Bardin Greene ApartmentsBardin Greene DriveArlington, Texas 76018817-987-4200Tuesday, October 3, 2017Re: Complaint # [redacted] , [redacted] Dear [redacted] ,I received a fax today regarding a complaint made by [redacted] .? This is the first time I have received any information or correspondence regarding this complaint.In response to said complaint; the applicant was not given information regarding the cable/internet provider.? She applied for the apartment on 8/4/17, was scheduled to move in on 9/15/and was notified of her approval status on 8/11/17.? At the time she applied, she was provided with a copy of a Welcome Home Letter, which provided her with her new address as well as the contact information for TXU and Time Warner to set up her services/utilities.? She did inquire about AT&T service, at which time I told her she was more than welcome to contact them and see if they were able to service her new apartment.? Additionally, the applicant signed our rental criteria as well as the back of the application, which states that if you cancel your application after you are approved, your deposit will be held for liquidated damages.? In reference to the lack of response from the corporate office, Ms [redacted] did in fact speak with my supervisor ( [redacted] ) on Tuesday 9/12/17, at which time she also informed her she would not be due a refund.? Ms [redacted] then proceeded to berate her using vulgar language as well as bad mouth our community.? I spoke with Ms [redacted] a few days later and she informed me she did not wish to cancel her move in, until she was sure she could find something else that would accommodate her needs.? To date, we have yet to hear back from Ms [redacted] , she just never showed up to move in.I have attached the back of her signed Rental Application for your review.? Paragraph of the application states “Application Deposit (may or may not be refundable).? In addition to any application fee, you have delivered to our representative an application deposit in the amount indicated in paragraph 14.? The application deposit is not a security deposit, but it will be credited toward the required security deposit when the Lease Contract has been signed by all parties; OR it will be refunded under paragraph if you are not approved; OR it will be retained as liquidated damages if you fail to sign or attempt to withdraw under paragraph or 7, if you fail to answer any question, or if you give information.”? Additionally, it states in paragraph “Application Deposit (may or may not be refundable)”.Please feel free to contact me if you have any questions or need any additional information.Thank you, [redacted] Community Manager, C.A.M

Complaint: [redacted] I am rejecting this response because: The information stated was false.I have received misleading information from everyone in the officeBardin Greene is not professional, very rude, and are not honest and upfront about informationNo one ever mentioned a contract for Time Warner until after I paid my depositI would have never applied if I had known that my cable provider AT&T was not allowedI called the office several times and no one ever responded.? My name is [redacted] and I am the manager of Bardin Greene Apartments located at [redacted] ? I am writing in response to a complaint that was issued with you from [redacted] Small, [redacted] ? On October 16, 2015, Ms [redacted] called inquiring about a three bedroom apartment home for her and her four occupants.? She had a voucher issued from the City of Arlington Housing Authority for a bedroom apartment.? We let her know that we did not have a three bedroom available.? Later that day, Ms [redacted] came into our office inquiring about our two bedroom units.? We let her know that according to our familial status guidelines, the maximum number of occupants permitted in a two bedroom is four persons.? She then came back a few hours later and stated that her newborn baby would be staying with his father, therefore she would now only have four occupants and could take a two bedroom.? We informed her that she would have to bring the updated voucher from housing showing the amount for a two bedroom? Our leasing agent, [redacted] , accepted her application and proceeded with the approval process? Upon running Ms [redacted] credit, we found that her credit did not meet our criteria and she was denied.? Upon further review, we approved her with an additional deposit, pending the updated paperwork from housing showing that the voucher was for a two bedroom now instead of a three.? She said that she would take care of this and get the information to us.? ? Rather than bringing us the updated voucher, she sent us paperwork from the Housing Guidelines Book stating that we had to accept the three bedroom voucher for the two bedroom apartment (please see attached, page 8-17.)? At this time, my assistant manager, [redacted] , contacted [redacted] at the Arlington Housing Authority to find out if this was accurate and if they had been informed that she would only have a total of four occupants and would be taking a two bedroom apartment.? [redacted] informed [redacted] that they had not spoken with Ms [redacted] and that they were unaware of her deciding to take a two bedroom apartment.? She also confirmed ? that the voucher for a two bedroom would be less than that for a three bedroom and would not be enough to qualify her for a two bedroom in our community.? I have attached the email correspondence as well as other documents for your review? Ms***? came in later and asked for her deposit back, stating that she was cancelling because we were “giving her the runaround.”? She said that she would file a complaint with the Housing Authority as well as the Revdex.com? We have done nothing wrong in this situation.? We have abided by the same guidelines for the requirements of anyone who applies to live in our community.? Please let us know if you need anything else from us?
