I am rejecting this response because:I have tried to pay the $in assessments but the company has rejected and told me I now need to pay $110. Make up your mind, $or $110?!? They are the most difficult people to work with and we are in the process as a community to find a replacement property management company. I will NOT be paying the $

The decision would have to be changed by the Fossil Ridge Metropolitan District NoBoard. As Mr*** is aware he can attend the District meetings and address the board during the Open Forum session

The owner is still past due $in assessments and will going to receive late feesWe have explained this to the owner and mailed him a copy of his complete ledgerThe late fee policy is an Association policy not an Overlook policy and the Association will not waive any more of his late
fees per the board of directors

I am rejecting this response because:I have provided unequivocal photographic evidence that the fence was damaged long before closing. Therefore, per response it is not my responsibility to repair the fence for damages done prior to closing. The continued finger pointing of who is responsible between Brookfield (developer), Fossil Ridge Metro District, Overlook Property Management, *** Homes is absolutely ridiculous. All I have asked is for the responsible party in this issue to step forward and resolve the issue; however, as demonstrated all parties (Brookfield, FRMD, Overlook, ***) simply want to point fingers at each other and continue to claim that I should pay to repair something that was damaged prior to closing

In response to this complaint,This owner consistently pays both the Master and Paired accounts lateWe have always tried to work with him and have waived his Paired account late fees times, and the Master Account late fees have been waived timesWe have no issues with *** ***, they
save all the envelopes and we are able to prove Mr***'s statements on delayed processing of his checks are not valid.Mr*** is still past due, he has been mailed a copy of his account ledger and we recommend that he catches up his account as soon as possible

We appreciate the complexity of Mr. [redacted] issue and are regretful that he is having difficulty having this matter resolved in a timely manner. However, it is [redacted] position that we did not install the community fence, we did not hire the subcontractor who did, nor did we damage the fence...

at any point in time. As such, [redacted] Homes does not warranty the fence. Upon inspection, it appears that the fence was not properly installed and that the panels were not anchored sufficiently. Concerning our previous warranty manager's response to the reported issue - Danielle revised her response to the complaint once she looked into the matter further and realized it was not a [redacted] Homes Warranty issue. She reported these findings to the homeowner, along with an explanation, per his own honest statement. Furthermore, our one year limited warranty is for the construction of the home only. We do not warranty Metro District structures, public lands, or open spaces in any way. We appreciate the opportunity to respond to this matter and hope that Mr. [redacted] is successful in his future efforts concerning this maintenance item.

The HOA Board of Directors makes the decisions for the community and our office assists them in regards to their decisions. The Board walked the property with the landscape company in the fall and a bid was prepared to replace some of the dead plants. The plants were not replaced one for one as...

overcrowding is a typical problem in the community.  The landscapers did get a late start with the planting and then it was delayed even further because our community is having fiber optic lines installed through a program with the City.  This installation has created many irrigation breaks and we did not want to jeopardize the new plants.  The Board will be walking the property again to approve the completed work and decide if additional plants should be installed.  The community has received two bids for the asphalt repair and maintenance. Both companies stated the pot hole could not be  filled and that a patch job would be required.  One stated the pot hole would not damage a vehicle, therefore, it was not considered an emergency. Both companies are scheduling out into September and October. Overlook Property Management strives to assist every owner. I will contact this individual and explain the process of the Board and answer any of her remaining questions.
