agree with all the facts alleged, however, even if they are not responsible, are willing to fully fix the problem. To repeat, Wyoming Valley Auto Sales will either have the independent mechanic they use fully repair the issue, at no cost to the [redacted], or will pay the amount that mechanic would charge for the fix and the [redacted] can get the car fixed wherever they want.  Wyoming Valley Auto Sales is willing to do this despite the fact that the [redacted]' own mechanic indicated on his diagnostic report that there is "no drivability concern" with the vehicle.  This offer to fix the vehicle has been made from the start. Had this offer been accepted long ago, the [redacted] would not have faced any of the issues he has listed. Further, [redacted]'s complaints about the initial offer of $200 for the fix, was based upon an apparent wrong diagnosis by [redacted]'s own mechanic.  Once the issue was clarified, the offer to fix it was changed accordingly.
